Replace Heat Shield?

My mechanic threw my old banged up heat shield away after installing a after market catalytic converter.
He claimed I don't need to replace it.
Is that true?

You need the top heat shield, but you could probably loose the lower one. Just be careful when parking not to park on long grass or other things that can catch on fire by rubbing or being near the cat.
