Angry New By-law in Ottawa

So I was having a great time last night at lonestar with everyone, but on my way home everything was ruined. I was going to down Hawthorne to towards Hunt Club. Driving normally not flooring it or anything. I was pulling away from traffic a bit... but its hard not to. Anyways I guess there was acop off to the side and saw me go by.

So anyways he pulls out behind me and i stop at the light. He just behind me waiting at the light. When it turns green i take off slowly and he turns on his light almost immediately, I put on my four ways and pull & turn off the car. He comes over ans asks my my papers etc, right away I can tell his guy is an *** when I lean forward to grab my wallet and he says "dont get out of your car". To which I respond "I wasnt".

Anyways he takes a walk around my car. (for the majority of you who dont know me my car is half primered). then he says "you have brand new mufflers, why couldnt you buy some with baffling." and proceeds to tell me theres a new Bylaw and he is giving me a ticket for loud exhaust. (I have a racing beat exahaust, which isnt very loud at low load, so I was quite surprised). I act surprised I am reciveing a ticket for this and so he asks me what baffling is (in a rhetorical form question) but I start explaining it to him. He stop me and tells me to come take a look at my mufflers. "see I can see straight through to the other end". Anyways Im not sure how exactly racingbeat makes their mufflers.... I will be researching it soon. because I was under the impression they were baffled in some way.

he hands me back my insurance and registration(without even looking at them) and says if you driving record is clean all you will receive is a $110 dollar fine. At this point I am thinking, this guy is a **********. I get back into my car and am trying to restrain myself.

he comes back, hands me the ticket, and proceeds to give me a speech about how aftermarket mufflers dont make a preformance difference "except maybe a tenth of a second at the top of the quarter mile". He tell me to change my oil more often instead, and my spark plugs, etc.. it will even give me better gas mileage. (I wanted to tell him know my wolf3d will give me gas mileage, jackass) He see that I am getting irritated. but doesn want to give me a chance to speak, so I bide my time. Finally when I get a second I say, well I rebuilt my engine (Im not 100% sure he understood that I rebuilt it myself). But I could see a quick look of embarassment come over his face.

He starts saying "well you can do whatever you want to your car we dont care, as long as its quite we wont bug you. Just make it quite. If me or my buddies see you around we will give you a part 3 to this ticket thats $395. Dont make us do extra work if we dont have to." So I pick up the ticket because i briefly thought that then maybe it was a warning and ask him. "so whats this then a warning?" he chuckles and says "no I dont do warning, they are a waste of time" and walks away saying "have a nice night" to which I reply "Oh yeah, you too"

See you in court loser.

I forgot the ticket at my girlfirends house, so I cant lookup the bylaw right now. But I will. I fully intend to fight this ticket as best I can. If people have opionions and stuff right them down. If you think you know a good way to go about fighting this let me know. I bought the racing beat mufflers because I didnt want to use fart cans, and the same **** happens. more to follow on the actual Bylaw once I find it.

Apparently there's a new law in Ontario giving officers the power to give out tickets to anyone with aftermarket exhausts that exceeds the decibel levels based on THEIR judgements. They will no longer be measuring it with the decibel measuring device.

You are not the first case, but good luck in court, i hope you can find your way around it.

Sounds like a great way to further plug up the court system. As far as I know the RB mufflers are Baffled. If the cop can see through them he has x-ray vision.

Thats what I was going to say. Is there any way you can get a decibel readout of your exhaust, I know r/b is super quiet so I don't know why he would give you a ticket in the first place. Damn I guess this is a taste of things to come. At least he didn't have a sniff test done on you.

thats what i thoght too. and if i can prove this somehow when i go to court i can win. i believe that the new bylaw basically states you must have a baffled muffler on your car. if so than this is a sort of 'loophole' for rx-7 drivers with rb mufflers.

when I looked down it with his flashligh i could see almost all the way towards the other end.... but i thought i might loop up near the other end and go through again. I guess Ill email someone at racing beat and get them to send me some sort of document that would be useable in court. i guess if I could get that the only other thing I would have to do is prove that I have those mufflers and that they are on my car.

yeah thanks god he didnt have a sniff test done

hey prez...looks like you may me going to court with 12 experienced witnesses ..after all isn't that how many people wera at the Lonestar..so far i've won against the disability jerks and the Ontario human rights comission ssssoooooo do you need a laywer ..not me ..the one that i got...he (GET THIS) works for the Ontario gov..fighting the Ontario gov!!the cop was a total sandwich head only experience he has with cars is eating EFFIN DONUTS in them!!

The mufflers are baffled. I've never taken 1 appart but from what i remember the inlet and outlet are offset from the center on oposite sides of eachother.

So, at the very least this would mean that there are 2 perforated pipes going from end to end. Which is the same way some stock mufflers are baffled.

The cop just needs to get laid. Or he's just pissed his cruiser doesn't sounds as nice as your car!

Be nice if you could bring the muffler with you to court

if you asked him to pull a DONUT he'd probably reach into his front seat..EFF..another donut joke!!! I could do them all day!..but seriously..mention the data from racing beat on the muffler itself and bringing in the muffler and a mechanic ..

This is from the ontario highway traffic act.

Muffler

75. (1) Every motor vehicle or motor assisted bicycle shall be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and excessive smoke, and no person shall use a muffler cut-out, straight exhaust, gutted muffler, hollywood muffler, by-pass or similar device upon a motor vehicle or motor assisted bicycle. R.S.O. 1990, c. H.8, s. 75 (1).

Yeah I was just about to post this. That is the exact one I was charged with. Not sure where it leaves me exactly. I dont know what the hell he was talking about when he said there was a new bylaw. Because one this isnt a Bylaw and two I saw this a long time ago.

any suggestions?

I just noticed under year he put 06... my car is a 2006 model? I seem to remeber reading about something that if they wrote down the info wrong the ticket becomes void because you can claim it isnt your car? can anybody confirm this?

The legal term is that the ticket has to be “proper on its face” meaning no “fatal errors”. Proper on its face means that the ticket is correctly written by the officer, without any fatal errors that are not fixable or excusable by the courts.

Under the Ontario Provincial Offences Act minor mistakes can be corrected at court by the prosecution, but fatal errors cannot. For example, there maybe a mistake in the spelling of your name, or the licence plate or year of your car is wrong. This can be corrected on the trial date by the Justice of the Peace or prosecutor and is not a fatal error.

Fatal errors are mistakes that will get your ticket cancelled because they are not fixable by the prosecution.

A mistake like the officer not putting his name on a certificate of offence is considered a “Fatal Error” and upon application by the defendant or his agent the Justice of the Peace may “quash” or cancel the ticket.

perforated or louvered exhausts are in most cases AS db reducing as a good a good 'baffeled' muffler..
easy way to get around getting stopped in the future is to not run a pipe that exit straight out the back of the car but rather points/curves down to the road .. option 2 mag did a test and the levels dropped over 10 db in actual noise levels , in relation to a level ~2" off the ground behind the car. may not look the coolest but you retain your flows.

SOme lawyer with too much time./money on his hands needs to take the Ont. gov't to court over this very stupid ' officers discretion' crap.. It's so pervasive in the books now that a cop could walk out beat someone for bending over in his car to grab his wallet from the door insert.. Ontario : the police state, less to discover more to fear.. that should be ontario's new slogan.

You'd think they'd have better things to do, like protecting the public. If a harley drives by it's 5x louder than most rx-7s with aftermarket exhausts.

I've heard of the baffle thing in other areas before. It's clearly not a law written by anyone who understands anything. What's better, something like a 3" flowmaster 40 series (with basically a V shape baffle between the inlet and outlet) or a half inch but long straight through" muffler?

if you present a good case that the officer doesnt have good judgement then you will win.

if its up to there judgement...then make it sound like he dosne know what he is talking about......

wow, i wanted to switch to the RB mufflers just for the sole reason they would reduce sound levels...but WTF now.

man, i am scared to drive around now that i hear this...

My car isnt even that loud. the cop was just bored, and powertripping. It gives even more of a foundation for my profound dislike of cops.

I feel a little better about leaving Ottawa now, lol.

I actually know I guy with an 240SX with a N1 exhaust who had the same problem... they must be cracking down, of course its easier to pick on 20-somethings in 10 + year old vehicles.

I bet the primer doesn't help at all...we all know the hard work you have put into your vehicle, unfortunately the cop sees a car that is loud with a younger male in it.. its not right, but its life... think of it this way -- its less than the cost of most speeding tickets!! And, no point deductions...

The "06" he wrote is your plate sticker, I got one of my buddies tickets thrown out because they wrote down 01, but yours was obviously done correctly.

Not sure what I can do now. Even if I can prove the mufflers are baffled soemthing tells me that they wont kill the tickets. Or maybe if I make it look like I really tried to get quieter baffled mufflers and went out of my way to try and get them they will feel sorry for me like I got suckered and cut it down to a warning.

Is it worth going to court anymore?
