DFW Speeding Ticket

Was going to post this yesterday, but obviously THAT failed. Anyone know a good ticket lawyer that works the Lewisville area? I had one for Grapevine a couple years back. The speeding ticket was going to cost me over $300, but for $35 they got me on something called Ticket Probation, where as long as I didn't get another ticket in that county for 6 months, it would drop off my record. I sure should have kept that guy's card.

This is something I am looking for, any recommendations?

















... other than "Don't speed"?

Well, then you can feel better knowing that I wasn't speeding as bad as you and I did two RX7club meetings ago.

We've got a pretty weak showing in the Dallas group if noone's ever gotten a speeding ticket here.

I've gotten and fought numerous tickets, Passport 8500 only helps so much. I've used attorneys and done it myself, they are not worth the money. Do it yourself, it's easy. You want what is called "deferred adjudication" which is basically 6 months probation, don't get any more in 6 months after this and your record stays clean. You pay a small fee for this but it's not like pleading guilty and paying the fine. You can do this yourself, request a court appearance - the prosecutor will offer you this or driving school usually. All a ticket attorney does is do this for you and you pay him rather than spend your own time on it. You could also do like me sometimes, don't back down and request that trial by jury! I've yet to ever get a jury trial, but if you do you got to be prepared and know what to do.

That's what I was looking for - in Flower Mound they made me pay full ticket price for deferred adjudication last time.

My plan was to go with a good ticket lawyer if I could get one recommended, but other than that, the ticket he gave me already had a court date on it, which meant he planned on being in court that day - I was going to call the court and tell them I have to travel for work that day and get the date pushed back to some random day (gambling that it's not another one of the officer's scheduled court days) and go before the judge. If he doesn't show up, the ticket is dismissed. If he does, I'll request deferred adjudication. Seem like that would work?

I highly doubt the cop will show the day that is on the ticket. That day is the day you show up and they try and beat you down to take a plea bargain. If you don't do the plea bargain, then they set another date and it's that time when the cop may/may not show. They don't need to waste time bringing cops in for your first appearance, that's the date they try and negotiate. Show up to that day and try and make a deal with whatever you can live with. If you don't like the deal, plead not guilty and request trial by jury if you got the cojones to do it and can accept the consequence should it actually happen and the chance you might lose. The city wants you and in and out of the system and to collect, it's all about the money. They aren't looking to spend lots of hours and peoples time deciding if you were doing 47 in a 40 or not. Next time when you speed, get the ticket in Dallas and not one of the suburbs. Much easier to get your way in Dallas than Plano, Flower Mound, Addisson, wherever.

That's the truth - like I said before I paid $35 to get deferred adjudication in Tarrant County. He said he didn't do work in Denton county (Flower Mound jurisdiction) though. :P

Perfect driving record, I only go in for the photo for a driver's license every 14 years because of these two guys...for Tarrant County, it's James Mallory, 817.924.3236 and for Dallas County, Randall Scott, 972.264.4000 or 972.263.0626. On the last incident in Grand Prairie, Randall Scott's office flat out got the 56 in a 40 ticket dismissed and all I paid was his $70 fee. No probation, no classes, no extra fees. I hadn't seen that trick in a while since the Metroplex went to a "court of record" style of ticket enforcement.

That's the guy I used in Tarrant County, James Mallory. Awesome, I'll give his Dallas County counterpart a call and see if he'll do Lewisville or can recommend someone who can.

FM3040 from Lewisville back into Flower Mound, by the driving range just over the Business 121 bridge. They've been watching that road a lot lately. I've driven right past them going almost 10 over, but this time I was 'testing' a 4.0L Jeep that had been weaving through traffic. Normally I stop at 10 over, but I got a little trigger happy and took it to 15. Lo and behold there he sits on the median.

For the record: Jeep < Neon < Police Interceptor.

I also pulled up at a redlight next to a 2000 era Jetta that thought he was faster than everyone on the road. I pulled on him pretty good too, but this time I stopped when I got to 55mph. He wasn't worried about the speed limit and went past me, but my point had already been made. I like the acceleration, speed means nothing unless it's speed in a corner. Heck, even a Kia will do 110 if you hold the pedal to the floor long enough.

Are you back in town now?

Phew, Randall Scott does Lewisville, but it's $55 to him and $160-180 to the City of Lewisville for deferred disposition

If I do it myself it's $171 for deferred disposition.

I guess there are people who'd spend the $55 to get him to go to court for him, but I've got some free time, it's not that big a deal.

They will bust your ***** for attempting that trick. I have been threatened that the judge does not have to limit the fine and court costs to the face value on the ticket if you trifle with the Flower Mound court. I'm pretty sure they mean it.

Flower Mound has a hanging judge mentality when it comes to speeding tickets. Worst place in Texas to get a ticket. They use an illegal technique of forcing you to in effect testify against yourself when you deal with a deferred adjudication. They cannot verify whether or not you have had a ticket dismissed in another municipality by way of driving school, yet they make you sign a form 'under oath' that states that you have not had a dismissal. They do not have the legal authority to do this under TXDOT law-they can only verify whether or not you have a record in the local court.

I watched the 'lady' at the window intimidate my 17 year-old son (Eagle Scout, choirboy, all around good lead-footed kid) into wavering because he didn't want to lie. He did defensive driving for a ticket in the Colony 3 mos before. The 'lady' caught the hesitation, accused him, busted him, then refused to allow his deferred adjudication. She had no legal right to bully him that way; he was guilty and was ready to plead guilty. It didn't do anything but erode his respect for the law.

When I moved out of F.M. 10 years ago I made a promise to avoid ever again spending a single solitary penny of my money in that town, due to the harshness of dealing with the traffic court.

Well, that's a damn shame....for GP, you pay Randall's fee and then court costs if he can't get it dismissed....on my own, it would've been $178. I was assured that the court costs I would pay would not get anywhere near that adjudication fee...I guess Flower Mound is different...

Yes, they definitely suck in Flower Mound - luckily this recent ticket was in Lewisville. What blew my mind is the lady at the next window over had a freaking dog in her purse. I think I'd've nailed her for contempt of court for that crap. I think it's retarded to bring a dog into public stores anyway, but bringing it with you to district court is just disrespectful. Just because you saw some blonde bimbo do it in a movie once doesn't mean it's a great concept.

If I had to guess, I'd wager that the stupid dog is why she was in there trying to pay her accident ticket in the first place. Leave the dog at home, Lady, you're barely bright enough to operate a motor vehicle WITHOUT distractions.
