Angry How do i fight this ticket

Hey guys & girls

I got a ticket in a residential area when comming around a corner and this cop drives past me and sets the horn off and turns around.

the corner is pretty nice curve and it is 1 of those 1's that you always put your foot flat around.

I was going around the outside and was a lefty.
i think i was going around 40/45 max when she saw me.

so she flipped the lights and sirens just as i passed her and turned around.

She said i was doing 50 -60 in a 25 zone.

i looked and the signs on the road boths ways and going my direction the outside lane which you can see more around the corner it is 25mph but going the other way on the inside is 35mph

she asked me how fast i was going and i said 35mph

so seh looked me up and took her time writing out the stuff and looking me up in the system.

She also asked me if i had any speeding tickets and accidents and stated the locations of them.
i said yes and told her the exactly what happen in all my 2 cases.
I asked her how did she estimate my speed and she said it was her judgement by training and experince.

She said i could fight the ticket and take it to court.

My questions are.
1. Can an Officer give you ticket by judgement of what her expectation of speed is?

2.What is the likly outcome if i take it to court?

3.If the worst happens and i do get judged what is the amount of point/s i will get on my licence?

4. What should i take to court with me?

I will take photos of the place and post them too.

well she can write the ticket, but i dont think "he looked like he was going fast" will hold up in court. without radar or by pacing you, the only thing that will stand in court is you saying you were going 35

It may vary from state to state but in FL a cop saying "he was going this fast" can and will hold up in court. Officers here are trained and can acctually be pretty spot on when judging speed.

I think that they can only write a "traveling unreasonably fast" ticket (at least thats what I got in a similar situation as you in CT). It cannot be a "speeding" ticket. Speeding must be backed up by radar/laser or other device data.

If it was a residential neighborhood, and she made the effort to turn around and pull you over.

You probably deserve it! You said "the corner is pretty nice curve and it is 1 of those 1's that you always put your foot flat around."

A residential neighborhood is the most unsafe place to do this type of driving. Start autocrossing to get it out of your system.

If you haven't had a ticket in the last year, just go to court and whine. Either you will get out of it completely, or you may just have to pay the price of the ticket, and not have it go on your record. But you may be put on probation for 6-12 months, which means it will go on your record if you get another in this time frame.

Once, this got pulled us over for doing 100 in a 40(don't ask) but he didn't have ANY proof.

He said "you're so damn lucky I didn't get your speed or I'd be writing you the biggest ticket." It's the best when they can't do anything to you but are still pissed. BUt I guess the laws are different in CA.

like rarest said www.ticketassasin.com 15 dollar shareware and you can firght it bymail. i'm in the procces of doing this too. also you can print out the cop stop guide and have a better chance at the stop of not getting the ticket in the first place.

Your best bet is to get a lawyer. The $2-400 you'd spend on that will save you over a thousand on insurance costs over the years.

I've had 13 traffic violations (I'm 20) and still got a safe driving reduction on my insurance because I always had a good lawyer go to court for me.

1. Yes, In ALL 50 states, a cop can give you a ticket by using "speed estimation" if thats what you want to call it. Just as she mentioned, they are trained to do this type of thing, but again its just an estimation. Its like if you're going down the highway doing 70 and this car flies by you and say to yourself: "They must have been doin 90 cause I'm goin' 70. So, they can estimate it based on their speedometer, which is often higher than ours. You DO NOT, I repest DO NOT need a radar/laser or similar speed device. My friend got his first ticket 2 months ago and on the ticket, it had a box that said radar: yes or no. The no radar box was checked.

2. The likely outcome depends on a number of things. The first one is population. If you live in a big city, you'll get off 95% of the time. The reason is because the cop has to show up to "testify", since technically he was a witness. But in a big city, they have plenty more tickets to write daily, so they ALMOST NEVER show up to court, with no witnesses, it gets thrown out. The fact that she said you can fight it leads me to believe that the outcome will be the ticket being thrown out. The last time a cop told me that, the ticket was tossed. It was probably just a "procedural pullover" if you will, not one that would result in her wanting you to pay the ticket.

3. The points it depends on by your state, but just take defensive driving if you haven't already. Not only does it reduce the price of the ticket, but you don't gain any points and have a clean record. You can only take it once a year and its 6 hours of complete and utter boredom, but you can take it on-line in some states now. Screw getting a lawyer, the cost of defensive driving is much cheaper and equally effective in "getting out of a ticket"

4. There's not really much you CAN take to court. I suppose photos of the speed limit signs, though I think they'll be irrelevant, it seems like she already had her mind made up that you were going faster than 35. So either way, you're screwed there. The fact that you are driving a sports car, especially one as rare and fast as REX doesn't help.

First off, like I said in another post. What one officer in one state and city can do is different from what another can do in another place. You need to get a copy of your state vehicle/traffic laws and local ordinances instead of asking questions on a message board. I don't think there are many lawers on this site. And if they were, they would charge you money before giving you advice. (That lawyers for'ya!)

Here in NC, an officer can approximate your speed and write you a citation. And it will hold up if you are stupid and dont get a lawyer.

Don't be stupid. Every court in the country has one certain lawyer that takes these cases. Find which lawyer this is in your area. They usually charge 200 to 300 dollars and will get the charge dropped or reduced to something like improper equipment.

I have a friend who is on first name basis with these type of lawyers in three different countys. And he actually is getting a discount from the one here in this county. Good buisness.

your first mistake was admitting to going 35 in a 25 mph zone.

Also, you never mentioned what she got you for.

If she estimated you for 50-60 and you deny it and have evidence it was not possiable to take that corner at that speed under full control of your vehicle any lawyer could get you out of that.

What is going to hurt in court is your admission since obviously if they cant charge you with 50-60 they will still go for the 35 in a 25.

If you feel the law was trying to take advantage of you, your best bet would be to get a lawyer. This **** happens all the time

I know i was speeding but i konw that i do not deserve a citation for going 50 -60 mph.
i will say that i am guilty of going 35mph in a 25mph zone

I got a ticket when I was going 45 in a 35, the cop was three blocks back when he saw me, so he said "I had to go 60 to catch you" and I got a ticket for going 60 in a 35. Tried to take it to court and lost. Good luck. =/

goto court and perform an old trick: get a paper, roll it up into a ball and throw it across the room. Then ask the cop how fast did it go

I don't think I would try that one. Judges dont like people throwing things in the court room. That stuff may work on TV but real judges are not TV judges.

One of the favorite statements our judge likes to hear is "I was speeding, but not that much". Guilty every time.

This is only slightly less popular than "Officer, I do not know how fast I was going, but I wasn't doing 50 in a 25. Maybe 35 or so, but not 50". You have just admitted to speeding. Think about it a moment.

Either statement in court will result in a conviction.

Speeding is speeding in Arkansas. The only difference is 15 or more over can be charged as careless and prohibited. This charge also covers such things as squealing tires (called reckless driving in many states, unnecessary display of speed or power in others).

FYI, a police officer has to demonstrate his or her ability to consistantly estimate the speed of a vehicle within five MPH by sight in order to get RADAR/LIDAR certified. Arkansas, as well as most other states requires an officer to use RADAR only as an electronic confirmation of what the officer already knows from experience.

You have the right to see the radar everytime you get pulled over. Just tell the judge that she did not show you the radar. No radar no evidence. Get it? So everytime you get pulled over for speeding ask to see the radar it's your right!!! (my uncle is a lawyer )
