wow...thats very interesting. this whole thing is becoming one big headache...the reason i picked this particular storage site is because it is close to my buddies garage...where we work on this car! so now i have to move it across town and away from my buddies garage. to make matters worse...the truck i use to move the cars trailer around is moving to BC in a couple of weeks, so i wont be able to move it back!! AUGHHHHHHH!!!!!

Plus im writing my thesis!!! and Dont have time for this!!!!!!!!! AUGH!!!!!!

for the warehousmans cat...where would i find that in the manitoba legal code?

It's not provincial law, it's federal. It applies to all provinces.

The way I see it though, he still advertised secure storage and as such you must show that he did not perform these duties with 'due deligence'.

He cannot argue that not everyone can be secured since everyone paid the same rate, everyone gets the same security coverage.

But heck, I don't know, I'm not a lawyer...

Contact a lawyer for the initial free consultation and then take him to small claims court for the $75.

Of course this will have to wait for the police matter to be settled first since it would be easier to sue, and win, once he has lost his other case to the police.

Like others have said, get some documentaton, and get over to the police and file your complaint. The longer you wait to file the police report, the harder it is to get anyone to take you seriously. I know that from experience.

Why did you not call the police as soon as this happened? You wasted 4-5 days researching this instead of the cops coming oout and getting finger prints and talking to the owner, who should have a record of eveyone coming and going. If he does not have this, then he did not follow his wearhousemans act thing showing prudent care. You may have shoot yourself in the foot by not contacting the police right away.

not neccessarily. The police would have said it was a civil matter and asked him to look into all civil resources before contacting them, which is what he's done.
