HELP! Car stolen and insurance company wants to screw me
guys,
The most dread moments came on Monday morning : woke up, walk the dog, and found that the 7 is missing. For two days I couldn't sleep well and grouchy all day long and to top it off the police didn't seem to be of much help. WTF ??? Aren't they supposed to be a little more accomodating than to put a lookout for it. Well, I just want to vent...
Anyway, the insurance company hinted at replacing some of the predicted-missing parts with recycled/used parts. Is that legal ? I thought they have to replace it with new parts be it Mazda or aftermarket. I don't want them to go to a salvage yard, found 4 used wheels for $400 and call it a day to replace my $1400 Volks. At least they can't do that to every single part missing right ?
What can I do here ?

It depends on your state laws, but yes, insurance companies CAN typically replace your parts with used or aftermarket. Welcome to the wonderful world of the insurance claim....(I just came through a little tussle with Allstate myself, I lost).

Yes, they can replace them with used parts since that is what got stolen. As for the Volks, you might as well kiss that claim goodby. They are going to tell you they werent insuring aftermarket parts, they were insuring stock parts. If you want them to insure aftermarket parts you normally have to carry a seperate "rider" policy for them and list them all out.

same thing happened to me with Allstate. They're probably the worst insurance company to deal with. Anyhow, my buddy over at statefarm told me to threaten a bad faith claim. He says that'll get most agents moving real quick.

Yeah, but we have the State Department of Insurance. I doubt every state has such a thing. BTW, that didn't help my case, the Allstate claims *******, er, adjuster, practically DARED me to call the DOI (which I did). They couldn't help me.
I'm very unhappy with Allstate at the moment. The body shop I'm at has had the best luck with 21st Century and Mercury. Worst luck with Progressive, but Allstate and Farmers are pretty bad.

The reason they label them as "enhancements" is that they aren't going to cover a replacement engine, tires, brakes, etc or other 'maintenance' items.

I dont follow either. Why would the insurance talk about replacing certain parts, unless they found your car and got it back (which you didnt state)
It all depends on how much your car is missing when you get it back. If its more than what THEY think the cars worth, they will total it out and cut you a check.
You always have the right to not accept (with State Farm anyways) the offer and go to your 2nd option (which usually involves someone saying what your cars worth if you were to sell it as it was before it got stolen.)
If you have pics and reciepts and pay full coverage, then I wouldnt see why they wouldnt reimburse you for the Volks.

Depends on the state. In Or the insurance company owes you like kind and quality.
Say if you had stock wheels they could buy some similar condition used stock wheels for replacement.
Don't even worry about the replacement parts. IF your car is recovered it will be totalled. I pratically guarantee it, wheels, seats and a few other parts will add up enough to total the car.

Yea, thats why I said "normally". Some insurance companies will cover things BUT most of the time you have to take the car to an agent and have them look and take a picture of the "enhancements" so they can have it on file. If the stuff comes up missing and you just show them a pic of your car from a year ago with those wheels thats probably not going to fly. I know this happened with my stereo equipement a handfull of years back. They said for it to be covered I would have had to take out a rider for them. Since then I've asked other companies and there are a few that will cover things but they usually require you to bring the car in for them to see the enhancements on the car so they can take some pics and document it.
Still most people dont do any of that. They just buy thier stuff and bitch when its stolen and the insurance company doesnt want to cut them a $2000 check for wheels that they cant even prove where one the car at the time.

I love insurance companies. Their inability to negotiate fairly and constant low-ball offers (pennies on the dollar) for documented property damage, medical charges incurred and tangible and intangible damages on our bodily injury claims, caused my firm to accumulate over 250 million dollars in verdicts against them last year. It's been a very good year so far.

Well, this will be my first post being a member of this board. Seeing as how im a cop, and deal with stolen vehicles on a regular basis i feel i can offer some insight, and comfort on the matter.
First off, about the police. Most people we deal with that report stolen vehicles are never satisfied with what we offer as a solution in the beginning. Issuing a Be On the Look Out (B.O.L.O.) is about the best thing we can do for the initial report. This is especially true if you cannot offer the police any suspect information. In the BOLO is all the pertinent vehicle information. All this information gets put into the central computer, and when we run tags on our computer, while patrolling, it will ring this alarm that lights up the whole screen, and then the chase is on . Seeing that its a turbo 7 that should be an interesting chase...*dreams of such a chase*.
As for the insurance, im not an expert on them. When you buy insurance on your stock vehicle thats what you get, insurance on the vehicle they see when they inspect it. Most people dont let their insurance company know about upgrades because it sometimes increases premiums, thus the upgrades are not covered. If you did take pictures, and have reciepts, you should be in the clear though.

Keep in mind that sometimes them only paying to replace the original parts can work to your advantage. Some of those original parts can have quite the pricetag at the dealer so if you get the money to replace them you may just end up ahead in the end.
I have known a few people who have very legally worked this to their advantage.

insurance companies are getting lazier and more like cowards.
i got hit in the front by some drugged lady and they were going to replace my car with some recycled parts because the car is from an old 94.
it was clearly her fault, so the money is there yet they want me to feel satisfied wit a recycled crap.
im telling you, somebody should do something about this.

No, the car hasn't been recovered yet but I have a pretty good feeling that my Volks, Apexi N1 suspension, and the C-west CF headlights is gonna be gone(the Volks is probably what draws these bastards to my car).
Yeah I understand that bit about the police, I just felt so helpless about the whole situation since it's beginning to look like it's a no-win situation no matter what.
BTW, Expensive Hobby22, stock Mazda wheels from a dealership is $625/piece, if they go with Mazda parts I couldn't be happier but as with my post above I hope they're not going to say : hey, we saw these wheels in rx7club.com parts for sale section for $450, that's what we'll pay for it.
Anyway, I lost most of the receipts. But a good friend of mine has a speed shop and I did buy the N1 suspension from him as well as some other small stuff and he agreed to squeeze some other stuff into the receipts.
Is this a good idea ? Will the insurance company look that deep into his shop's accounting and stuff ?

Ok... a little update,
Now the insurance company is really pissing me off. They practically say that they're suspecting me of committing fraud because I'm new to the coverage, I have more than one car, I actually went to the police station instead of calling them, etc. They didn't say it openly yet. And worst yet they were really suspicious because I didn't hear the alarm triggers during the night.
Anyway, how easy is it to steal a 3rd gen ? Can somebody with a flatbed just came in and towed it out do it without tripping the alarm at all ?
Now the insurance company is really pissing me off. i dont know about yours, but mine sucks. the stock alarm uses the horn, and the little sports car horn the car has is not loud enough to wake a person imo.
i feel for you, ive been screwed over by an insurance company too. i hate insurance, you have it in case something happens, and when you actually need it, they dont give you your money. laws need to be passed to correct the way insurance companys handle claims, because people like you get screwed, and other people get way to much money, making everyone elses insurance go up.
