Ticket in DC for expired VA Inspection?

So I drove the Miata in to work (working out of George Washington University for a few months) this morning, no big deal. At 10am I went to grab my gym bag from the trunk and proceeded to work out. When I got back and went to feed the meter I noticed that I had gotten a parking ticket while at the gym. I am legally parked at a meter, with time on the meter, during the hours where street parking is legal, so I was wondering wtf I had a ticket for.

When I got to the car and looked at the ticket it showed being issued for expired state inspection (my inspection was good through Feb 2016, today is the first day of March). Needless to say I'm a bit miffed about having a $50 fine due to DC for something that I doubt I would even get ticketed for (yet) in Virginia.

I was initially planning on going to get the miata inspected this weekend (I live in Maryland, so it's not as simple as stopping at any old service/gas station on the way home from work), but I'm thinking I'll leave work early(er) today to get it done.

Has anybody else had something like this happen? If so, how easy was it for you to contest the ticket and have the fine/ticket dismissed?

Cheers,

Levi

DC sucks. They squeeze every penny they can and it doesn't go back into providing services. You can try contesting, but what's your time worth. They know that and know they can get away with **** like that.

And if you need something from them, forget about it. I had an FB that got broken into. Their response was file this and file that, but don't really expect us to do anything.

Yeah, between this and another $50 ticket (I was parked too close to a hydrant that had absolutely zero markings indicating a parking distance) I figure it will be worth it for me to swing by and waste an hour or so during the work day.

Ticket

Levi - SAY H4YY. Sorry to hear about DC ticket, the ticket writers are really the most 'efficient' of all DC workers! Spotting an expiration on the first possible day at a non-expired meter- it ain't right.As far as spending only an hour there dealing with the 2 tickets, you're probably underestimating, but good luck. I don't get how DC can fine you for another states expired inspection sticker. Seems out of thier jurisdiction.

Because it's DC

They also keep trying to tax commuters who work downtown but reside in MD/VA

You should be able to take a picture of the car with current inspection in place then head to the DC court house and they'll wave the fine.

Works in VA but based upon what I'm seeing here may not work in DC

Good luck fighting tickets in DC; it is not like a normal judicial system where laws are adjudicated fairly and logically. You might get lucky, or might just waste half a day on an unsuccessful effort. DC is famous for just randomly putting tickets on your car, even if you manage to decipher and correctly guess which of the conflicting sighs and parking rules apply. It is common to recieve tickets in DC for bogus alleged "offenses" on vehicles that are 100% legal according to Virginia law. DC is an inherently corrupt and dysfunctional entity. Your best bet is to always park in a garage and never on the street.

Yeah, that's pretty much what I've gathered. I went in last week for two other tickets (I forgot to grab the registration for the Miata, so they wouldn't let me address that ticket) that SHOULD have easily been dismissed (one was a missing sign, another had a clerical error on the ticket itself) and the $50 ticket was upheld, the $30 ticket with a clerical error (which SHOULD normally be a dismissal) was just lowered to $15.

Since the weather is nicer now I'm bringing the bike in primarily, but if I do need to drive (like this week, since it will be raining pretty much all week) I've just taken to parking in a garage about 4-5 blocks away ($12 for the entire day is, sadly, very reasonable).

Someone had this happen to them on Reddit.

Apparently, the VA inspection sticker is only valid in VA. Thus, no jurisdictions outside of VA can issue tickets for expired inspection.

Actually, it's 50/50:

However sections 4 and 5 under this link read:
§ 46.2-1158.01. Exceptions to motor vehicle inspection requirement

4. Any motor vehicle, trailer, or semitrailer that is outside the Commonwealth at the time its inspection expires when operated by the most direct route to the owner's or operator's place of residence or the owner's legal place of business in the Commonwealth;
5. A truck, tractor truck, trailer, or semitrailer for which the period fixed for inspection has expired while the vehicle was outside the Commonwealth (i) from a point outside the Commonwealth to the place where such vehicle is kept or garaged within the Commonwealth or (ii) to a destination within the Commonwealth where such vehicle will be (a) unloaded within 24 hours of entering the Commonwealth, (b) inspected within such 24-hour period, and (c) operated, after being unloaded, only to an inspection station or to the place where it is kept or garaged within the Commonwealth;
Which basically restates what I said above, the VA inspection sticker only counts inside Virginia.

Basically, print that link out and go in like you KNOW you're going to win because it'll be up to the confidence game. I doubt that the D.C. district attorney will be that familiar with the Virginia law.
Also, it'll help if you get it inspected prior to court.

Pele - You're a badass! Thanks for the link

I'll be going in tomorrow I think. The vehicle was ticketed at like 11am on the 1st, I was planning on going to get it inspected that weekend since I live in MD and it would easily be a 2 hour process to leave home, get it inspected, and drive back home IF there was no line for the inspection. Anyway, I actually ended up getting it inspected that same afternoon at like 2pm.

When I went in originally for the other (bogus) tickets I got they would not let me do anything with the inspection ticket since I didn't have the Miatas registration on me. Ironically enough, I think I actually got a WORSE deal on the other tickets due to the fact that I was in uniform. Hopefully plainclothes will help.

So... I went in to the DC DMV earlier this week and it turns out that all Pele's wisdom was for naught

Before I could even get my registration sheet out of the folder I brought the, judge (a younger man, I think he may have had a little "sugar in his step" based off his mannerisms) just looked at me and said he was throwing the ticket out because it was written incorrectly

Apparently he didn't like the verbage of it stating that I failed to report for inspection, stating that a Virginia vehicle cannot be cited for failing to report to a DC inspection. So he just chucked it.

I was all ready to plead my case too!! Instead I just said "Thank you sir" smiled, and took my **** then left!!
