umm.... couple things missing for this to be considered assault.

assault 1) v. the threat or attempt to strike another, whether successful or not, provided the target is aware of the danger. The assaulter must be reasonably capable of carrying through the attack. In some states if the assault is with a deadly weapon (such as sniping with a rifle), the intended victim does not need to know of the peril.

TAKE A LAW CLASS!!!

For anything to be considered assault, the victim has to feel THREATENED. There was no threatening action here. It was not directed toward adam c. It was a ball that flew wayward and happened to hit adam c.

I'll go ahead and post this since some idiot's probably gonna say something about this being battery instead of assault:

battery n. the actual INTENTIONAL striking of someone, with intent to harm, or in a "rude and insolent manner" even if the injury is slight. Negligent or careless unintentional contact is not battery no matter how great the harm. Battery is a crime and also the basis for a lawsuit as a civil wrong if there is damage.

no need to explain that one.

so wait, what about malicious intent, knowing that the ball might slice (if one knows he/she is a habbitual slicer) but continues on with the golf-swing anyway?

Let's say you win.......now what?? The guy has to pay the $125 lab fee for testing your **** for blood? The incured $75 doctors bill, incured ONLY cause you smelled MONEY??

Let's pretend you were building a Cabinet and you.....all by yourself..... smashed your thumb with the hammer. The Injury and the Hematoma(sp) would be way worse than what you recieved from that golf ball and yet after you smash your thumb would you even dream of visiting a Doctor and having your pee tested?? I'll answer that for you.......HELL NO.

Move on....just apologize to the west forum for being a Fucktard with your lawsuit speak and move on...
