The buyer's ONLY responsibility is to get you the money for the item. It is then YOUR responsibility to get it ready, package it, ship it, make sure it gets to its destination and/or deal with any problems along the way.

Hi, I am the seller of this transaction and will explain my side of the situation.

I was sent an incomplete payment on a S5 manifold. I waited two weeks for the balance which was supposedly always "coming tomorrow", I turned down many solid buyers since I had misterstyx69 partial payment (he told me a story about how his friends wife is mad at him and he needed the part to get his car out of her garage and not to refund his partial payment since he would come up with the balance soon).

The agreed upon deal was that he would cover the price of the part as well as all shipping costs associated with it since I initially asked for a local pickup.

The original shipping quote from canadapost which I got online was not accurate once I brought in the box to ship it since it was an over weight/size parcel.

I immediately informed the buyer that shipping would cost more and his response was 'just send the part and I'll pay you later for the shipping'. I decided against it since it took him much longer than expected to come up with the initial money- I did not believe I would get the rest of the shipping cost.

He gives me the number of his 'friend' who I am to meet up with to give the part. I call and call and call but never get an answer nor hear back. I soon realize why, the slimy misterstyx69 as he calls himself filed a paypal claim while I was calling his friend to give him the part.

I email him about it and he says: 'no problem, just give my friend the part I'll cancel the claim later when I get the part'.

I don't understand why it is so complicated David (misterstyx), I gave you a price you couldn't afford so you send me an incomplete payment. Shipping cost an additional amount that you weren't willing or able to pay upfront. You made me package the manifold for you which was useless. While I was trying to make plans to give your friend the manifold you were stabbing me in the back with an unlawful paypal complaint. That is why I must have the money before I ship and why I will not give your friend the part without you first canceling the claim. What you did is very slimy David and you broke the trust I had in you.

I will not ship the part until it is paid in full with shipping, no exceptions.

This is not rocket science, just return his cash. He did not recieve the product, you did not come through on your end. Return the money, End of dispute.

I can vouch Dave for bein and awesome guy, I have done several trasactions with him and he is honest and straight forward to deal with.

 

i can also vouch for david, he is a good guy to do biz. with...i agree with dan as well give him his money back and thats it..david can find this part elsewhere from hopefully a more trustworthy forum member. and for the record, i dont really trust anyone with less then a 500 post count.

I'll tell you what, tell your friend to come pick it up, but I want you to publicly announce that you will cancel the dispute. And if you don't, please keep in mind I will come visit you to get my money back.

The simple solution is you should have shipped the part for the agreed price...if you got the wrong price...then that's your fault and your loss. YOU take the hit for being the one that didn't get the correct shipping amount. I've had one transaction with Dave...and he went over and above to help me out. You definitely on on the losing side here...quit while you can.

Agreed - I've had to eat the extra cost when I had shipping work out to more than I quoted a buyer. That's the seller's problem - it's your mistake, plain and simple. Shipping is part of the agreed price of an item, so it's not reasonable to try to re-open negotiations when a deal has already been made, and payment made. You could have also looked at more cost-effective shipping options if the post office was "too expensive" - Eg. Purolator (available at Canada Post outlets) or DHL amongst others offer much better rates and flexibility on package sizes.

 

This actually happened to me twice. That the seller refunded my money coz shipping was actually cost more than it was qouted from the website. I dont think it is completelly the seller fault, that the shipping qoute was not accurate. I think as long as the money's refunded, "we" buyer should understand that this sort of thing might happen.

I agree, if shipping would have cost $5 more I wouldn't have said anything. Considering that shipping in this case would have cost nearly the entire amount sent to me for the manifold AND the shipping cost it didn't work out.

Lac_Frak sent me an Echeck..It Was Not for the Full amount,But That was all That Paypal had Ruled For me to Recieve(go Figure)..so that is all that he Sent..The other remaining Money from this Transaction I know I will never see.So,I am Going to Close this Ordeal,and Move on.Thanks to some of The guys For the Support on this matter.You know who you are.Sincerely STYX.
