tuning noob question - Who's liable?

tuning noob question - Who's liable?
My FC has got a bunch of mods on it, and its almsot time for the EMS leap (well at the very least a piggy back fuel computer)
My major concern is the lack of rotary tuners here in the CT area, which leads me to consider what would the consequences be of a "screw-up" during a tuning session. For example, if I go to a local shop and get S-AFC tuning done, and hte tuner screws up - where the engine blows. Either right there on the dyno, or at a later time...who's liable?
I dont really know the answer, but if the tuner does not bear any liability, then why would anyone go to these supposed experts? My guess is that with expertise there must be some sort of accountability. Is this true for the tuning industry?

It all depends on who tunes the engine. If you take it to the guy down the street who works on cars for free, or for some pizza and a 6-pack, then I would not expect any warranty. However, if you take the car to a legitimate commercial tuner, then you will have a certain amount of liability covered. The usual routine is for a third party to disassemble the blown engine and determine the cause. The tuner will take full or partial responsibility if appropriate, but if the failure was not due to the tuner's negligence, then you are going to be stuck with the bill for the rebuild. Prior to any tuning, it is always a good idea to ask prospective tuner what kind of warranty or liability he/she covers. If you have great concern for your engine, then have the engine built and tuned by the same shop, as this puts ALL of the liability on them rather than you.
