Advice...State Ref

So I was out driving last night not getting into any trouble, just driving. While leaving a parking lot after eating dinner with a freind a cop see's me and follows me out. IM thinking whatever let him follow me. Rides my bumper for about a mile then hits his lights, Im thinking here we go. I pull over and he walks up to my window do you have a license he asks me. Yes I do I tell him, I hand him my lisence and his next question is can you pop your hood for me. I dont mind the law or an officer doing his job, but i do like to know my rights and Im not afraid to ask questions. So I ask him why was i pulled over and he said my exahust is a little loud, and i say ok well I have a CB system in which he says well you got a lot of carbon on the outside and it looks like a race car. At which time I realize hes jus trying to be a dick. So i get out thinking whatever lets see how bad this will get. Upon opening my hood he starts jumping all around with the flash light asking whats this whats this whats this, in my head Im like why do they pop the hood if they dont know what they are looking for. He looks at my turbo and says is this your intake, in which I respond umm yeah thats my intake and he says ooo well wheres your carb number and I tell him i didnt know I needed one. Anyways he rights me a ticket for state ref. Ive been reading and i figured Im just going to pay the fine, but I just dont understand why cops have to be such dicks. As soon as i started asking questions he went from reasonable to a dick, he had a talk with me after and he was trying to put me " In my place " how its my fault I got the ticket i should have just went along with him, which tells me he did it just to be a dick anyways. And I saw to him Im not trying to be a problem I just like to be informed and know my rights I dont see why asking them should be a big problem. At which time he refers to the "two" stickers i have on my lower door as a whole bunch of racing stickers is going to get attention. I had my freind with me who over heard a lot of the last conversation, my second idea is to challange it in court, I dont think hes justified in telling me he would have only given me a fix it ticket if i would have been more couperative. Pluss how ignorant do you have to be to open someones hood and not know what your looking at, heres a picture of under the hood. Anyways thanks for reading my rant. Any comments on it or advice would be apprecaited. Thanks

pay the ticket and move along. it'll be a huge time sink and anxiety plus in the end you'll lose.

honestly there are 3 problems with this.
1. not knowing the law doesn't omit you from it. You can't kill your parents and say.. oh I didn't know that.
2. don't pop your hood. Course they'll say it's then probable cause and pop it anyways. BUT at that point you know you're screwed.
3. in traffic court you're guilty until you prove otherwise. reality.


The lesson here is to just do as the officer says. ... asking questions is a sure fire way to get a ticket. Liscense and registration? Just hand it to them and STFU.

The first thing in your post you said "So I was out driving last night not getting into any trouble, just driving." If you are driving the car you have , that's like looking for trouble to an officer. We aren't afforded the luxury of driving wherever we want, whenever we want. Don't be the only one on the street late at night.

just curious do you have a front mount? and how big/loud is your exhaust?

Yes I have a front mount, my exhaust is full 3inch with a silencer.

You didn't have to pop your hood. It doesn't hurt to fight the ticket. If all else fails, at least you know you tried. Once they say there is probable cause to pop your hood, you pretty much have to. The officer was doing his job, unfortunately he was being a dick about it. You also shouldn't have said that your turbo was an intake. You should've just told him it was the stock turbo, just polished or something. They wouldn't know the difference in most cases.

It's called "discretion". Google it.


You should of been well aware of the risks you take when running a single turbo FD in California. That's why a majority of the 7 owners don't do it. The people that do are mature enough to know you have to pay to play and don't bitch when they are hammered by the law.

Ain't that about a bitch Chris, week before your tune with Kan and this crap happens. No way will you pass state ref, and you will definately lose in court sorry to say...pay them and I think you are exempt for a year (although I can't be sure), they give you a duration on when to bring it back to stock after you pay the fee.

Just pray like I did, and hope that ticket never comes, I think I got very very lucky and somehow the CHP lost the ticket when I got popped on 880 Fremont and was issued a ticket for state ref. Ticket never came for court to my house and I called the court and my name wasn't even in the system.

Worse case scenario, you got a buddy with a silver FD too that is bone stock, swap vin & license plates and go to state ref.

Did you get cited for 27151 VC Exhaust modification and 27156 VC Smog Device?

Maybe in your eyes you were cooperative, but in his eyes you weren't. When you told him it was a catback exhaust, what was your tone of voice? You might have sounded like you were trying to make him feel stupid or something. Usually, if I get pulled over, I am as polite as possible and I don't ask too many questions. I let the officer do most of the talking. If I object to something he has to say, I let him say what he needs to say, then I say my part. The easier you make his/her job, the nicer they become.

^ Yeah it was just a thought, probably too risky anyway and not worth the trouble, but trust me I've seen it done before just not on a FD yet.

How hard will it be to get your car smog legal. I don't think the state ref would know weather or not the car came with one turbo or two. Just make sure the car passes smog and you should be good. I had to go to the state ref once and they just did a smog and decible check, didn't even do a visual inspection.

Ugh very hard, as all emissions stuff pertaining to smog was removed when he converted to single turbo, I don't even think he has the air pump.

I am fully aware of my responsibilities of owning and driving this vehicle. I have two freind that i grew up with all through school and am still good friends with who are in SJ PD. Like I said I have no problem with cops doing there job and I am usually very polite when i know I was in the wrong. I have no respect for the police officers that would rather spend there carrear writing tickets mentioned above then doing actual police work. Now if i was in the wrong somewhere, ran a red light, speeding, illegal lane change, no registration, hell even a tail light out, anything which can justify pulling me over in which I was in the wrong hey hes doing his job and i can deal with that. Dont pull me over because " my exhaust is loud " and it " looks like a race car " and if the reason your pulling me over is because of my exhaust dont follow me for almost two miles and leaving from at least 4 stop lights before you decide you got nothing better to do than harass me becasue your to lazy to go take a real call. I understand discretion trust me ive heard plenty of stories from my freinds. I just feel like we the people with our taxxes is whats paying Police Officers to look out for our best interest, and id rather have them enforcing laws which effect my life, like traffic tickets such as speeding, DUI, other traffic violations which affect my safety on the road while driving. I really dont think im going to be any safer becasue the guys exhaust next to me is loud and his car looks like a race car. Hell then why dont they pull over every harley breaking ear drums everywhere they ride, or every lambo, ferrari thats on the road those look like race cars too. My outlook man up and go stop the guy down the street from beating his wife, or the guy who just beat up two people for looking at him funny. This wasnt about the ticket, I drive an illegally modified vehicle and i take responsibility for that my rant is about how the officer approached it and handled it. I still cooperated with him i just asked questions and he couldnt supply them fast enough so i knew he was full of ****. After he asked me to pop my hood and i asked him what for he repeated my question back to me three times before saying well your exhaust is pretty loud. +1 to that. Like I said, it doesn't hurt to try.

I used to drive a Yellow Protege 5 wagon. It has a carbon hood and is all done up and what not. I never broke the law, the fastest I'd go on a freeway is 80 mph. I hate how some police officers profile you. I was treated like **** once when I got pulled over. I was doing everything the officer told me to do and after issuing me a ticket he said my car sounded like a piece of crap. Now that pissed me off! I totally feel your pain man!

The officer should take real calls? Do you have any clue what police work is like? I highly doubt it kid. It's not like the officer decided to pull you over instead of taking a robbery in progress. Traffic violations are usually enforced when there are no calls for service(911 calls). Law Enforcement is 90% reactive, not proactive. Officers wish they could prevent crime like all the ignorant citizens (you) think they can, but it just doesn't work like that.

Dsicredit the "reason" for the officer pulling you over? Fat chance buddy. Illegal exhaust is more than plenty probable cause to pull you over. And count on the officer showing up for court for a few reasons...

Number 1 - We have to
Number 2 - If it falls on our day off we get an automatic 4 hours of over-time even if it only takes 30 mintues.
Number 3 - If the court day is on our normal day of work, then why not show up?


By the way, next time try using this thing called paragraphs.

Ive been on about a dozen ride alongs in the last year with my friends Im pretty sure I have a decent idea between that and stories they tell me to have an idea of what police work is. "Ignorant citizens?" Please you hold a badge so that makes other people ignorant becasue its not our job to know the law? Its your Job to enforce it and know it and make others aware of it. Not give us attitude because we want to inquier into why we are being pulled over with no apparent reason as to a traffic violation. And when i was out with my freinds we found a whole lot more interesting stuff to dig into than a car with loud exhaust. You want to know ignorance its the cop that asks to pop hoods and think a turbo is an intake thats ignorant. And as far as discretion goes I cant tell you how many times Ive been talking to my freinds and them talk about how many traffic violations they have let go becasue there are more important things to attend to. Like i said I dont beleive a cop who drives around getting loud cars off the street is a cop I care to have serving and protecting me, sounds like hes not into anything but protecting himself from being put in harms way. And hey its my opinion right? And paragraphs... really is this a forum or english class I dont have to turn this in for evidence or a grade. I understand you are sticking up for your "PEOPLE" but seriously put yourself in the same situation as the officer would you have carried yourself the same way?
