So if that day's AVERAGE was 104, the bank sets it rate at approx. 101. And THAT'S what we have to send the $$ at. That's that.

But that's really not what this is about. I clearly stated that I apologize for breaking my word, and it's definitely something I HATE doing, and almost never ever do. And I'm not lookin to give anyone a run for their money. My intentions are pure, so I'd appreciate if we can start dealing on that basis.

Ramy:

Once again, your argument is misleading. I can't believe you keep saying so.

Since the $ appreciated in the open market from the date you quoted the price 3/8 to the date you placed the order or paid (4/22? 4/23? ) that has happened even including any cushion the bank may have taken. So, if the cushion was 3 yen and you paid 101 instead of 104 when you placed the order or sent the money, you should have considered the same 3 yen cushion on 3/8 when you quoted the pieces; that would have made 102-3=99; therefore there is still a 2 yen/$ appreciation in the same period, open market or not.

I am not questioning the purity of your intentions, I just asked the favor to let me understand why the price hike, but you don't seem to be taking my legitimate questions seriously, evidently.

As we stand, I see the two following choices:

1. You prove to me that your price hike is due to circumstances beyond your control that happened after March 8, the date you quoted the unit; in which case I will happily pay the difference
2. Alternatively, I would agree to relieve you from your obligation. You can refund me the money I paid you over two months ago and you are free to sell my hooks to anyone else. I would feel somehow sorry for that because I really wanted the hooks; on the other hand, I have to be honest with myself, I don't believe I would have placed the order if I had to pay more than what you quoted originally.

I hope you do appreciate I am not asking to getting the pieces at all cost for the price which I paid for in advance, as I perhaps could, but I am willing to absorb any objectively justifiable extra cost.
I also hope you do appreciate the fact that I am giving you the opportunity to bail out from your obligations in case you made a good faith mistake - let's say you mistakenly quoted $125 on 3/8.

Please let me know promptly publicly or privately - as you wish - how do you intend to proceed from this point.

Thanks.

- Sandro

Thanks,
Ernie

Just call Ray @ Malloy for the rear tie down bracket.

Part#: FD01-56 251B & 252B. You just need the driver side one.

Now buy my spot lol.

Sandro, I'm not going to repeat myself. If you have concerns, email me. I'm not discussing it on the forum. Also, I'm not going to "prove" anything. I don't reveal business info to *anyone*.

Kevin, unfortunately the tow hooks are only sold as a front & rear set, so I can't get you just the front...sorry.

Ernie, as I had mentioned to you earlier, everything is posted & updated on the thread. I don't handle the GB stuff; BlueRex does. So plz find the payment info & instructions posted on the thread (one page back I believe).

Thanks,
~Ramy

This reply just proves that you do indeed have no commercial basis for jacking up the price, and that the extra $50 you are now requesting is arbitrary and unsubstantiated.

With reference to the second option I had indicated in my previous post, are you willing to settle by refunding me the amount I paid in advance and be relieved by your obligation to deliver to me the product at the price you had initially requested and I had agreed upon? For the avoidance of doubt, I am not available to take on me the burden of reselling the piece like su-maverick seems to have agreed doing. On the other hand, I realize that my money was spent already and I don't want to put any unnecessary burden on you by requesting an immediate refund. I can wait for a reasonable period until you can find another buyer.

You keep asking not to discuss this issue on the forum but privately. I don't see why a good-faith discussion shouldn’t be open. I believe I have been soliciting legitimate questions and proposed fair, reasonable solutions. I have no problem sharing this information on the forum.

Thanks

- Sandro

Sandro - I have not officially agreed to anything. I am simply trying to expedite the process since it seems that there are one or two people who are interested in a spot in this group buy. One way or another I expect to get my money back in this.

I apologize if I gave the impression that you had definitely taken on you the responsibility for re-selling your slot. Please notice my statement was "...like su-maverick seems to have agreed doing"

Again, in no way I meant commenting on or overstepping your decision.

By the same token, I do not mean to express any opinion on nor influence decisions of any of the other buyers in this GB who may feel otherwise comfortable paying the extra $50, like vel525 and FDZero did already.

Regards,

- Sandro

I don't see why you are the one who has to worry about it. You should already have your money back imo.

Had it been disclosed that this situation may occur and you assumed the risk then it would be your baby. Sad to say because i know how hard ramy works to supply us with these goodies, but this really is just one of those times where, imo, the business loses and has to try and recover the lose after a few refunds. Been there, done that myself in my own shop just to keep things right.

A happy customer tells 5 people, a pissed customer tells 25.

Oh, I received mine last Thursday. Have not opened it yet. And considering it took me over a year to open and check my HIDs I bought, who knows when I will open this box and check it.
I"ll try to take a look this weekend. Thanks Ramy.
