neg 2 ticket diferal
neg 2 ticket diferal
I got a $550 ticket for negligent driving in the 2nd over the summer and my court date is coming up soon (January). I have a clean driving record so far. I spun out on a local road and got T-boned. The cop gave me a ticket because "any time there are skid marks means you where driving too fast for conditions." I dont know if getting a lawyer is worth it at this point (because it is my only ticket and I heard that you get 1 free deferral every X years). Has anyone else had one of these? Should I get a lawyer or go in there and wing it?
My son got a 2nd degree negligent driving north of seattle last year and had already used his get outta jail free deferral on a 33 in a 30 ticket (dont ask).
He hired Jeannie Mucklestone and it got tossed and he did not even have to appear in court.
it's your call, but with the economy the way it is and the state looking for $, i dont trust the system...

yea i got a neg in the 2nd 3 years ago, it was 538 bux.
i was drivng my 7, its a white 89 t2, and i live in a small town.
at the time some dumb kid had just bought a 88 10ae, and was burning out and terrorizing the town. i pulled out of my moms work. took a right, it was into a school zone. School resourse officer saw me, called an on duty cop, lost sight of me for 11 blocks, found me and wrote the ticket.
honestly, i didnt do it, they said i spun my tires in the school zone. but with the great small town i got boned.. to add to it, it was the first time i had driven the car in like 4 months, and it didnt have insurace, so they wrote me for that too..lol
so i was into it 1076 bux, they did drop the no insurance to 150, but the neg 2 should have dropped off my record last month. if it is the 3 years thing.

You can't get any traffic ticket defered. They have to be minor traffic offences. neg, no ins and driving on suspended are not elligible for deferment. In washington state the prosicutor has to show a perponderance of evidence that

Negligent driving -- Second degree.
(1)(a) A person is guilty of negligent driving in the second degree if, under circumstances not constituting negligent driving in the first degree, he or she operates a motor vehicle in a manner that is both negligent and endangers or is likely to endanger any person or property.
(b) It is an affirmative defense to negligent driving in the second degree that must be proved by the defendant by a preponderance of the evidence, that the driver was operating the motor vehicle on private property with the consent of the owner in a manner consistent with the owner's consent.
(c) Negligent driving in the second degree is a traffic infraction and is subject to a penalty of two hundred fifty dollars.
(2) For the purposes of this section, "negligent" means the failure to exercise ordinary care, and is the doing of some act that a reasonably careful person would not do under the same or similar circumstances or the failure to do something that a reasonably careful person would do under the same or similar circumstances.
(3) Any act prohibited by this section that also constitutes a crime under any other law of this state may be the basis of prosecution under such other law notwithstanding that it may also be the basis for prosecution under this section.
If you still have my number call me and we can chat about how you can beat this ticket. I'll need to hear the officers statement and if you supened the officer or not.

If you got the ticket in E-town get ready for the ride of your life. That and sumas have the same judge and you won't believe the bullshit you will deal with.
don't miss your court date or it's straight to jail. figure on 6 or 7 court apearances if you plead innocent

spend the money and get an attorney.
Or spend the time to learn how to defend yourself for this bs. I used to be pretty pro police, but since seem to be used by the local govt to collect money, I have lost a large part of my respect for them.
The legal system is BS and is just there to collect cash for the state/local municipalities and lawyers....

Back in march, I was 17 riding my GSXR-600. I got pulled over in Tumwater doing 60 In a 35 going to work. The Ticket was gonna be like 350+ but the cop was nice enough to write it down to 40 in a 35 because of two reasons.
1) It was my First Ticket
2) I actually Pulled over instead of running (which i would have easily done.)

If you are referring to insurance companies, they can check back 3 to 7 years in your history depending on state, insurance company policy, and a couple other factors.
+1 for getting an attorney
++1 for Jeannie Mucklestone.
She's gotten several coworkers and friends out of tickets over the last year that I'm aware of.. Additionally, if you add up the cost, if you plead innocent and go thru w/the BS you may still be found guilty and then be out both your time and the money lost on paying higher insurance rates.
IMO it's worth it to put down the couple hundred and hire an attorney.

a few months before that i got pulled over in grant county going 92 in a 70.. i live 5 hours away so i didn't wanna have to show up to court. i hired a local lawyer named patrick earl who went to court for me. he got the ticket changed from a speeding ticket to an "overweight axel" ticket. not sure how my mazda 3 qualifies for that
but either way, it changed from a 200 dollar ticket to a 250 dollar ticket that won't touch my insurance (which my insurance company said would prolly go up about 100 a month for 3 years..). so 250 dollar ticket + 300 dollar lawyer fee = 550 dollars as opposed to 200 dollar ticket + 3 years of 100 dollar extra monthly payments which = 3800 dollars..in my opinion id rather pay a lawyer and see if they can get it off, because if you get it deferred, then get another ticket, you get both..
oh yea we were both under 18 at the time and it was our first tickets
