Wastegate Problem - Had A Shop fix, should I bill the rebuilder?

Wastegate Problem - Had A Shop fix, should I bill the rebuilder?

Alright, here is the issue:

I took my 3rd Gen to an Apex Certified shop after putting back in my engine. Everythign worked find except my turbos. Now after troubleshooting my engine for serveral hours, I could not figure out why i wasn't getting boost.

So the Apex shop looked around adn found some busted hoses and some missing gaskets and replaced them, hoping this would fix the boost problem. Well it didn't.... after they were stumped, I called the place that had rebuilt my engine and asked them a few questions and see if they had any similar problems with other customers.

Well he said that the wastegate could have been damaged in shipment, so I called Apex and told them, and had them call my rebuilder... about an hour later he called me back and said he had fixed the problem.

I was informed by the Apex technician that the wastegate c-clips had not been placed on the wastegate, causing it to remain open at all times allowing no boost pressure.

My question is, I have a bill of $664 for parts and labor from Apex which has already been paid for. I was curious if it sounds reasonable to file a dispute and have my rebuider pay for it since they had not put the engine back together in full (seeing that the wastegate clips were missing) - I would just like some opinions on this.
