As stated below, I ask the seller (theo481) for a Prosport Tri-pod gauge holder in the private message I send him, clearly the item was stated and the price was offer.

Payment was sent on Feb. 20th, item was sent out on Feb. 27th!!
Item is picked up at today March 5th at postal office.

Open the parcel, item in the parcel was not the prosport tri-pod I requested during the first initial contact with the seller both through thread posting and pm. The item was a tripower dual gauge pod.

Already submitted a paypal dispute since seller noted that he will not refund.

Please post a link to the for sale item, it's part of the requirement of posting in this forum, as per forum rules.

2nd: my response was posted at the bottom of the forsale thread, I'll copy and paste it here for you as a reference.

I'm almost sure that this is not my fault. I never deceived you at any point or tried to give you something that wasn't listed.

As far as I'm concerned, I don't believe that I'll be refunding you anything.

I am sure you have no intention of deceiving me. However, I pm you regarding a "Prosport Tri-pod Gauge" if my pm message should have say "tripower pod" then I would have been wrong.
"Prosport Tri-pod gauge" vs "Tripower Dual Gauge" is close in name? You have got to be kidding right?
I clearly asked if you have the item and would agree for 85shipped, in which you did confirm both the item and the price.

In conclusion, you did not have the intention to rip me off, however you agree to have the "prosport tri-pod gauge" that I asked for but sent me a Tripower. Therefore, I believe you should refund me as soon as I sent the item back to you with delivery confirmation.

I thought I saw a Prosport tripod gauge posted on the seller thread for $100 ~115 (no picture), that is why I asked to confirm if the seller has it, which is why I asked for 85shipped to 92683. Instead, the seller has a tripower dual gauge which is posted for $50. If I knew I was asking for a tripower, why would I ask for 85shipped?

1. When I searched for that "Prosport tripod gauge" No results came up, it could have just been my connection though, so not fully refuting that.
2. When you PM'd me you didn't ask me what I had, you just offered a 85shipped.
3. It is impossible to edit the posting.
4. Your message on the Thread was "you got pm for tri-pod" I then got an offer, for 85 shipped. I accepted, and even then put, Tripower sold!, and you never said anything to the jist of "that's not what I wanted," or "wrong item."
5. I really don't think you read anything at all.

justaimme, could you please close the dispute. Whatever the outcome of this on this here forum, I'm willing to make it right in the eyes of the MODs, as I am starting a vendor account soon, the last thing I need is bad feedback on here.

I still don't think I did anything wrong and I think we can come to some sort of a resolution here, I just don't want paypal to dig into my checking account against my will and charge me 40 in negative balance fees.

Just to try and get the ball rolling, why don't you put the item up for sale? for 50$ or what ever you want to (reasonably of course) and I'll refund 50% of the difference minus shipping, so about 10-15 bucks? I had a few PM's on the pod so I'm sure it will sell in a fair amount of time...

Hell, check the thread it was for sale on to begin with, and there were even a few people wanting it there!!

to Answer your "2." Yes, I did state in the PM that I want a propsport tripod for 85shipped. If I want a tripower, I would have offer 50shipped and not 85shipped.

Reason I did not looked at the thread and assume that the tripower was sold to me is because I pm you about a prosport tripod and you agree to it.

Yes, I would love to resolve this in a professional matter. But the right way to do this is for me to return the item with signature confirmation, I will incurred the shipping cost myself. And lastly, you can refund me the $85. I will close the paypal dispute once this is agree upon.

Sorry man, but I'm not taking the brunt of this one because you didn't read. What you "offered, shipped" was of no difference to me. The way I looked at it was that maybe you were a AK or HI zip code, so you were sending extra for the extra shipping charges. Frankly, it doesn't matter to me what you offered.

Case in point, you asked me for an item I wasn't even selling and was, arguably, very close in name to something I WAS offering, didn't read the thread to realize what YOUR mistake was, and now I am expected to fully refund you because you didn't read.

Please reconsider the previous offer, as it will still stand.

From personal experience, PayPal won't protect you because you bought the item from a third party, not eBay, or Half or one of their actual sponsored venues. I got ripped off for 2k worth of stuff and they told me to deal with it.

If a prosport tripod gauge vs a tripower dual gauge is "arguably close in name," then we have nothing to discuss.
Case in point, I asked you for an item that you weren't selling yet you still say yes and shipped a different item.
I will not accept the previous offer even if I lose the paypal dispute.

I never suggested that it was 100% the same. And to be fair, you only once referred to it once before the sale as a Prosport. Every other message just said Tri-pod.

Yes I only refer to a Prosport once because that was my first PM to you to ask if you had the item and is willing to sell it for 85shipped? And you confirm and imply yes. Therefore, I feel it is unnecessary for me to repeat it again in further message in which I ask for shipping updates.

I agree, to a point.

1. If this was my mistake, I would correct it. Just like you asked, why did he PM me for a random part.
2. Maybe 85 bucks isn't a lot for you, but for me, trying to go to school full time, without taking every single loan possible is not a walk in the park, that 85 bucks can last me a month or more depending on what comes up. And besides, the determination of "how much money it is" shouldn't be made by you, because it is obvious that to both parties it is not spare change.

Since no one is going to accept blame, and justammie doesn't want to compromise, I will be done in this thread, minus me being PM'd by a mod to come back here.
