flood damage, need help deciding

flood damage, need help deciding

short version of story:

engine block got rusted due to a flood i had in my garage. we are going threw the home builders, they have a drainage issue, they are at fault . we did not have flood insurence. what should i claim

one person suggested :

get 3 quotes for garrenteed running engines and show the price and get a check written:
mazda
gothem
rotary resurection
(problem being 2 of those need a block to work off)

what is your suggestion?



LONG VERSION:
k. we bought the house befor we saw it. it is a brand new house pritty much(4 years old, we've been here 3 years). it had a leaking issue. carpet got soaked in front room we thought it was from the foundation having a crack but it was actualy coming from upstares .
there is a neiborhood on a hill just about 1/4 a mile north of us. they are the same development prity much. built at same time. there is a slight slope down to our place. then there are a few west to east streets. one north south street that points towards the upper neiborhood .well. the watter rushes down the northbound street from the hill. and rushes to the last west/east bound street . that being ours. then it rushes out to the natural drainage . that happens to be infront of our house. our house is lower then the street level. our driveway slops down. water actualy runs between all houses pritty much aswell. but because our house was slightly lower. and because we are right by that ditch. the water backed up cuz of hail and **** that got caught at that gate they JUST put up befor the storm. so our garrage had 5'' of water in it all the way to kitchen door. if it rained for 5 more min or less. we would have had water in the house. and my mom just spent 7-8,0000 on new kerio cabinet for tv and new custom dining set. we actualy now have tile in front room becasue of the water problem we had.

first 2 rows of pictures show a slightly strong storm from 3 years ago, when i first moved here. it shows how even a slight rain can make 3-4 inches of water on the street. and how that drain channel fills up quick.

Man, the photo's of your neighborhood are depressing. I hate plot housing. I honestly think I hate most new houses. They look nice. Yeah. They're new. And there's so much of them that they just build them where ever, leaving the clueless buyer to deal with the problem of their million dollar cardboard box falling apart.

If I ever invest money into a new house, it'll be an old one. An old house, you will know whether or not a problem like this is going to happen, because the scars of age will be left, if you have the eye to look out for it.

Did I get this straight though, you bought the home without having yet even seen it? Why would you do that?

That's a damn shame seeing that happen to a seven, and I'm sorry it's happened to you. If your motor rusted, I'd also invest some good time in checking your frame for rust. Check out atkins rotary. I think they sell built blocks without cores. I'm sure there's other vendors that sell built without requiring a core.

we lived in cali. my mom was being transferd here. she saw the development. and was in side one of these houses befor. and trusted the realiter guy. nothing more is wrong with this house. nothing is bad with the home builders. its just the land they built on. there are 3 old neiborhoods around us. they are all fine. no serious flooding problems its just our lil area of land.

centex is going to re-locate us. and give us a bigger house and money for our problems.

its not like we are trying to hard to make them do what we want. they are working very well with us.

the engine in my rx7 is fine. it was a spare engine i had in my garage

not quite sure what you can do..... here in cali, im pretty sure to claim something like this, you'd have to show proof that the motor was a fresh rebuild (like a receipt) ... insurance people are scanless, and will do everything to screw you over... so this will be tough to get anything from themw/out showing proof of what the motor sitting in your garage was worth... if you give them quotes from engine rebuilders, they are probubly gonna want proof that the motor was just rebuilt before the flood... otherwise, they will probubly give you little to nothing for it....... but im not an insurance guy, and im sorry to hear about the flood.... and i hope they compensate you! good luck and lemme know what happens

na . insurence people arent the issue.

because there is no flood insurence involved. they might have protection type of insurence for themselves . like doctors have malpractice insurence. but, would you really have a recipt if you buy it from a buddy cross town?

and i can fight that.

i already have people who will write it off for me. cuz . i doubt if they come with inserence people that they will know jack bout rotary

also
and this is most important

they dont waint a law suite on their records. they will probly do anything to make it not go to court. concidering they are building several other neiborhoods right now. and they want a clean record or else the houses wont sell .

Brand new reman from speedmachineperformance.com is $2,900 toss that on your list of prices. Sux about the flooding. I think I would also buy and older house like skyminded said.

You can argue all you want and get quotes for replacement, but the insurance companies are going to fight you tooth and nail - forget it.
UNLESS you have receipts for recent work that covers all the big ticket items (i.e. engine rebuild?), you're basically SOL...

Are you prepared to take them to small claims court?

small clames court?
hah..... na. this is a lil bigger then small clames cort. its 7 or more houses on my street that got flooded from the paith of water. there is nothing small about this case :-P
and they want to keep it hush and keep us happy and quiet

take 'em to task, whats there to lose?

Worst case scenario is they say, "nah the motor is only worth $XX.XX" and you're left to sob - haha

I would try to get everything you can, especially when insurance is involved - not that Im advocating any type of fraud - just that this will end up coming from an insurance company's pocket regardless of whether its the builder's insurance or the city's. Just when I read in Forbes that insurance companies in north america were "distraught" at the record low profits of 780 million dollars for their 2005 year, I have no quams with getting everything to that you're entitled - because they'll fight you regardless of entitlement or not - you may as well go to bat for every last toothpick that is dripping.

Adding the car under the property damage might get a little sticky.
I mean you can't just take that $2,900 quote that someone mentioned and expect them to just fork that kinda cash?

pritty much thats whats going to happen
our property value is low because we legaly have to list that we flooded once befor if we are going to sell the house.
we spent several thousand in paint . tile. grass, laun treatments,
we have put alot into this house to make it look less typical.

my mom expects them to fork over cash to pay for our troubles of having to re-do this to a new house.

na we wont be moving into an older house. we have to kind of stick to centex. and they have another development aboud 5 miles from here in a good spot.

and we will be asking for a slightly larger house. hah. basicly so i can rip down a wall to one room and get 2 rooms. mmmmmm. 2 master bedrooms in one house. hehehehe...

yeah......
there are no real damages to our house.. god works in mysterious ways. we actualy have no expenvie damage other then our annoyance and the engine that got rusted..

but we are pushing it cuz its scarry in this house. just look at the pix

I would go to the loacal mazda dealer and ask them to give you a printed quote for insurance purposes for a reman S5 TII block... make sure they add the core fee on it and give it to the company paying the bills....


is that mold on the walls... because thats a huge law suit

good to hear that they acted on your problem, and that last part was confusing me (5" of water, and it rusted his engine? wtf, he must have that car seriously lowered)
