Got a Ticket Need some advice!!!

So I got a speeding ticket on the way down from northern california during my spring break. The thing is, he clocked me going 90 in a 75 when i was going 85 with cruise control on. I used the tire calculator and everything and i should be going slower than the indicated speed on my speedometer since the wheel height is smaller making the speed i'm actually going: the indicated speed on the speedometer - .7% the indicated speed on the speedometer.

The cop was a huge distance away going the other way on the freeway (in other words, he was north bound, while i was south bound) and clocked me while he was coming towards me with his radar gun. He then bounced over the median (a grass median with a dip in it) to head southbound and pull me over.

Here's my big ol question: Are police even allowed to use radar units while their vehicle is moving? Wouldn't the radar unit receive an inaccurate reading if the vehicle being checked was heading towards the radar vehicle as the radar vehicle is moving in the opposite direction? Wouldn't the doppler affect be multiplied since both objects are moving (sorry i forgot my physics... i should know this since i'm taking physics in college)? Someone help me out.

This is my second ticket within the 18 month period that i could request traffic school again. Pretty much this ticket will make my insurance premium for liability jump from 1200 a year to who knows what... Thanks a Bunch.

Take the car to a mechanic and have them make a written statement that your speedo was not callibrated correctly. That used to work when I lived on the east coast. And show up to court because half the time these cops don't show up to court and your ticket will get dropped anyway.

Lots of good info and help there. They have a section of prewritten letters for fighting radar tickets.

wont work. no matter what your speedo says, it's your responsibility to obey the speed laws. i knoe, i've tried when my speedo was busted. it just doesn't matter at all.

85>75?

havent done math since highschool.

Yeah there are other vehicles doing the same speed or even faster, but you got caught going over the limit. What would you tell the judge, 'i was really going 85 in a 75, not 90. over the limit is still over the limit. Just show up expecting the worst and ask for traffic school( if you can), if the chp doesnt show up, then you get lucky.

you pay for ever MPH over the posted speed, why the hell wouldn't he try to get his fine reduced?

IMO the moving speed trap is BS, they should HAVE to be stationary to get an accurate reading.

about the clocking while its in motio the cops car is conected to the radar gun so it automaticly does the formula to calculate your speed in other words no matter how fast he is going the computer automaticly subtracs his speed to get your speed

but it is less reliable at targeting unless he was the only one within a ways of his car.

accurate yes, but when you have a group of 4-5 cars how can you tell which is doing the speed the gun is indicating? maybe by sight at which it is moving compared to the others but that, in my mind, is innacurate.

speeding cars should only be pulled over when it is obvious, and sometimes i think the operators just guess who it was because i've had officers BS me and say i was going well over the speed i was actually doing before.

Another thing to think about though is on long stretches of road the CHP doesn't use the patrol cars to gauge speed, they use the airplane or hellicopter to tag your ***.

honestly just pay the ticket and do the traffic school. you were speeding at 85 and breaking the law just as much as if you had been going 90. with traffic school no point on your record.

I refuse to shed light on subjects such as this anymore. My help is never appreciated and it alway ends up with insults being thrown my way. I deal with dirtbags all day that like to throw insults. I like to have a break once in a while.

In anycase, good luck at court. Let us know how it turns out.

Thats a pretty **** poor plan. He can fight the ticket, and if he loses, still go to traffic school. He was speeding, and he got caught. He is an idiot for doing that, but he should still try and reduce the expense of the ticket, or try and get it thrown out all together.

Seriously, check out the Ticket Assassian website. They will explain how to fight the ticket with a trial by declaration. No need to go to court. It is all done by mail. If he loses, he can request a second trial. If he loses that, he can still ask for traffic school.

Also on the website, they have prewritten defense letters that explain how to defend yourself when given a ticket with a radar gun involved. It is definetly worth your time.

Hate the I-5 northern-southern trip

Just admit you were doing 85 not 90. You must have been on I-5, around what city?
My first ticket (many, many years ago) was 2 weeks after getting my license. I was driving my friends '89 sentra with 3 other (fairly) large people in the car plus luggage heading down to L.A. Got pulled over and the cop said he got me doing 95!
I said 95?!!
I prooved to the judge that an '89 sentra with 4 big men is not capable of doing more than 80. He was convinced that the car was too crapy to get a speeding ticket so I didn't have to pay any fines or attend traffic school, but the bastard took my license for 2 months!
Anyways, I don't remember seeing a speed limit for 75 m.p.h anywhere in cali, thought the most was 70 m.p.h.
-Good luck!
