Angry Blew a rotor.

Okay, so here's the deal... I buy an 87 RX-7 off Mr. A. H says that Mr. B rebuilt the engine, so, it's a good engine and everything's fine with it. No worries.

I get the car, driving great... a month and a half after buying it, it blows a rotor.

So I bring it back to Mr. B (the guy to who fixed the car up). He is saying that there was not a rebuild done to it, there was just some seals and gaskets replaced. Whereas, Mr. A is saying that he put $2000.00 worth of work into it!

I am not too sure where I should go from here. I know that a month and a half on a rebuilt engine, would never, ever make it blow a rotor. Should not, anyways.

My dilemma: I am down ****'s creek... The guy who sold the car to me, seems like a great guy, but the fact of the matter is that he sold me a "rebuilt engine" and it blew after a month and a half.

Any suggestions as to what I should do? Who I should go after? Mr A. or Mr. B??

Suggestions appreciated!

go after the guy who sold you the car bacause hes the one that said it had a rebuilt motor not the mechanic that "rebuilt" it he told you that there were just some seals replaced.

Sounds like time for "SMALL CLAIMS COURT"
Your grounds: misreprensentation of goods sold.

You need a affadavit from MR. B stating what he did to the car . You also need proof that MR.A stated the engine was rebuilt. I am not a lawyer, you need to see if DroptopRX7 can give you some advise.
I don't know if CA is a gentlemans agreeement state. You need to find out.

He also sold it as is... but still told me it was a rebuild... am I still okay?

imo its going to be on judge judy and its gonna be your word against his. If you take it that far... Just make sure not to speak out of turn Judge Judy hates that ****.

I personally think you don't ahve anything. IMO you should bit the bullet and rebuild. As is, is as is. Sorry and good luck!

The most you have to lose at this point is the filing fee for small claims court: ~$50
What have you got to lose?, your bud screwed you over.
Of course he can counterclaim your recent mods caused the motor to blow.Or that racing caused it to blow.

... but isn't it fraud or misrepresentation at sale if he said the engine was rebuilt? No matter whether it is as is or not.

You will only know the truth when, you open the engine. I had a guy in MD who rebuild my engine with a street port, good condition housings, etc. A year later the engine starts dumping coolant over the overflow canister, I blew the engine shortly after while running the car with a busted oil cooler line (long story). Anyways, after another mechanic cracked open the engine:

1 - Housings where corroded, VERY corroded.

2 - Half *** ported job, he probably forgot to port one of the end plates. Not to mention that my sister could've done a better port job on those that he did port.

You can't go after anyone without proof. But, if you have a liberal judge/court system in your area, you might get settlement.
Sometimes its difficult for you to prove that someone said something, especially if you don't have the receipts to prove it and if that person denies what was originally said.

Since it is a used car, see if the lemon law can help. Depending on time(six weeks from date of purchase seems too long) and price(actual amount), you may be entitled to some compensation but it depends on the laws in your area and how much time and money you are willing to spend on the lawyer.
It might help if you can prove that you overpaid for the car, compared to others in the area, because of the rebuilt engine.

My personal opinion is that after 6 weeks on a 15 year old car, broken components can only be expected--rebuilt or not. 6 weeks of abusive driving or neglect can break anything on any car.

Yep! Your choice is to hassle with it or forget about it you may get lucky and walk away with something or you will walk away with less than you had before. If anything a lesson was learned (to bad it's going to cost) don't believe people.

I have proof that he was selling with a rebuilt engine... written on an email.

Should be good. I will talk to the guy and see what he has to say. I think best bet is me going after him for the money and him going after the mechanic for the money.

Yes, but I have an email from him saying that he has a rebuilt engine on it.

Im in the same boat as you...really sucks... I had money set aside for my race car that isnt finished so Im using that....really sucks *** when you get screwed though doesnt it?

Update....

Not a whole lot of good resolution to this... I ended up getting a second (donor) car with a new engine on it. The dude that sold me the car actually helped me yank the engine out of that car and I'm going to get another to finish the job up. Can't wait!! Supposed to FINALLY be done by this weekend.

Wish me luck! (haven't had much of it so far)
