Exclamation Bad transaction: J$Balla - Rear Seats

This guy: (J$Balla)
https://www.rx7club.com/members/j%24balla-141499/

Wondering if anyone knows this guy. Would love to just get the parts I bought.

Bought a set of rear seats from him.

Says he shipped them and that they were returned to him "Receiver did not want".

Here's the images of the stickers he sent me:

I run a couple of businesses from my house. I'm in all day every day basically. I usually get a delivery from UPS of something almost every day. The guys from UPS know me. I've never refused a package in my life. And if I wasn't around they would have left a slip.

I can believe that UPS screwed up somehow, but I didn't ship the parts, it's not my problem. Seller says that it'd cost him another $400 to ship them again and so he hasn't done it. He should have sorted it with UPS.

Haven't heard from him in weeks.

Here's my iTrader:

Here's his:

Here's the original sale thread:

Any ideas, gang?

Well, I checked the detailed tracking, and it would seem at first glance that the seller did not properly prepare the package, and so it was kicked back. Look under the detailed tracking notes, you will see that the only place in the US that this package apparently went to was Pembina, ND. In that location, on 4/11/2011 at 12:00PM, it was noted "Returned to shipper". Same location, less than three hours later, it says "A valid tax identification number or deferment number is required for clearance. / Returned to shipper. " This tells me that they never made it to trying to deliver it at your address--it was never in Illinois, where I believe you live. Later, at 7:10PM that same day, it was noted that the receiver refused the package....but the location is Winnipeg, MB, Canada, not where you live. This package never made it to your door, and you should not be held responsible for it. The seller should either refund your money or resend it with all the proper information in place.

Thanks man, I appreciate you doing that. I somehow missed the tracking number being on there. I wished I'd checked that a long time ago.

I've not had any luck getting hold of the seller.

My next step is to file in the Canadian Small Claims Court against him. It should be an open and shut case, and I should get all my costs refunded too.

Shame it has to come to this.

Maybe one of the admins could try and contact him?

If I take him through the small claims, then both him and I will lose a whole chunk of our lives sorting this out, and he'll be out a ton of money (or possessions if he can't pay up and the bailiffs have to go to his house).

I'll get a Process Server on Tuesday so I can go ahead and file against him in Canada, but of course I'd rather solve this outside the legal system.

The last time I was in litigation with someone my lawyer took me aside and said "You know, the only people who win in litigation are me and the other lawyer. We both get to take another paid vacation this year". And he was right. The other guys settled in full before it went to court, which is always nice.

Good luck with the admins contacting him. That is why I used to be a mod--because I did things that went beyond the standard for the forum. If you read the forum rules, it says that the forum staff have no obligation to try to solve disputes like that. In short, the typical option will be what it always used to be--the offending seller will likely be banned to protect others from losing money.

I heard from the seller finally tonight.

There might be a good resolution to this in the end.

Thanks again for your help.

I had UPS pack all this stuff up as I was unsuccessfull at finding packaging to actually fit all that.

I figured with them packing it up I will just send it to the buyer through them as well. Big mistake. I always have problems with them.

Anyways, I haven't had internet for the last month, so I could not communicate with the buyer.

However, I have finally talked to Charles and will be issuing a full refund by the end of week, as that's payday...

Charles, you have been EXTREMELY patient so thank you. Also my apologies for this fiasco!
