DO NOT DO BUSINESS W/ TSUBAKI aka SEAN HERBERT...

About a week after I sell my 93 FD to this kid, I get a letter in the mail from the superior court of LA saying I'm being sued by this guy for $4500 for no smog equipment on the car. I provided a valid smog cert with the car.. Sean was fully aware of everything on the car and what was needed for it to pass smog. I listed everything in my ad on this forum for christ sake.. This kid and his dad drove up to NorCal to pick up the car, looked at everything and even test drove it.. What kind of **** is this and who does this?!

DO NOT DO BUSINESS WITH THIS GUY UNLESS YOU WANT TO BE SUED AND GO THROUGH THE HASSLE AND STRESS I HAD TO GO THROUGH!!! BEWARE!

Was the smog equipment on the vehicle when you sold it to him and he took possession of the vehicle?

Not just the cats but was "All" the smog equipment that the car came with on the vehicle when you sold it to him?

Link to ad.. everything was on the car. Buyer was aware of everything, what's there to debate? In Cali my only responsibility is to provide a valid smog cert which was done. I didnt lie about anything on the car and was up front and honest about it all....

Anyway.. this isnt a post to debate about who was right and who was wrong here.. Just a post to let you guys know my experience with Sean before you do any business deals with this *******...

FYI,

It makes a major difference especially in the State of Ca when it comes to the emission equipment and whether it was on the car when it was sold. If it was not all there and you paid someone to get a certificate then they have you by the short end of the stick. They have to go over the required check off sheet that tells them what items to verify that are supposed to be on the vehicle. If the smog shop checked off all of them and they are not on the vehicle then the buyer is going to come back to you and the smog shop that certified it.

I would file a counter suit just for having to deal with this rubbish since obviously you are going to have to travel and take time off of work. I see nothing illegal on the car from the pics.

I always put a fat "Car is sold as is. Buyer is fully responsible for any work or corrections needed to be done to the car from this point forward"

Then sign it , have him sign it, have a witness of his sign it, and have a witness you know sign it.
