Reff Ticket

So, i got alot of advise and help with everyone willing to loan me parts to swap everything over to try and make my car pass emissions. But, i would like to try and get around changing everything over if at all possible. Does anyone know if there is a way around me seeing my car by a Refferie? I'm pretty sure i will have to swap my turbo motor with a stock one because i was told that i would never pass the sniffer with my medium street port being that the over lap is so much. Thanks

If you got a Reff Ticket just pay it. Mine was 609$ or 400something$ if i got it reffed. I'm saving 200$ for working my *** off for a week to get all the stuff back to stock **** that it's not worth my time.

Are refs even re-instated? I heard due to budget cuts, all you could do is pay the fine. Either way, just save yourself the headache or trying to pass legit and pay the fine.

Instead of asking the questions, try gettting the info from the horses mouth. All I see is a bunch of miss information. Last time I got a ref ticket I payed it off. It was $425. But the bad thing about that is you are known as a gross polluter. Call the state ref near you and ask the Question.

The problem with me just paying the fine is a got a speeding violation with it. If i pay the ticket/fine then i'm pleading guilty to it. and i will not be able to attend traffic school. That will make my insurance go way up. I found someone that has a cat i can use to smog my car, but i need the motor now. Does anyone have a stock S5 motor i can use to get by the reff? I will do the labor work to swap the engine, i just someone who has one i can use. Let me know.

Thanks Robert for the reply. i hear ya. Yeah, i called the state referee station today and they told me i have to pass 3 steps before my smog is complete. I have to pass visual, functional and emissions. So yeah it sucks.

So why did you open your hood? How much over the limit were you going or is it your 2nd violaiton in 18months? If i ever get pulled over and they ask me to open my hood i'm saying NO. Not to mention i riged my hood release to break off so if i have to open it *Click* well sorry officer.

i know personally of 1 who's had their car towed and impounded because of it. and 2 others who popped their hood after receiving the threat and "managed" to "fix" it after telling them the hood wouldnt open.

honestly what are you going to do. they can pretty much impound your car for any reason. even if they are in the wrong and you fight it in court your time is wasted plus you have to pay the impound fees

I've said Yes once i'm not doing it again. Our 4th amendment right says we can say No. Unless he has probable cause or is doing a "Safety" check i can say No and he can't search my car. If he is doing a safety check and only searches under my hood that's profiling.

I'm not going to make it easy for him. I'd rather exercise my right then just hand it off.

yea i know what you mean but if they want to tow your car they can. just hope you never get in that situation

I thought each violation was treated seperately. Paying a bail amount doesn't admit guilt. You should still be able to attend traffic school. (someone please correct me if I am wrong) If anyone here has done online traffic school, that **** is not school, it is punishment. You learn NOTHING, you do not become a better driver because of it, you have to memorize useless statistics. It is punishment, pure and simple.

I also got a speeding ticket that turned into a speeding and a ref ticket. Speeding somehow translates to popping the hood. I caved in because I was 350 miles away from home headed to a funeral.

Have fun walking home after they impound your car and do their search anyway.

You voted (or didn't for that matter) for the dip****ts that gave the cops the rights.

Friend did online traffic school. We all got loaded on grapefruit juice, vodka & a pinch of sugar and took turns answering the questions. It was kinda fun.

Last time a cop asked me to pop the hood, I asked him "Why?"

Police said, "We have reason to suspect your car is modified." With a nice ******** attitude.

I popped it because the whole car looks stock. He had no idea what he was looking for. He even missed the Meth injection.

The only person you will not make it easy for is yourself. I have seen a few friends' cars get impounded for saying no. If you refuse, you will/can be arrested with obstruction and your car will be impounded under evidence for being a gross polluter.

A night in jail if you don't post bail, your car impounded for 30 days, some hefty fines, the cop makes a court appearance and gets paid overtime for it and misses work, and a nice "**** you," from the judge at the end of your case.

Cop gets paid a good amount of money for showing up to court - Check
Your county and tow truck yard get a nice check from you - Check
Being incarcerated under your record - Check

I just hope you never get in this situation if you say you are not going to comply with them.. My State Ref ticket in the Vette was $765. I just paid it off and was on my way.

Why would you paying for the emissions part of the ticket mean you are pleading guilty to all the violations? One is an infraction and the other is a moving violation..

Actually, you are exercising your rights. If you don't want to pop your hood, you don't have to. There is no reason for him to make you pop your hood if your car is stock. You just better get a really good lawyer that knows what they are doing.... and about a couple G's to pay for it.

It's probably easier to pop the hood and be cool with the cop. Most of the time they will let you off if you don't come off as an *******... Coming off as a defending "*******" might be the problem...

I can have a stock car, but have a "Racing Beat" sticker to give him enough probable cause to pop my hood. All they need is probable cause and the definition of that is set out for the officers discretion (Stickers, sound, lowered, wheels, muffler, etc.)

If he did not state his probable cause, you may refuse. Every time I have been pulled over and was asked to pop my hood, he first stated his probable cause THEN went ahead and asked to pop my hood.

He already has his probable cause to open it, if I don't comply, I am committing obstruction:

Compliance with Peace Officer Orders

2800. (a) It is unlawful to willfully fail or refuse to comply with a lawful order, signal, or direction of a peace officer, as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of the Penal Code, when that peace officer is in uniform and is performing duties pursuant to any of the provisions of this code, or to refuse to submit to a lawful inspection pursuant to this code.

Resisting, Delaying, or Obstructing Officer

148. (a) (1) Every person who willfully resists, delays, or obstructs any public officer, peace officer, or an emergency medical technician, as defined in Division 2.5 (commencing with Section 1797) of the Health and Safety Code, in the discharge or attempt to discharge any duty of his or her office or employment, when no other punishment is prescribed, shall be punished by a fine not exceeding one thousand dollars ($1,000), or by imprisonment in a county jail not to exceed one year, or by both that fine and imprisonment.
I'm not saying it will happen, but it's all up to how the cop feels that day..

Probable cause should fall under the rule of, weapons, drugs, extreme illegal acts. Emissions shouldn't be in there... Lazy piggies that fart flowers out of their butt. My aftermarket exhaust is not going to kill someone.
