My fellow RX7 friend. From the pictures it really doesn't look good for you. If I read it right, you entered the intersection from a side road and stop sign. Unless the other driver ran a stop sign/light, he had the right of way.

I know it doesn't sound right, but how fast the other guy was going will be determined of no concequence in determining fault. This is totally a who-had-the-right-of-way situation. The damage to your car is actually evidence against you.

A Stop Sign basically says you cannot enter an intersection until it is safe. The other guy didn't have that same requirement. The simple fact there was a collision, any court will conclude you were at fault.

Sorry dude. Even if the witness's all testify that the other guy was going 100mph won't help you. I'm pained for you that you lost your 7, but there it is.

that sounds right, but he should not be fined for the accident the right of way laws are werid when stuff like this happens. so speeding is okay as long as you have the right of way ? WTF ?! speeding idiots no okay but looks okay according to cali right of way laws. thats stupid it doesn't make any sense where is the logic in that?! why protect idiots who can't obey the law? weird as it sounds you both might be at fault LOL.

of course I will admit i do stupid stuff in my 7 but thats 1-5% when im drving the 7. im good but not perfect.

the proof should be where you got hit. only 1 set of skid marks????
one set should be from your car getting pushed the other should be from them.
as for the insurance, somthing sounds fucked up.here in ny we MUST provide proof of insurance at any traffic stop( if the cop asked and all the time at a accident scean.get yoru self a good laywer sounds like your gonna have a battle on your hands

The bottom line to this after I have looked at all the information is this:

you MUST prove they were speeding period. you actually were at fault its called failure to yield right of way and the ONLY caveat to that law is if the direct traveling car was speeding, there not being any skidmarks on their part means they did not brake whatsoever it also means that the lack of skid is bad for you, at least if there was skid marks up to the point of impact it could prove speed, the damage to the car and the lack of skidmarks are your only ground to stand on, you must try to prove speeding thats your only hope my friend. from here on out never pull out unless you are clear no matter your thoughts on car position because most people ARE speeding and 10mph over/under can't be proved easily. Sorry about your Fc looked nice.

actually you might be able to get them on a technicality if you cannot get them for the whole thing, cause if your traffic laws are the same as ours, you MUST provide insurance and contact information to the other party if they request it. Since they didn't you can get them on it. i think it can be construed as falsification of information/identity. and you can probably also get that cop suspended cause what he told you was flat wrong.
