There actually is logic behind the cali emissions laws. They test for differences in startup emissions, which are a very large part of emmisions on many cars. On the highflow cats, they usually work like stock when hot but kinda suck until then. This was what the pre-cats were for, start-up emmissions.
They are also cocerned about anything that gets vented into the open air.
For example, a open air BOV or a gas leak will both release some emissions other than what is released by the tailpipe.
