title issues, advice?

Okay, I bought this POS rx-7 last February. At that time I had 30 days to change title over into my name for only $42. I did not realize that I had only 30 days at that time. I went in the other day to finally switch over the title because I am getting close to putting the 7 on the road. Well, I received some bad news, that $42 changed into $142 with all of the adjusted late fees!! I was so excited when I bought this 7, but now that I've had plenty of time to do some sorting of it, I've found that I've been ripped off in the sale and way overpaid Now I am looking for a new body with less problems to purchase and wonder if I still need to change the title into my name of my current 7 or as long as I do not plan on selling it if having the title signed with my name and date along with the signed bill of sale is okay?? Once I find a body to switch over the working stuff in my car into it, I'll transfer the title right away instead of waiting this time and use up the rest of my current car for parts. I just don't want this to somehow come back to haunt me later on down the road. I'd rather put that $142 plus whatever else I can come up with towards getting the better body instead if y'all know what I mean. Any advice would be helpful at this moment.

Sounds to me like you want to drive the car until you find one with a better body. If that's the case, then obviously you have to pay the $142 to get the title switched over to your name and get the car registered and legal to drive.

If you are not planning to drive the car, and it's just gonna sit until you find one with a better body, then in my opinion you don't need to pay the $142.. you just switch the parts over that you want to keep (if any) and register the new car within 30 days. You can then sell the old car using the title that you have right now, by signing the title over to the buyer.. there should be a place on the title for you to sign, to release your interest in the car. When you sell the car, you need to get a signed + dated statement from the buyer, stating that he will be the new owner of the car, effective immediately.. the statement needs to include the car model and year, old license number (if any), vin number (from the dashboard), purchase price that the new owner paid you, and of course "paid in full". This statement is for you to keep! - it will protect you from any hassles/ lawsuits down the road, because you can *prove* that you sold the car to the other guy, and he is the legally-responsible party. This is necessary because some people will neglect to transfer the title, and then get into a crash or something, and the lawyers will naturally go after the legally-responsible party.. you.

Nothing personal against your boss or the body shop, but I would strongly suggest that you protect yourself by going to the police department and doing a check on the vehicle, to see if it was reported stolen by its last owner. You never know!! These days, when it comes to dealing with "body shop" vehicles, you must protect yourself by making sure it wasn't reported stolen by the last owner. This is no reflection on your boss - you're just protecting yourself, and doing what you have to do.

If it checks out, then ask the p.d. (or the vehicle licensing office) how to get title to the car, how long it takes, how much it costs. And do this yourself.. that way you'll have peace of mind.

genrex: thanks for the great advice, I've had a previous history with title problems. I purchased a full size 79 chevy back in HS and the guy had never transferred over the title and had actually tried to erase something on it. Ended up having to track down the previous owner before him. Man was the previous owner pissed!! He said exactly the same as you about accidents and lawyers, blah. Send all lawyers into the sun!! Oh, and I really do want to drive it until I can get something to switch into it, just don't want to pay that amount just to swap the title over Oh well, that's life. Just have to find a punched cat assembly to replace the assembly I chopped out while troubleshooting a problem. It at least has to appear to be there to pass inspection.

Good advice for Hada too. If you check with p.d. make sure it is the state version and not locals. Locals know dick about that type of issue.

Well, here in Washington, I didnt have a title for one of my cars. If the person KNOWS you bought it from them, and you just need to get a new title without paying the money for the transfer of the old one...You could try going to the DOL and applying for a lost title. Talk to the last owner and see if he will help you out on this...Then, if you say its lost, the last owner (before you) has to sign a paper that hes selling it to you, and that he lost the title. Then the DOL will issue a new title to you on the spot . No more late fees for not transferring on time . Or some other variation of that might work...

~T.J.

EDIT: Or just call the DOL tell them the truth, but then tell them that you lost the title, and you cant find it to transfer it now, and ask them what you should do, they'll tell you .

Do they do affadavits of non-use? Here, if the car has been off the road (wink wink) since you bought it, they waive all the late fees.

Interesting idea Felix. I'll check into it. It has been off road(ing) Prep for this old car to pass the MO inspection has been a b!tch. At least I don't have to deal with emissions testing, just have to have the appearance of having a legit exhaust.
