That sucks dude, good luck fixing it and when you do look into Hagerty Insurance I am paying $400 for 6 months full coverage.

+1 In most states doesn't this fact make any argument against the insured motorist pretty much null and they are taken care of. It sounds like someone may be getting the shaft here....

I hope no other owners on this board are using mercury insurance group. If they are they should drop them ASAP!

did you get a copy of the police report indicating that you are at fault? don't settle with them until you get all the facts. it sounds like they are trying to pull a fast one on you!

dont take the offer!!! Tell them No!

Insurance companies have to settle with YOU, not tell you what to do. That is how they make margins. They pay out less than they need to, and leave you to foot the bill. If you settle for less than is required, then it is your own fault.

And they have to prove that it is more cost effective to toal out a car than it is to fix it. And if they want to total it, make them replace yours (minus your deductible)

Maybe I am reading this completely wrong, but it sounds like you rear ended this guy.

please tell me you did not take that offer, if you did im sorry but that is stupid!
my insurance offer 10k with my car back and im still fighting it, you are getting screwed, did you have uninsured motorist part on your insurance? some company have it as default, check it. anyhow i would not take that offer, either they fix the car and not totally it or at least 6-8k with the car back.

My guess too. Based on his diagram above, the location where the two cars made contact would have to be established. Depending on which lane, that would determine fault of the accident. If that couldn't be done, then the insurance companies are probably just calling it a wash.

In my state, not having liability coverage is a seperate offense, it does not determine fault at the accident scene. I doubt California is different.

if ur drawing is accurate than it appears he made an illegal lane change and was consequently at fault. however if you were also making an illegal lane change than you to were at fault voiding my previous statement. but if you feel that your lane usage was legal then i would argue his lane usage putting him in the wrong good luck.

By your drawing it looks like after you turned, you either turned into the left of the two lanes or he turned into the right of the two lanes of choice. Whatever happened there would say who is at fault. So....when you turned right did you stay in the right lane of the two lanes of choice? If so, his fault. If not, then this is completely your fault. Not to mention the fact that with there being no traffic as you described why didn't you see him and either slow down or hit the brakes to not run into him? Since you saw where he came from yaddayaddayadda... AND hit the BACK passenger side of his car sounds like it could have been avoided all together.

there was traffic the only ones that were behind me was that 350z everyone else was going north and south. and i turned into the right lane he hit me so hard he pushed me to the curb and my headlight cover hit the buliding near the street.


pics and the the accident happend dec 2nd read the police report. dec 4th was when i started talking to my insurance about what was going to happen.

if you have collision there is something really wrong here.

You should get full value for the vehicle, minus whatever they think a salvage yard might pay for the car.

You should get at least 60-75% of the value of the vehicle, regardless who is at fault if you have your car insured with collision coverage you get your money, period end of story. Then its up to THEM to fight with the other insurance company to get some of the money back.

If you had no collision coverage then your lucky to be getting anything.

There isn't an "other insurance company."


What insurance coverage do you have? (liability, collision, etc.) This is where EXPLICITLY understanding your coverage (and exactly what it covers) is important.

that sucks. my ins company says my fd is worth 15-16k. its a 93 with 130+k miles. they also insure my aftermarket upgrades as long as i have the reciepts. fight those *******. you can appeal their decesion. dont take anything from them unless its worth it. once they give you the check, its usually case closed.

Dont accept their offer. I think you can force them to have a 3rd party appraiser come and inspect the car, at which point receipts that you have for the things you may have bought usually count. Also do searches on auto trader for fd's in the whole country and show them that they usually go for more than 11k. Also show them the kbb that shows them worth like 16kish. Dont back down. Fight them until the end and tell them right up front that you wont accept the car being considered totaled for that small amount of damage. I have gone through this personally.

When I "totaled " my car the insurance company was going to give 8k and I told them that they better look up what it is worth and do some market value checks. after that they came back to me with an offer of 11.5k to fix the car because that would be cheaper than the actual market value.

You need to tell your insurance company to pull their head out of their *** and give you what it is worth, they are trying to screw you! Be firm, be a man don't let them push you around, you paid your premiums . Now you are going to end up with a salvage title if you let them total it.
