Angry Ownership change (20 yrs & older)

So I went to the licence office to transfer the ownership of my 1985 RX7 GSL SE. Had everything ready to go (safety, appraisal, insurance, etc). She then asked fort the ministry appraisal form. HUH!

For those off you who don't know. Any car that is 20 years and older needs an appraisal done on the MINISTRY form which you can pick up at your local licence office. What a ******* **** off....

That sucks to hear! Always surprises at the MTO. So do you have to take this form back to your appraisal guy, or can you just fill it out yourself?

I've been trying to find some one, harder than it seems, My Toyota dealer is coming over to get it done! But you want to get it done soon if you bought the car privately, I'm sure the HST will be on used cars too!

The car was in my brothers name for a while. Now I finally have insurance on my own at a decent price so I have to switch ownership. I told the lady my brother gave his car to me. Then she goes you still have to get a bill of sale, safety, then do the used motor vehicle appraisal record. Then you pay 8% of the appraised value.

Idiots I tell you! Always get jammed by the government somehow...

You have to get a licenced used car dealer to fill out the appraisal record.

I don't think you have to pay the 8% if it's a "gift" they have Tax exemptions for that, but brother is not on the list, but how could it not be?

http://www.mto.gov.on.ca/english/dan...used.shtml#tax

Scroll down to tax exemptions and you will read this:

Tax exemption

You do not have to pay retail sales tax if:

* You are a qualifying Diplomat or Status Indian. You can complete a transfer by showing your identity card.
* You receive a vehicle as a gift from a close family member, such as:
o Spouse
o Parent or step-parent
o Grand-parent
o Son or step-son
o Daughter or step-daughter
o Grandson or granddaughter
o Step-grandson or Step-granddaughter
o Son-in-law
o Daughter-in-law
o Father-in-law
o Mother-in-law

Note: Only one tax-free transfer per vehicle is allowed every 12 months within your close family.

For some transfers, such as gifts between close family members (describe above), are sales tax exempt if a Sworn Statement for a Family Gift of a Used Motor Vehicle in the Province of Ontario is provided when registering your vehicle at a ServiceOntario Driver and Vehicle Licence Issuing Office.

My advice would be to try a different person or different licensing office. If you catch them on a bad day they can really screw you. But yes you don't have to pay the tax because it was a gift from your brother but you should get him to right a note saying "I hereby gift my brother (name) a 1985 Mazda RX7 GSL-SE." or Some **** like that.

It took me 5 attempts to get my truck registered in my company name a few months ago, every time I went in they asked for something else.....I gave up on the office in Streetsville and went to Square One on the 5th attempt and they processed it no questions asked. Their many layers of beaurocracy never cease to amaze me!
