1) Attorneys will typically only take on cases (with no money from their client ) when there is personal injury involved and their client is not at fault or is insured. Why because they don't get anything from property damage settlement. They get their $$ from pain and suffering compensation.
2) Attorneys will represent your property damage claim as long as you are footing the bill. Which ain't cheap at around $200 bucks per hour... And each hour is not productive either. For example: Lets say a lawyer has his secretary type a letter to the person that you are suing and it only took 10 minutes, but you will get charged a 1/2 hour. That's $100 bucks right there. Expect to pay up at least 5k just to get the matter settled out of court. Now if you go to court expect to pony up at least 15k.
3) Yes if you win the case you are entittled to get money from the person that you sued for legal fees. And in real life good luck collecting unless the individual has a lot of $$ or owns property. Yes you can dock his pay but what good is it if the dude changes jobs every 3 months to avoid paying you or refuses to work. This why lawyers dislike to sue individuals, it much easier to collect from corporations.
4) Let's say the you win the case in open court (because you were after punitive damages remember) and you are already 20K in the hole. But you have been awarded legal fees, and the property damage which in this case looks to be no more than 1k. So right off the bat you are entittled to get 21k from this guy.
what about punitive damages though... Yes your lawyer can seek 100k, but ultimately the judge decides what you should get. And it's probable that the judge may throw out your claim if he/she thinks that you are full of it. Or may just give you 1k in punitive damages like I said he/she will grant you as he/she sees fit.
So in recap you have a $22K award that you spend $20k to get, and all this guy has to do is not work and thus not give you a dime (and no he does not get thrown in jail). And oh yeah that award does not include the time and money you spent in this case (missed work, school, gas in order to get to the lawyer's office or court).
yeah it seems worth it don't it? So yeah it ain't gonna happen.

I would also press for the depreciation of the car's value after being hit.

I have a friend who chose weed over me, too. I even confronted him about it before he started.. told him if he got big into it he shouldn't expect to see me much because I can't stand marijuana (smells, gives me a wicked cough).
The point is that any friend who chooses a drug over an old pal isn't worth the time, as this story has proven. I'm going to make sure to park my 7 in the garage whenever it gets back. Glad to hear you hunted the bastard down, though. Way to take advantage of your smarts.
