I'm sure many of you CA guys are plenty aware of these damn mobile smog stations. And that cops will try and make you cooperate, but here is some info i found, thanks to a really dope "group" on facebook hahaha, I will copy and post some of the important information from the group.

okay, here's the deal; straight from the consumer
affairs dept smog division ( Marvin )
Mobile Smog check points are strictly voluntary.
a CHP may try to hassle you, but do not give consent.
keep this number handy in your cell - 1-800-952-5210 -
press 0 and ask for Marvin. he is the the
person in charge of the mobile smog stations,
and the only one in the dept.
if need to, call him during a CHP
demanding you to smog your car.
share this post."

"I just got off the phone with Marvin from the
Bureau of Automotive Repairs at 1-800-952-5210.
He was courteous and helpful with all of his
information. I Told him that I was stopped at a
mobile smog checkpoint and that the officer
implied that these were mandatory and that
it caused me to be late to work. He immediately
asked if, and encouraged to file a complaint. He
also offered to send me a letter of apology in
behalf of the B.A.R to show to my employer in
case there had been any problems.
He consistently said and confirmed that the
checkpoints are completely VOLUNTARY and
that the CHP officer must let you go!!! So there are OPTIONAL.
I would suggest keeping the number and if
you ever get pulled over then just call and
ask for Marvin. The total time it took
me(went through the process with the
automated recording and pressing number for options)
was less that 15 mins.
When they answered I spoke to a lady, who
later transferred me to Marvin also said that the
checkpoints are to check for vehicles that are
emitting vast amounts of (visual) smoke."

another reason why I started a new thread is from fear that nobody would

this thread is titled in such a way that the only people entering will be interested in the information meaning there's no way that anyone with this problem is going to skip out on reading this VERY helpful information. Which helps the community, and makes me happy

just say "i do not consent to the search of my person" and he will know that you ain't the average honda retard hahaha, he probably won't wana deal with you by then. they hate when people know the law.
anyways, if he wants to give you an exhaust ticket without pulling you over for probable cause. ask him how he knows that the exhaust isn't stock, and if he has a decibel meter on hand. if not, then how can he be sure that the exhaust doesn't comply with state law? that is why they can't give you a "too low" ticket without breaking out the measuring tape(wish i would've known this 4 months ago) it pretty much voids the ticket in court.

The smog tests, run by the California Bureau of Automotive Repair (BAR), are technically voluntary, but with the fanfare and presence of highway patrolmen flagging people down, it does not come off that way to many drivers.

he probably just didn't notice the code was added back in 2002, and that the BAR has admitted that these tests are on a voluntary basis.
the code protects california by not stating whether it is or isn't voluntary but by making it read out as a mandatory event as a privelege to drive on california roadways and something you agree to by having a license and driving on them.
but what happens when enough people lose their jobs by being late due to the implication that the tests are required? not like california can afford more unemployment when it is already broke.
