It seems that I bought a starter a few weeks ago and the price changed from $120 to $150 yesterday.

I owe them $30 by the close of business tomorrow or they're gonna send some guys...

if you have a receipt the receipt says you recieved merchandise in exchange for $$$ on such and such day. the part is yours, tell them to f*** off. they made a mistake.

It still doesn't make any sense to me. What you're saying is, if I went into a JCPenny, bought a pair of pants for $20..and the next day, they raised the price on those pants..that I would owe JCPenny money. Uhh..no. Things don't work that way. If you didn't tell the guy from Olympus Auto to **** off right then and there, I don't know why.

The agreement was that Jason owes him Fudds... the next Fudds meet is next week. While there has been plenty of time, the time when he would pay (by buying lunch) was set.... Therefore Calvin shouldn't have made plans for something that was no longer his... even if he hadn't yet received payment.... That's like if you buy a car, and you're making monthly payments but the car company decides that they want the car back because you haven't paid, but the payment isn't due for another week.

Pre-arranged agreements can't just be changed at the whim of one of the parties of the agreement... I don't recall Calvin saying "I reserve the right to take it back whenever I need it until you pay." However, I'm pretty sure Calvin did say it's OK if Jason treats him next Fudds meet.

if it's not paid for, isn't that essentially a loan?

Your basis for argument is incorrect in assuming that this is payment series over time. This is/was a 1 time payment deal on a predefined date - definitely far less than a car payment. If you told me that on a certain date, you would sell me a megasquirt and i will need to pay you X for it. And on that day, you have megasquirt in hand and i don't give you cash .. what would you do? now let's assume (like in this scenario) that you still gave it to me anyway, because you're a nice guy. How long would you consider a "fair and reasonable" amount of time for me to pay you for it? I don't want to put any words in your mouth or assume how you think but honestly, almost 4 weeks later is a bit much wouldn't you agree?

Let's not also forget that I've had deals with jason long before and I've been very prompt with my payments to him. I'm just expecting the same courtesy.

I consider the maryland folks a little closer personally than if i was making a deal with someone in cali. So i guess to cover my side, I should have written up a contract with all the legalese involved for non-payment or late-payment or any other situation whereas, thereby, henceforth and so on? Maybe get a notary public involved? I would hope not.

And for the record, I'm pretty sure that I said to Jason that the item was "on loan" until he paid me. So please don't assume what you might have heard from me at the previous meet. Honestly, and this is my opinion of the matter, if I haven't paid someone and offically completed a business deal, I wouldn't have done anything until the matter was resolved. Only then I would go about my personal business knowing full well that that item was now 100% mine.

My logic is fine... I wasn't assuming that the payment was a series over time... only that Jason said he'd pay you on a pre-determined date...

My main point was that you can't expect someone to sit there and do nothing with something that's in his possesion... nor can you expect him to wait around for you to decide that you want to do something with it, on loan or not.

To use the car analogy again... (and not with reference to multiple payment, as that obviously isn't the point) I buy a car using a loan from the bank. That means that technically the bank owns my car, and until i've paid up, it's theirs. However, they don't reserve the right to make plans for that car, nor do they tell me I can't modify it however I want.

It is obvious that Jason fully expected to pay you by buying you lunch at the next Fudds meet... In fact, he fully planned to pay you last time, but you went in and got food before he could buy it. Since the original deal was for him to buy you lunch as payment, and since i heard you agree that he could buy it for you at the next meet, that's the end of it.

As for the megasquirt deal, I would treat it as I'd treat any business deal... no money, no product. In your case, I would've held onto the lip. Since you decided to let him have it anyway, OBVIOUSLY so he could do what he wanted with it.... then there is no more cause for argument. If you didn't want him to do anything with it, you should not have given it to him.

Honestly, I don't see why this has had to drag out into paragraphs and references.... If you give something to someone pre-payment, then you're allowing them to own and do whatever they were going to do with it before the actual transaction, a decision made on the reputation and trust that they will come through on their end to seal the deal.... How the hell do you "loan" something out to someone with a price tag attached to the end, anyway? To loan is to expect it back in the same condition.....

I never heard of anyone demanding extra onto an agreement that was already made beforehand, makes things seem really shiesty.... If you have enough trust that someone can pay you later, then have enough to actually finish out the term.... I doubt anybody here actually thinks Jason is capable of not being able to come through on his own debts, so why have you started?

Also, it's pretty lame for someone to start calling out people on their repuation before actually trying to settle it out of public eyes first.... If you want to keep going on about it, maybe you should settle things with him face to face before arguing with everyone else....

i guess i'm one of the only people in this thread that believes keeping an item exactly the same as it was given to me until it's paid for is a good idea.

my LAST comment, to avoid getting into any sort of spitting match, is this: if this situation were turned around, or if ANY of you were in his shoes, you'd be pissing and moaning too.

No, I agree it's a good idea as well... However, when making agreements with people you know and trust, little matters like this shouldn't even come up....

Had he even asked Jason before why payments were taking so long, if he had an issue with it? Had he specifically told Jason what might be going on if he didn't pay sooner then later?

There are a few ways this could have been handled better, and just outright demanding payback for something he didn't have awareness of is a bit selfish....

And I hardly would call any of this worth "spitting" over, since it doesn't have to get further then him just asking Jason in person or private about how to settle this matter or get payment quickly.... But to answer your statement, if I was in the same situation where I potentially might have had someone else interested in it and needed money for it ASAP, I would have held onto it myself till the first person with the money paid up.....

The main point I have been trying to make is that i wouldn't have let the situation occur in the first place. If i give something to someone trusting that I'll get paid, then it's his/hers to do what he/she wants with it. I wouldn't have assumed anything; I would have contacted the person I gave the item to before making other plans for it... What is the point of giving something to someone if not for that person to USE it?

My point is that so much was done wrong here that I don't think anyone should owe anything aside from what was agreed upon, and at the very least, this shouldn't have been made a public matter without even contacting Jason first.

DEAR GOD. IT'S JUST LUNCH. YF You need to chill out, seriously. It's not a big deal, it's one meal that you haven't yet recieved. It's not like it's $500 dollars that you need for you're emergency surgery. NO, It's a $10 meal. NOT IMPORTANT. And don't say "But the point is.." because this is not a situation to make "points" about. You should not be so uptight about $10 or less.

Edit; falnfenix, what business deal with Jason went sour? As long as it's worth more than $10, please feel inclined to make a big deal about it. Some other people don't show that courtesy.
