They can't tow your car for street racing If they have no evidence, it is basically his words vs. your words. They only way they can catch you is, if you're in the act of it or have video evidence with your plates capture too. You can always file a complaint, but I doubt that will do any good.

Bring to court, better have a lawyer in hand. Better have some good evidence proving that weren't there at the time. Justice needs to be serve to dick *** cops. I had a cop in SF that gave me a no front plate ticket on my own drive way while I was working on my car while some mustang gunning down the street.

You should have gotten name and badge number, and filed a formal complaint.

This was horseshit on the sheriff's part. "Posted street racing..." Posted where? Reported by whom? Reported when? What evidence - - police witnesses, or just an anonymous complaint? Plate number or just vague description of a car?

And absent a search warrant or reasonable suspicion of a crime, I don't think you can be forced to open a vehicle that you are not "operating." When you volunteered to open the car and start it, though, you took a huge risk... because if it did start, he'd have had grounds to ask you to pop the hood if he could claim it didn't 'sound stock,' and then could tow it if you refused, as you'd be "operating the vehicle on the highways."

Clearly, the sheriff had no actual grounds for a tow, or he would have towed you regardless of an arguing neighbor. He backed out when he realized he was overstepping.

Letting this kind of stuff go without a complaint, encourages it. I give cops a lot of benefit of the doubt because I know how hard their job is, and we need them to keep the idiots at bay, but crap like this is uncalled for and should be opposed legally & strenuously whenever it does happen.

Makes me wonder what the hell he was thinking. Honest mistake in ID is one thing, but 'stealing' someone's legally-parked car with no better reasons than this is just dumb.

This sounds like something that happened to a buddy of mine with a high 12 sec honda in show trim. They towed it before he knew what was going on and the next night his car was stolen from one of the tow yards that the police use. Whats even worse is after he found it was stolen from the tow yard and went back to the police they said he got a ticket on the freeway the night it was supposed to be in the tow yard. Stupid people that stole it and went for a joy ride racing down the freeway, got pulled over, and didn't get impounded. WTF. The car was later found wrecked but lucky everything was there so he got a nice settlement from insurance, but the 3 days while this was going on was a nightmare.

damn you are so Lucky. I was asleep when my car got towed for no reason. My car is fully registered insured parked legally on the street and they towed it in front of my rental house. I went down to the police station, and the cops excuse was my car looked abandoned. SO stupid.I drove my car everyday, theres now ay its abandoned. I had to pay a release fee which was 90 bucks and the tow storage fee which was another $380. It was like a additional $100 because my car was super low.

wow if your story to the cop sounded like anything that crap you typed I would have thought you were full of crap too... super tough to understand that !!!

but that would suck, good thing you dodged that bullet, what I would have done is taken a video of me and the cop and me wrapping my hand around the extremely COLD engine.. or something and taken that **** to court... no way can a cop just pull up to a car and say 'yup looks like the car that was racing' and just ****** tow it... hell what if you weren't even home or were in the hospital or out of town and he just took that ****, he would have been in deep ****...
