wastegate problems

I'm changing out my manifold and decided to check my wastegate. Well the mechanic noticed that the valve isn't all the way closed. I won't have a chance to go to the garage and look at it until tomorrow, but I'd figure I'd get some advice before I go there. Could this possibly a bad wastegate spring or is it something serious to the point I just need to buy a new wastegate? I'll take pics of it tomorrow and post them up. Its the older style tial 44mm wastegate (not the MVR).

if they left out the valve seat, it wont seal very well

I'm an idiot, the valve seat was completely missing. I have no idea where it is or was, but I don't think I even had it in when I got tuned. So, I purchased a new one now and waiting for it to come in. I didn't get a chance to take apart the wastegate and check the diaphragm yet, but by not having a valve seat, could that damage the wastegate? I can't wait to get retuned now, I should see full boost on my 6766 quicker than 4200rpm now
