when pulling an engine/tranny should you get fluid out of the tail shaft?

If you don't drain the tranny and the driveshaft is out, yes.

I guess that could be why that tranny had a third gear whine.

I thought there should be but wasn't sure, hopefully the previous owner didn't drive it alot like that, I'm needing that tranny for my sand rail.

You can buy those trans all day long for $50 to $100 used.
