Stolen 3rd Gen, Blessing in disguise?

Well, I was up in Toronto eh? Anyways, my best friend picks me up from the airport with a grimace look on his face...... The bad news is my car was stolen while I was on Vacation It works out that the person who stole the car is my best friends little brother who knew I would be on vacation. Instead of stealing the car the traditional way, he broke into my house and stole the keys(thank god for that, no lock damage).... He went out joy riding and I guess forgot to shift or didnt realize there is no longer a rev limiter..... So the silver lining comes in the shape of a well needed rebuild on insurance money and his fathers $250 towards my deductible. Not to mention he knicked up the front bumper somehow and now my faded bumper gets a free paint job as well...... With the gas money im saving on the free rental car I think im going to invest in an alarm as soon as the car gets back from over a months worth of repairs! I don't know about you guys, but I was so ready to drive my car after a weeks vacation..... Now after 1.5 months I'm going to have to break in a new engine so it will be even longer. Anyone wanna come take me for a spin? Oh well, there is good in everything right?

WHAT?! F that I wouldnt put it on YOUR insurance... that will just up your premiums. I would have it put on that little punks insurance, or his dads if you can convince a court that he is responsible for his minor (if he is one)

Well, my insurance company will persue his father's insurance company. I talked to my insurance company and they said they will not raise my rates as long as charges are pressed. What they say and what they do are 2 different things, but it isn't something that I am considered @ fault @. I think there are laws in FL that protect me against the insurance company going nuts.... Does anyone have any information on this? I will seek restitution if my rates are going to be effected....

My FD key is in my pocket at all times...as for the spares I hide them (very well). My best friend flew in from Denver and I was in my Jeep for a few hours running around and made sure he wouldn't be able to find the spares!

What punishment is your friend's brother going to get? Because he commited the following:

1) Breaking and entering
2) Trespassing on private property
3) Stealing

These are some pretty heavy charges in my opinion. Is his family EXTREMELY sorry for what happend? If so, what is his family going to do about it in order to repay for damages incurred? Just because his insurance will pay for damages, doesn't make the crimes commited any better.

How is his insurance company going to cover for the damages? That is strange to me. An insurance company only covers for all damage incurred by you and your property...so how is his insurance company going to write it up? Say you were driving a bus and you ran into a house. Your insurance company will pay for the repair to the house, because you damaged the house w/ the bus. How old is the kid and does he have insurance? BTW, this brings up another point. An insurance company will cover your car IF you give permission for someone to drive your car (there are some exclusions to this rule). Well, in this case, he took your car w/o your permission. Therefore, even if it is filed w/ his insurance company, he would not be covered because he didn't get your permission.

Unfortunately, this is a case where you have to press charges in my opinion. You may have to file a police report, etc. in order to get things done. Because your friendship w/ your best friend and his family has be potential to be screwed. There are cases where things happen between friends and a friend is promised payment, but it never materializes. This is where the loss of a friendship occurs. You do want payment/restoration to your property right?

IMO, that boy may or may not deserve jail time, but he definitely needs a beat down for what he has done. What is the family going to do about him?

There might also be a criminal destruction of property in there somewhere i am sure.. due to the break in and the vehicle

Yeah, I know my insurance company going after his father's sounds weird, but this is what i've been told. I really don't know anything about it myself.... As far as the kid goes, this is not all he went down for. He only started there and now has nearly many more felonies then stealing my car and I will be pressing charges. My best friend is not going to not be friends if I press charges because his brother deserves it. His father wants me to press charges because they are @ wits end. Hopefully everything works out..... I will know if my insurance rates go up by trial time @ which point I will seek restitution for that.... As for now, the car is in the shop for the engine and my insurance company has already cut me a check for the body work... I know I am in college and there is no way im going to front my 6K before I let insurance pay...... God knows when I would get that money back....

How old is the kid? Unfortunately, it seems like the family is the one that will suffer financially because of it. Unless, of course, he will be of legal age soon...and can be legally given the boot.

I hope everything works out for you. And definitely keep your eyes on this "kid" as well as his friends (if he has any).

I would seriously whoop his ***. I hope he goes to jail for a loooong time.

Thats breaking and entering, burgarly cause he took the keys out of the house, and grand theft auto.

Milk them for everything you can, he fried your ACT clutch, blew your ported motor,etc etc etc

Yeah, me too, but I don't put it there for security reasons. I like to stick my hand in my pocket and touch it (the key, you sicko), cuz it makes me feel goood, with an extra 'o', cuz it's that goood.

yea heh when i read the beginning i was thinking oh man this guy got his car scrapped parted and sold peice by peice all around the US he took it for a spin blew the motor that does suck but at least in the end u will still have UR car back. hell maybe even better its the waiting that will kill u

thanks guys, just had to vent btw, he is 15, but he has a ton of felonies in just 2 weeks so he will definately be tried as an adult..... alls well that ends well

jf4828 - I lived in Tampa for 13 years (just moved to So Cal actually) I can remember when I was 16 (long time ago) and I was hit head on by a drunk driver up in the Tarpon Springs area and MY Insurance company had to foot the bill because Florida is a "No Fault" state. (I am about 90 percent sure about this) When damage occurs to your vehicle and is written up by the authorities (Hillsborough Co. Sheriff/TPA PD etc) as not being your fault, your insurance company pays the cash on your behalf (minus your deductible) and then goes after his Insurance Company to recover lost money. I am sure your rates are not supposed to go up - I know mine did not.

Ah, just a little update, what happens is my insurance company is actually going to sue the 15yo kids family for the 8k in damages.... my insurance does not go up....

I don't think that is the case unless the repairs exceed 80% of the book value of the car.... You have to rebuild the title if the car is totalled but my repairs are < 80% so I think im ok...

If you lived in NJ your insurance could give you 5 new rx7s and you would still be getting screwed by how much they screw us.

8-9 grand a year for 8 points. I have been paying near that for at least 4 years. Its not gonna get any better

I remember a few years back when my best friend caught this one kid (around 14-16 years old) breaking into my car we took his *** into the basement and beat the living crap out of him kept him over night and then let him go in the morning.
