Buyer/Seller beware. Collect before shipping!

On Tuesday, October 30, Matt Gagne of Sherman Oaks, California (matt g) agreed to buy a HKS T51R KAI turbo kit that I had for sale. We agreed on $3500.00. After several conversations I agreed that Matt could send half of the money ($1750) and he could send the other half plus shipping when he received the kit. I received the first $1750 on Friday, November 2. Matt received the kit on Saturday, November 3 via FedEx overnight. On Sunday Matt sent me a PM saying the box that the turbo was in looked like it had been run over. He also said that the hot side of the turbo was damaged. I immediately asked for pictures of the turbo and the box, neither of which I have seen. Matt also claimed that he was making a claim with FedEx. I contacted FedEx and they said no claim had been made on that tracking number.
The phone number that Matt was using to contact me has also been cut off. It says ‘The customer you are trying to call is not reachable, PTS6180.’
Mr. Gagne currently owes me $1750.00 for the remaining balance on the turbo kit and $377.74 for overnight shipping via FedEx.

I will be taking further action if I have not received my money by this Friday

I met Matt while he lived here in CT a couple yrs ago and have spoken to him a couple times since he moved. He's a fairly decent dude though a little flakely from my experiences and don't really see him doing something like this. However, if he did its unexcusable, I hope everything gets resolved for you.

wow. YOU fucked up big time. why would you trust someone over the internet with that much money. anyone with half a brain wouldnt front some random person that much money.

I haven't spoken with him in 6-8 months so I don't know if the number I have still works but I'll give it a call in the next day or two for you and shoot him a pm and let you know if I hear anything.

dayem!!! I would not send anything out without a full payment, I agree that it's also your mistake.. ANYWAY for 3500??? I would have send you the full payment for the kit.....I've been eyeballing this kit eversince you posted.. but oh well, good luck to you,..

with the amount of money involved were looking at felony level fraud
you may also have to contact the buyers local district attornees office
you've got his name, former cell#, and an address - he'll be fairly easy to track down by them

then again, if emails can be subpoenaed and used as evidence then i'm sure the agreements that were made via email might suffice

yeah, I have the written agreement stating that he will pay the remaining amount plus shipping charges.

If I don't receive payment by tomorrow I will be filing a claim against him.

you do not need a formal written agreement--all you need is the electronically sent communications, which means emails and PM's. This is important--if you have to print out any copies of these emails, be sure to display the full header before printing. That way, it will show the originating IP of the email, in other words it will prove that the emails were sent from his IP address and not faked on your end. In many cases this detail is not needed, but you never know when someone will claim you made it up, better to cover your back side from the start.

Paypal will refund your money completely, you will win the claim, and he WILL be expected to pay back PAYPAL every dollar they give you in return. If he doesn't, they will take his amount owed to a collection agency, where they will go after him. Just keep up with paypal, you have nothing to worry about.

i've hung out w/ matt a couple of times... but never really knew the guy on a personal level. when i do see him around, i'll let him know. i'm in socal, close by where he lives.

LMAO! Your not very familiar with PayPal are you? If he has no money in his [PayPal] account, which you can just about 99% guarantee he does not, then no refund will be issued at all. PayPal will throw their hands up and say "Sorry, there is no money in his account" and the buyer is left to pursue the matter on his own. PAYPAL DOES NOT PROTECT BUYERS.

Thats right they will only give you what is in the account. I got screw over a few times and never seen a dime.
