Angry What WOOD you do?

My next door neighbor got a friend of his to cut down a tree that hangs over my driveway. The friend has been cutting the tree down all this week a little each day. Each day he comes over and asks me to move my car but for some reason doesn't today. Well I go outside to start my car and... yep, there's a softball size dent in my passenger fender and hood and the fence that separates our yards is bent. I was like WTF!!! The guy lowers down the lift and trys to play it off like he had no idea that the 4" tree limb that fell about 15 feet landing on the chain-linked fence and my car caused any damage. I'm trying to get in touch with my cousin to take some pics with his digital camera. I will post pics when I get them.

Dang, that really sucks man. I work with a professional landscaping company, and if we do any damage (rarely happens) we take care of it. But since you say it was your neihbors friend, i doubt he has any kind of insurance like that.
If i were you i would have first of all moved the car myself without anybody having to tell me. But even then, the inevitable can happen. I would definitely confront both your neighbor and the guy who was doing the work on the tree and see what can be done. If they are nice, they will help you fix your car.

Hope you get things straightened out...

yeah, i'd confront your neighbor- but do it calmy and suggest that it needs to get resolved obviously. When people are screaming, it doesn't make the others involve work any faster or feel any compassion about the situation....If I knew it was my fault, and someone came it at me screaming- shoot- I'd fix it, but I'd take my sweet *** time getting around to it...

You report it to your insurance company. You notify your neighbor that they have been notified. Your insurance may or may not request a police report but most likey they will send some one that will also speak to your neighbor. Handle it calmly and let the insurance company do the work. They will pay for it then go after your neighbor to be reinbursed.

Get a police report!!! (I hope you did as soon as it happened...), then file with your insureance, or his? Or your home owners insureance..... Or just beat the hell out of him for your FD!!!

im sorry that your car is dented but this man is absolutely right..

when they were repaving my driveway, i moved my car once out of the way so the cement truck can come in..he could still come in even if i didnt move the car but it would be a tight space and im not gonna risk it..well i moved it and i made sure i took the car to work or just drove somewhere for the next 3 days at the same time the truck would come to make sure i wont encounter with an "accident" with it..

better safe than sorry..

Called the cops but they said there was no criminal intent, so they could do nothing. Civil matter and only if they refuse to pay for the damages, I would have to take them to court.

well why risk an accident like i said before?

they were unloading cement in my driveway but i moved each day or made sure i wasnt home at the time of their arrival..who cares whos driveway it is, i dont want my car to get hit, accident or not..

and how can they cut trees from morning to night for a week?

to the poster, do you have a job? lol

i mean no offense but why dont you just go somewhere for the time being?

1. the tree was over 40' high
2. the tree trunk is about 5' diameter
3. the tree had grown out over both the neighbor's house and mine
4. the tree is 6' from the neighbor's house and 14' from mine
5. the weather hasn't been sunny all day everyday.

Notice, you said YOUR driveway. You knew when they were coming to repave YOUR driveway because YOU hired them to do the work for YOU. Now, that is not MY tree. The tree is not in MY yard. I had no idea when they would be working because I did not hire them. I didn't realize they were cutting it down till someone rang the door bell Monday afternoon and asked me to move my car on the street. I wasn't going to leave it on the street all night. I guess if I would have done that and it was hit or broken into, YOU would have asked "why did you leave it on the street"?
It's so easy for people to criticize what I have done and spout off advice on what I should have done even though I had no control over the situation.

The woodsman is wrong for dropping a limb on your car but Jim is right. Why would you leave it anywhere near this guy was sawing?

He doesn't work at night!!!!!! After he finished for the day I would pulled my car back in my drvieway!!!!!! He did not work Tuesday because it rained all day and yesterday he only removed the brush on the ground. He failed to tell me today he had started cutting again!!!!!! NOW STOP BLAMING ME FOR **** I HAD NO CONTROL OVER!!!!!

What prevented you from parking it in the street during the time they might have begun cutting (based on your past experience and the fact that they were not finished with the job), and then coming out at dark to move it into the driveway after they quit for the night?

I'm not sure what you expected. Sympathy for something that sounds like it could easily have been avoided with a little effort on your part? Situations like this are why you pay for comprehensive insurance. Learn from the mistake and move on.

Its his driveway and his property it is the responsibility of the tree cutter to not hit his car. He shouldn't have to park on the street. He shouldn't have to do anything. Althought it is a risk to park it there it doesn't matter, it's not his responsibility to keep LOGS from falling on his car. Especially if they didn't tell you that they were cutting on that day, but even if they had, it's still not his job to protect his car from morons. Get his info, get him to pay for it. It's his fault and your car. Good Luck!

Sucks that this happened man. Try talking to your neighbors and see if you can reach a solution. Either way you will be covered by your insurance company.

I think that if they had resumed cutting they should have told you, but it was an accident so try to be understanding of their side of the story too (you know the one where they f***ed up and didn't ask you to move your car ). At the very least get an apology and let the insurance do the rest of the work.

Although I agree with the idea of getting the car out while dangers presented, I totally dig Jake's point here! Damn, they aren't in HPD's place, but manage to create some damage. It's like your neigbor pee from his side of property to your property. You ain't have to accommudate him by building some toilet just for that, right? Maybe, HPD, you should try shooting a guy from your house to theirs. See if they like that
