wudever........he's got like two years to do something about it in small claims court, so patience in developing a case can reap big dividends...it took a year for me to squeeze the insurance companies for my money...thank God above I didn't have this kind of support or I would've lost Faith and said, "fuggedaboudit...they told me so...."...

I was not telling VIC to drop the case, but to take him to small claims court(like other people said).
Quicker end to a problem, have a nice runing car again, save money along the way and tons of less grief(priceless).
He said, he had no other course of action, but small claims court.
Apparently this was his lawyer's advice.
People come here and ask for advice and people respond according to what they would do.
So, no one is the holder of the ultimate truth or the right way.

I'm speaking from experience.
We (my partners and I) have been in a legal money lawsuit against an individual for $1/2 a million for 3 years now and all we get is bills amounting close to $40K.
When this case is over and done we still have to try to collect and that is more expenses, more loss of interest and more grief and battles.
The lawyers are fat and happy, arguing back a forth at my expense.
Sometimes is not worth it, no matter how much $$$$$ it is.
What is your sleep and peace worth????
Not to mention, the out of pocket cost to take care of the problem.
Our case could not be held at small claims court, so that is why my advise to Vic.
Get it???

^ None really. I'm most likely going to take him to small claims court which is an automatic $5k judgement for me seeing as how he's definitely not gonna show.
My car is still in the same shape it's been for over 2 years. I'm pretty sure I'm going to either have to sell it outright or part it out. I just don't have the money to fix it.

Small claims is useless unless the person has a permanet address and or place of work. You can not have them arrested if they do not pay up, and they must own some tangible property in order to file a claim against them for you to seize which is more legaal costs and time.

I didn't have to do any of that for my attempt. I got the forms, was told it would be $75 to file, more if I wanted a sitting jury. I said I'd be back later....I used that info that it could be done to continue my pursuit of my "insurance claim" against the out-of-state third party insurer, based in Detroit. They initially only wanted to give me $2200 - $500 salvage (since I wanted the crumpled beast to pull all the good parts off of...)....we went back and forth until I wrote the letter explaining my last course of action and what I was told by the courthouse peeps. It was then that they upped it to $2900...I got an independent appraisal by a guy recommended by Ari of Rotary Performance and then told the insurer I was going to be using that appraisal in court. THAT was when I got my $4700. Did I mention this was for a modified 1980 RX-7??
Most folks in the area say GG still works in that same "shop" and has done so for years oblivious to the fact so many people want his a$$....I'd say that's a pretty permanent address and he has to have a tool collection, right? And a car or motorcycle to drive? All there for the pickings....

He doesn't work at Marcos on W. 20th St. anymore. Supposedly, Marcos got fed up w/ him and gave him the boot.
There was this little incident where Gabe dissapeared for close to two months with one of his customer's car. When the owner of the car couldn't find him, he was going to report the car as stolen. From what I heard Gabriel caught wind of this and returned his car before the owner had a chance to report it. I also hear that Gabriel now has a permanent residence and is doing business out of his home. He currently has someone's car there.
Just little **** I've been hearing about his ***** through the wire.

If you cant find him there, his might have some cousins that live over by my side of town. And he likes to go to Houston Motorsports Park. He usually rides with a few people.
Side Note: I've smoked every RX-7 the have showed up with so far!!! (Haven't raced Gabes' yet)
