If you are in accident, make sure you have a witness or two (not riding in your car)

At least from my experience, unless you have a witness, you will be unpleasantly suprised.

When my car was hit, the 16 yr old driving the Explorer was cited for 3 violations (illegal lane change, inattentive driving, and driving out of state with a provisional license) after she admitted what happened to the police officer taking the report.

However, by the time the insurance companies got involved and the case went to arbitration, it became a "no-fault" accident that my insurance and I (deductable) ended up paying for (there was no damage to the Explorer, but my car was damaged) because no witnesses came forward and the police officer didn't "witness" the accident first hand.

Lesson that I learned - (1) police reports don't mean any thing anymore and (2) have at least one witness because stories change when insurance companies get involved.

It looks you have a very nice car and hopefully you won't have a problem getting it fixed. I am posting what happened to me to echo some of what others have posted as well as hopefully preventing someone from getting screwed in the future.

Even if you did hit the truck first, wouldn't he still be at fault for hitting you? I don't see what he is trying to gain by claiming that you hit the truck first.

fault will rest with the state. most states nowadays are no-fault states. they assign a 'percentage' of fault to drivers. but since you're insured, don't even sweat it. it's gonna be your insurance company duking it out with his. it's still a good idea to get the police report to figure out where you stand.

and yeah, get quotes from a couple reputable shops for the work that's going to be needed, and fight hard as hell to get that money from the adjuster.

aftewards, get junkyard parts or aftermarket, and pocket the difference.

Almost like my accident!! except the lady was going 35 and i was at a dead stop... car has been gone now for 5 months. Had to re do EVERYTHING. Bent my god damn front mount in half, bent my exhaust in half. Destroyed lost of plastics in the front and rear.

Nope. I told the truth. The truck was stopped, I was at a slow creep right behind him, and the talon slammed into me, shoving me into the truck's hitch. You can tell I wasn't under hard brake because the hitch would have gone through the center of my hood from nose dive.

I looked at the front chassis rail, where the bumper attaches to, and it's completely bent. This is going to be great, 3 weeks of owning this mint, perfect record car and it will already have a salvage title because some ******* hit me.
