Can I do deferral for my ticket?

Can I do deferral for my ticket?

Hey guys today I got a ticket while doing some runs for dataloging. I came to a light next to some cavalier.. Light turned green the cavalier took off fast and I just sat there for a couple seconds, then normally drove off. Then I decided since the road was clear to just do some of my loging and went WOT through 1st, shifted into 2nd peeling out while passing the cavalier, then went into 3rd gear and took that all the way. Then all the sudden I see lights behind me, the ******* cavalier was a undercover cop. So he said I picked the wrong guy to race even though that wasnt my attempt. I have better things to do than just then race cavaliers... He gave me a ticket for negligent driving 2nd degree. So I want to know if I can get a deferral for this ticket?

how fast did you get up to? did you chirp in 3rd? have you ever had a deferal?

If it is oyur first ticket I believe that you can do it on a defered basis. either that or hopefully you will have a judge in a good mood.

If he took off fast, claim entrapment. He suckered you into it. Instead of lessening the burn from getting shafted, you may be able to make him reach for the Prep-H. Gotta try whatever you can.

I did get some tickets but that was over 3 years ago. Isnt that you can get a deferral every 3 years?

haha he also told me im lucky I didnt get a ticket for illegal exhuast. He said I was shooting flames. So I had a friend watch the back of my car when I take off WOT, I shoot flames all while in the gear going WOT... like a long flame

Anyways though, what would a lawyer cost me? What do you guys think the best route for me to take is?

Oh man that sucks. You have to watch for hidden lights and extra antennas on all impallas, crown vics, chevy burbans, intrepids and others. Bad luck.

But if it is your first you can get it reduced or deferred. If you get it deferred then do not get another ticket for a year otherwise the deferral gets dropped and you've get the Neg 2 ticket.

But don't worry besides being about a $500 ticket and your insurance may go up. You should still be able to drive. Don't ask me how I know.

Oh yea the cop wasnt wearing a uniform or anything. He was just in regular clothes. I dont know if that matters or not. ahh and no I have never gotten a deferral before so I have no clue how they work.

well, i'm sure you can get a defferal then. but i think they suck. the defferal will cost you $100 something, you will be on a probation period of 6months to a year. as long as you don't get caught doing the same thing or something simular ( courts decision) you're fine. but if you do get a ticket for something simulare your ticket goes back on your record, you have to pay the original fine, and you lose the defferal payment. that really sucks if you're like me.your best bet would be to find a lawyer at a reasonable cost. don't know how much it will run you, might be more than the ticket its self. but check around cause they all are different. i've got ranges from $750 to $4850 for my charges. but mine are criminal. i'd think ( cause i've been misunderstood in talking to lawyers and got a couple prices that were for traffic tickets) your's would be around 350 mark. yet you also gotta think that if it does go on your record your insurance might go up 20-30 a month. add that up for a year and get a good price. so just food for thought.

Yea normally I wouldnt want a deferral just for the reason that I might get another ticket and be screwed... but since I will be leaving for 5 months in June for boot camp and tech school I wont be driving. I thought I could use the time of me not driving to my advantage.. but seriously do you think I can get the deferral and what do I do to get it? I need to send my ticket in within 15 days so what should I mark down on it?

For a deferral do I actually pay the amount of the ticket and promiss I wont do it again?? If I gatta pay the amount of the ticket then **** it, i'd rather pay a lawer that much and have them fight it.

mark down to contest it. they will then give you a court date. when it's your turn ask the judge if a deferal is availiable. i would still get an attorney. what if you get deffered for a year? just a thought. i think that defferal system is just a way to make more money.

Uniform doesn't really matter so long as they are displaying a badge is my understanding. As far as your intent goes, you have no real way of proving that besides your word against an officers which needless to say doesn't really work. To you, you just continued your data logging off of the light, to the cop, he zipped off and you decided you weren't going to let a cavalier beat you like that. I think racing has become a bigger thing with kids lately and there has been a lot more attention to it with the media. For that reason, I don't see the court bending a whole lot. I've never really been big on the whole getting a lawyer for traffic violations but thats your call. I personally would just go in say what I had to say and be kind and calm and hope that they reduce it to something smaller.

Here is what I know. Undercover cops when in a undercover car have to wear a uniform. There was a case when a woman was pulled over by a undercover cop and he did not have his uniform on so the ticket was deffered. Not sure about the badge but it seems a little fishy.

When you first said that he took off fast I immeadeatly thought ENTRAPMENT. The only cop out(no pun intended) that I could think of was the fact that he was trying to pace your vehicle since radars are innefective in court at moving speeds. If he was in front of you then it would be pretty damn hard to pace you...not to mention dangerous in and of itself. I have seen my fair share of Undercover cop pullovers and know that none of them started out in a race. Most were just traveling on the freeway/highway.

Good luck with the ticket. I will see if I can ask some of my state trooper friends, they might have some suggestions.

He didnt show me any badge at all. He just walked up and asked for my paper work. Man do you not read what I said in my 1st post? He took off from the light while I sat there for a little bit. Then I drove off normally while he was quit a ways ahead of me, then I went WOT. I could care less about a cavalier, I can show you my data logs I was driving hard the whole time. Oh and BTW I took at a look at my logs I guess I never went through 3rd gear, only 1st and 2nd so about 60mph.

That’s great, you were data logging. There have been a couple times where I'm driving and someone flys off the line and I stop for a second and just go eh why not and zip by them for kicks. This is what the cop will say you did, he's not going to ask if you were trying to race him because no one is going to be stupid enough to just outright admit it (even though you were not). More likely, even with data logs, he'll think you were trying to kill 2 birds with 1 stone, get a data log and smoke a cavalier who thinks they're hot stuff.

It seems like your argument is one that refutes entrapment more than suggests it. You are arguing that your speeding was independent of his driving and then you're turning around and saying that he baited you into doing it. As far as uniform goes, I know in court in Oregon at least, they start their shpeal about "displaying a badge" meaning they had one or the embroidered one on their clothes to prove they were an officer.

Frankly, if you really didn't try and race him, I still don't see this as having very much/any potential to work out in your favor. In the end it’s you giving your case and the officer giving his interpretation. In the end they'll probably just think you were fiddling with your laptop as your car idled at a light and then it changed and the cavalier jumped and you just figured you'd show him what’s up. It sucks but that’s how it goes.

Well here if my datalog of when I got pulled over. The 1st part of me drivine up a twisty hill. Then you can see I pulled up to the traffic light at the top of the hill. The rest is explained in the picture... The key for the line graph is black is the RPM, pink is the AFR, red is the load...

That sucks pulled over by a Cavi. Note to self do not RACE any american built cars in the city or freeway. Its seems every other day i see a new uc pulling someone over. To risky.

He said chances are high of me getting of it but there are too many variables. That doesnt sound bad to me considering that the ticket is $538.

I wouldn't pay $300 for a lawyer. Since most of my friends get pulled over in their ****** civics and ricey cars for speeding, most of them get their tickets deferred. I don't know how it is with reckless driving, but thats how it is with speeding. I've heard that if you get a court date, most of the time, the cops are too lazy or don't care enough to show up. Then just make up some bullshit for the judge and tell him your sorry that it was some special occasion and you don't normally drive like that.

I'm not sure about you guys but the last thing I expect a lawyer to say to me when I call them is "Eh, you'll probably lose and I'll take your money anyways." Nothing against your case but no lawyer is going to tell you that you're SOL if they see money in it.
