Need some advice / input on a recent traffic ticket

Need some advice / input on a recent traffic ticket

Hello,

I was pulled over last night by a police officer for not having my back window cleared off. There was some snow left on the rear window of my parents car.

So I am being interrogated as usual, I handed over the insurance papers but I couldnt find the Insurance Card. It is a company vehicle and it is my parents so I do not drive it all of the time so I am not 100% sure where the card might be, but it is in the car somewhere. Turns out it was under the glove compartment box.

The officer had already written me the ticket and drove off i found it a few minutes later parked in my friends driveway.

I was driving just across town to a friends house.

So i am just asking any advice from

Again I got pulled over for having snow on the rear windsheild.. But I received a ticket when I failed to present the Insurance card....

any pointers?

I dont really want to plea guilty, and I feel if i go to court I will get jammed...

You mean you handed over registration papers but not the insurance document?
Go to the police station and explain. Talk to the same officer if you can. Thats the only advice I can give.

It's going to be the police officer's word against you if you go to court (I don't think you have a chance to win in court. . . possibly a reduction from the crown prosecutor).

Yes I handed over the papers for the license and registration, I just could not find the insurance card.

On the ticket it states:

Did commit the offfence of: Fail to surrender Insurance Card..

I did go to the police station but they women there didnt even want to give me the time or day...

Thing is, it is a company vehicle and i did hand over the insruacne papers, i just couldnt locate the little pink slip ...

The snow on the window was just an excuse to pull me over.

I failed to surrender Proof of Ownership recently. Since there are no demerit points for that I just plead guilty with an explanation and the nice Judge dropped the fine to $20.00 from $110.00. By the time they got the Victims Fund money it cost me $35.00 with no demerits.
I explained I was driving my wifes car and she recently renewed her license sticker and forgot to return the Docs to the glove box.

The judge was also clever enough to know that I didnt get pulled over at 3:00 am because the officer suspected I didn't have my ownership.
Officer let me off 20 + kms over the limit and didn't bust me for the Fail to surrender Proof of Insurance either. Best police experience I have had for a long while.

I am not 100% sure but once they write the ticket you have to deal with the courts to have anything changed regarding the fine or the ticket.

Don't give the Police any reason to bust your ***** and they usually leave you alone.
I attracted their attention by driving above accepted limits.
Lucky for me I had a very reasonable officer to deal with and got a big break.

I may be wrong but here goes:
If you have No insurance on you.they can issue a Ticket but Recind it if you can show proof of insurance within 24hrs.
The Snow on the back Window,it is a Safety hazard and you should know better.
Take it to court.The cop won't show anyways.they have bigger fish to fry.

Regardless if he gave you a ticket for failure to show insurance (which is what you got from whatt have read, and is the desirable one to get, if you have to get one), or failure to operate vehicle without insurance, if you show your proof insurance on the date you received the ticket to the court, it should be dismissed without question. You may even get a chance to speak with the prosecutor oen on one befoe the actual trial date is even set. Make sure to have proof (insurance card), And A letter from your Insurance / company.

Never enter as guilty, though no demerit points are given to a ticket as simple as failure to show insurance, it is still considered a traffic violation and will strike against you with your insurance company and quotes.

I suggest you arrange to speak with a prosecutor, or wait till the trial booking, to deal with it before you go to the hearing.

How could I go to court on the day I received the ticket, it was 11pm at night...

you go to court on the date the ticket shows. This date will not be the hearing, but to set a date for the hearing. But, with these tickets in particular, if you can show proof of insurance on spot to the prosecutor, it can be resolved right there on the spot, so there would be no need for a hearing. Another option is to go where the court location is, before the date, and try to speak with a prosecutor and see if you can get it resolved earlier.
Just remember regardless of what you do, Have proof of insurance, and a pink slip is NOT enough on its own, you will need to provide a written or printed document form your insurance company, and Do not plead guilty and accept a reduced fine, as that will still be a traffic offence, and you don’t want that.

1. Call your insurance to find out whether they consider a non moving violation a conviction that they would use to increase your rates.

2. The police officer can do nothing about the ticket once he lays the charge. (Well there is a little caveat there. He is supposed to take his portion of the ticket and file it with the court within 7 days. I guess if you found him before he did that he could theoretically decide not to file it with the court in time. But I have never heard of that happening intentionally.)

3. The police officer's next chance for input is at court.

4. Always fight a ticket, any ticket. There are many helpful websites that will guide you through the process. Asking questions on here is probably not the best way to proceed. Naturally this will cost you money since you are expending your time, but trust me it is probably cheaper than increased insurance premiums.

The ticket is considered a "traffic" violation, and will be credited against you, and will be placed on your record as any moving violation. Believe me, i know this one, form references form several insurance companies. Now the impact on your quotes will vary from insurance company to insurance company.

Even if it didn’t increase anything, you never want any tickets on your record, as some companies will not take any one with three or more tickets on their record in a certain period of time, and this one will be on the record if convicted as guilty. It would be a shame ot not be approved in the future because of something so simple as not having proper documentation. I have seen it happen.

hey if you have insurance and you are insured under the vehicle, just book a court date go to court with your pink slip as proof you have insurace during the period of the offense and they should just dismiss it or worse case charge you 20 bucks.

they just dismissed mine once i should up with the proof of insurance

no need to stress of it

was the cop in a rush / was there a reason he didnt allow you to search the car for the
pink slip?
thats what i would say to the prosecutor "cop seemed to be in a rush and gave me the
ticket before i had a chance to sift through the car to find it"
