drunk driver hits the FD last night!!
so im out with some of my good friends last night at the "powerhouse" in old town folsom. im one of the DDs and i have the FD out. so we come out to leave at about 0130 and my friend tom and i get ready to get in the car and call it a night. across from me in the parking lot is a toyota landcruiser sitting there with his reverse lights on for what seemed like 5 minutes. so we decided to wait for this clown to back out before we leave so we dont run the risk of hitting each other (narrow parking lot). so he finally begins to back out nice and slow. my friend tom tries to guide him back giving him signals as to how much room he has left. we tell him to stop about a foot from his SUV and my car AND HE KEEPS GOING!!!! he backs right into the FD (by this time we're shouting and im beating on hit rear window) and crunches the driver side of the bumper pushing my car about two feet towards a wall. he finally stops and im flippin.... i walk around to the passenger side and his passenger is drunk as ****, as is he. it took them a minute to realize that i was even there, beating on his door. they get out and i talk to the driver who is unable to comprehend what just happen, much less what i was trying to say to him.
my other friends come up and call the cops b/c this guy was obviously about to drive off and kill someone.
but heres the kicker, the cops cant do **** b/c they didnt see him behind the wheel and the incident took place on private property unless i declared a citizens arrest, which puts everything on me, something that i cant deal with (and risk losing) when im about to move away. the cops did, however, realize that the two were wasted and took the keys to the land rover and took them home. so at least we managed to prevent a drunk driver from trying to drive his dumb-*** home and possibly killing someone.
it just pisses me off that, 1) this clown thought that he could drive himself and his friend home in the condition that they were both in, and 2) the cops couldnt throw thier drunk asses in jail b/c everything happened on private property.
as for the damage that the FD took, relatively minor, theres scuff marks, some lost paint, and a good sized crack in the bumper.... son of a bitch

oh man, that is weak, cops like that **** me off... they could of very well have done much more... from what officers have told me in the past, if you are even inside the vehicle (any seat) with the keys in your possession you are a potential driver and it is considered a DUI on that grounds. When I was younger that didnt make sense to me but as I got older I would see things like this happen and having the law that way made SO MUCH sense.
I'm sorry, I hope your FD gets better and does so on his dime... looks like they owe you some nice 99+ tails that are genuine and a Re-Amemiya diffuser... you know because that is what you had and he completely desimated them.

BUT, if that isn't the case in California, your anger is misplaced. The Cops would probably have preferred to take the douche jail, but statutes don't allow it. Cops don't write law, they just enforce it.
BTW Nghtstlkr7, sorry about your car, but you did the right thing by stopping them. The cops should have at least been able to assist in some type of info exchange, especially insurance info?? Hope everything works out.

Sorry to hear about your FD. Hope you get it all worked out.
Recently there was a guy in my area that thought he was fit to drive home and while his best friend was hanging out the window sick, he ended up decapitating his friends head and DIDN'T EVEN KNOW. THATS HOW SHITFACED HE WAS!!! He drove 12 miles with a headless body hanging out his window. When he got home, he didnt even notice, he just went inside and went to sleep with the body still hanging out his window. The next morning a guy and his daughter were walking their dog saw it and called the cops.

they did aid in info exchange and whatnot. im gonna see what can be done. at least we were there to stop them. and who knows how far he woulda pushed my car had we not been there

Folsom cops are the freindliest, most helpful cops I have ever encountered.
I was working late one night (in Folsom) and when I went out to my car at 3:00 AM, I found that someone had thrown a glass vase through my rear windshield. The next day, I made a police report over the phone and the cop came to my work and got more details and she even dusted the vase for fingerprints. No luck finding a match, but at least she tried.
Funny though, my car was vandalized on private property. I guess different offenses have different rules.

yea that really sucks man andim sorry. it could of been worse though. **** i had a drunk driver hit my FD this past april and he F**KED it up, totally smashed in my drivers front fender, messed up the front bumper, and hit it so hard the inside of the wheel hit the lower conrtol and cracked the wheel. then of course it had to get worse, when the drunk *** kid reversed out of the front of my car and tried to leave, he hit me again and smashed in the rear quarter panel, smashed the taillight, bumper and all. so like i said it could of been worse for you. **** that happened in april and i still dont have my car back on the road

im fortunate that it wasnt worse and that we were there to stop him from crushing my car and then driving off.
apparently the only way i couldve sued him was if i gave a citizens arrest. that was the only way that the cops would haved given him a breathalizer. but now it would be my word against his.

Sucks about your car man. At least it prevented the ****** from driving off. I can't stand people who drive drunk. A drunk driver hit and killed both my parents (who were up for parents weekend at my college) and 4 other people last year. They were trying to help out at a previous accident that had happened a couple minutes before. Your car deserves a purple heart, its sacrifice may have saved someones life.

holy **** dude i am sorry to hear about your parents. yeah im glad we kept him off the street last night. besides, the life that couldve been saved may have been my girlfriend's (who was driving in the area around that time last night)
