BAD GUY: ARotary14

I know i am not a long time member of this site but i am a frequent member of rx8club and this is a member here selling on both sites.
here is the thread https://www.rx7club.com/2nd-generation-rx-7-1986-1992-parts-194/fc-parts-893948/

I bought 4 rx8 wheels with tires from ARotary14. After speaking with him through several emails he seemed like a nice guy and the deal seemed reasonable to me and the wheels looked good in the pictures he provided, here:

After sending payment it took him a couple days to get them shipped out to me, saying he put the labels on wrong or something. Well I just waited patiently and didn't get bothered by it. paid on 4/23. received on 4/30. he lives one state away (im in louisiana and this is coming from houston texas).

When I finally got the packages and was ready to get the wheels and tires on my car, unfortunately this is what i got:

This is only one of the wheels. the others seemed to be damaged too but i cant be positive being that the pictures he sent me weren't close ups. however this wheel got to me looking ROUGH and nothing at all like the pictures he sent me.
filing a claim with the shipper (UPS) is out of the question, because this is the packaging he used:

the two first pictures show the extent of the packaging of one of the two boxes. empty pizza boxes and a piece of posterboard. and the box obviously starting to fall apart. the second two pictures are the extent of packaging from the other box. you can see the circle where the face of wheel wore on the inside of the box, and the styrofoam, that was protecting the TIRES and not the FACE OF THE WHEELS.

Now I can't imagine myself or anyone ever packaging something like this, having ever shipped something or not. Seemed obvious without anything at all protecting the faces of the wheels they would get pretty messed up. no bubble wrap or anything just the bare face of the wheels right up against the inside edges of the box. Even though I was very disappointed, I simply emailed him with the pictures showing him what happened.

So I email him
"i got the wheels today. the one box with the wheels facing out from each other i am assuming made it ok judging from the pictures you sent me. however the wheels in the other box that had the styrofoam (protecting the sides of the tires and not the face of the wheels?!) with the wheels facing the same way had the faces of the wheels BADLY damaged. it will have to be refinished it is completely scraped up"

His response
"HOLY CRAP MAN.......... I AM SO SORRY....... I packaged on and my buddy packaged the other man I am so sorry."

So i mail him back
"from what i can tell from the pictures you originally sent me they all seem to have gotten somewhat damaged, but i cant be for sure since i was not there to see them before you shipped them. i took some pictures after cleaning them all off. obviously the one that is significantly damaged is my main concern. im not sure a ups claim is possible in this case based on the packaging.
i have been quoted between 75$ and 175$ to repair it from the wheel repair shop where i live, but not an exact cost because they said i have to bring it to them for that. let me know how you want to handle this."

(i later took the wheel for an exact cost. $150, plus an extra $15 for tire mount/dismount)

No response. I emailed him back
"hey i dont expect them all to be new looking and even though they all seem to have been somewhat damaged from the packaging for shipping if you could give me a partial refund to cover the cost or most of the cost to have the badly damaged one refinished i will still leave positive feedback for you."

seemed reasonable to me. given that they were improperly packaged and damaged and im not even expecting to return these or a full refund. i just asked that he pay for refinishing for this wheel, or even just most of it since it probably wasnt in perfect condition when he sent it.

No response for 3 days. So, i email him again.
"hey man
if you could mail me back and help me out a little here it would be great. i'm not trying to be rude about this, but the fact is the face of at least one of these wheels has been ruined by improper packaging for shipment. i don't think its too much to ask for a bit of a refund to get the bad one refinished. id prefer to handle all this easily and not have to bother with claims and such. my car is in need of new tires so i need to get this resolved and on my car ASAP. i appreciate your concern in this."

Still no response. seems he's ignoring me, since before receiving the wheels his email responses were always very quick and atleast within the day. so now I will have to file a claim with paypal on this to get my money back. If anyone is considering buying something from this guy, I would seriously reconsider, based on his unwillingness to package items properly or even make an attempt at making a bad situation right when the buyer is (overly) understanding and nice about the whole situation. If he contacts me and will partial refund me for all or most of the cost i was quoted to refurb this one wheel ($165 was the price quoted), i would remove my negative feedback for him and give him good feedback for doing the right thing, but so far it doesnt look like thats going to happen.

I closed a FS thread that he had going on, from this point forward he is not permitted to sell anything on here until this is resolved.

Unfortunately for you, paypal won't do anything at all. They will only cover purchases made on ebay.

actually, ebay buyer protection and paypal disputes are 2 separate things.
as an update i received an email from the seller today, but still no resolution. a paypal dispute has been opened as a request for partial refund for the $165 for the repair.

That's exactly my point.

You may get lucky but if the seller decides to tell you to go to hell, Paypal won't do anything.

well when you pay with paypal and use a credit card as the funding source, the credit card company will get the money back, regardless of paypal.
anyway, if the seller wants to tell me to go to hell i guess its his choice if he wants to resolve this and apparently be able to sell anything on this website (thanks rx7roller02 for helping!) but that's up to him and I'll wait and see how he handles this.

Well I am going to take care of it and was going to from the begining I was checking wheel prices on repairs. 165 is a little high but I intend on paying him because I know different places have different prices. I just hope this can be resolved without to much negitative feedback! I never ment for the wheels to get scuffed up.... That just happens sometimes I ordered wheels from rota and they were scuffed up IT HAPPENS
