Dude, the bottom line is that they hit you. Whoever does the smashing is immediately at fault, and the damage to your car, witnesses and your own statement just adds to the fact that they were driving too fast, hit you, and they're at fault. Plain and simple.

Wow, thats not even an F-150 it looks like a F-250 at least. A turbo diesel monster, those things are fast and virtually unbreakable. IMO, here, in Miami, most of the guys that drive and Turbo Diesel or dually truck think they own the road, literally. When he saw you crossing the intersection, he probably said " he better stop and let me through cuz I"M NOT STOPPING!!!" I should know because I have been in the car with multiple drivers of these monstrous trucks. It's not fun or funny, just reckless and dangerous...

Good luck with everything.

the proof shows that the driver that hit did not attempt to try to stop, accourting to the lack of skid marks that are behind the truck when the point of impact happened. you can say he WASN"T near the speed limit or below it jugding from impact.( even if he or the driver had any common sense of caring for other driver the driver would of tried to stop.) but speeding show the that the driver is wreckless, careless and a danger to other drivers and peds on the street. liense maybe suspensed or revoked.
and truck is going to do more dmg due to its weight compare to a light weight car like the rx7. the rx7 will recive the full impact of the truck due to its weight. truck beats car in an impact anyday due to weight. remember objects in motion tend to stay in motion, law a phyics ( blah however its spelled) gravity loves to play with heavy objects. it sucks but like i said on BAR its good you were hit on your side and your alright. we have enough pll dying, parplysis-ed , sick in the bay.
I see your S4 was and still is one of the cleanest s4 i've seen ! cuz its the orginator of the S5 BOOO YA!

Here is an accident i got into 5 years back when some stupid british lady with an international dr lic decided to cross a solid white line, a left turn lane and come into mines.
I hit her at 70 and went airborne.Flew about 40 yards and landed.
When i got out I was fine and went to their car and asked if they were ok. they were amazed I got out with only a skin burn on my wrist from hitting the shoullder belt, the only party of the belty I had on. Thank god I am strong cause I bent the steering wheel also.
Milk it does a body good!.Put your lap belts on!
The glass didnt shatter as much but my firewall buckled on the drivers side. Went backwards about 2" inches.
Still drove it and got it out of the middle of the road. Surprised none of the tie rods broke.

I know these aren't front end pics but figured I'd show my accident too. I got hit going to my bank. I was only going 10mph if that and so was the car that hit me. fucked up part is that they were able to drive home I had to get towed.

I finally found the time to email my insurance rep the pictures of the accident along with diagrams and such.

The police report does not look good for me at all. The officer wrote me down for not yielding the right of way and he said that he believed that I was at fault. In the report he wrote that there was no sign of the truck speeding at all, and he marked me for not paying attention. If anything, the person ramming full speed into a car ALREADY in an intersection is not paying attention! There was a diagram showing the damage to my car, and he did not mark ALL the damage to my car.

What do I do now? The report also shows that the person claimed to be going 30MPH during the impact and the police officer supports this.

I would be sending the pics that you have to your insurence ASAP, and than see if it is possible to bring that officer to court in your state for filing a faulty report

That really sucks

This is the reason I video all my driving, though it only cost me $2,000 to learn that lesson.

Witness statement > police report 90% of the time. They were there, he was not. They witnessed the crash, he did not.

Use a fOI request to see if the officer involved has any specific training in crash investigation. Also take pictures of skid marks, the intersection and damage to your car (you should have got some more shots of their car too).

It takes about 100 feet for an f250 to dead stop from 30mph
Assuming they were doing the speed limit you would expect at least 30 feet of skid marks and an impact of under 20mph, judging by the impact I doubt they were going that slow.

Hate to say it but the picture / diagrams that you emailed to your insurance rep make the accident appear to be your fault, that teamed with the area of your vehicle that was hit gives me the feeling that this will not end well for you unless the witness(es) are definetly on your side.

There were no skid marks. He didn't attempt to brake but instead he sped up to overtake me even though I was already in the intersection about to finish my turn.

Yes, thats how it appears. Did you have a stop sign? If you had a stop sign I can almost promise you you are going to lose this one. I got into an accident exactly like this except my rx7 was the truck. I hit him in the same spot and the fool that pulled out infront of me, through a stop sign lost. His insurance paid me.

Im sorry for the loss of your car but I dont think you have a leg to stand on here. Through traffic has the right of way and you made a careless mistake.

in my opinion, you are at fault. you should have yelled the right of way to the truck because you were pulling out of a smaller street.

I like your story and all, I hope you win this, but this situation is not a fairy tale where your car is everything for you... this is life, and this is a serious matter where sympathy does not play any role.

BTW, cops on bikes are all ****, most of the time.

You definitely have fault, however you might be able to swing it to 50/50. It would be hard though since he did have right of way, but if he was speeding you might be able to do that.

Actually no, I made an unprotected left, the other car did all the smashing into mine, and yet I was still at fault because I did not yield the right of way.

Insurance investigators are very good at their job.
They can tell what really happened even though people lie - good investigators always assume people are lying (cause there's money involved) and look at the evidence for facts.
Give the insurance company the pics you took - that can help.

Drop the lying and cussing up the cops part.
If any parties in this investigation finds this thread, you're fucked.
This bad attitude is not going to help you.
You pay insurance premiums for a reason - let them do their job.
Of course, this is no guarantee you're going to win...but life is sometimes unfair.

well I could see where the cops see you at fault of the accident. It's a unprotected left turn yet they HAD to be speeding, The damage to the car is to far great be just at 30 mph.... Either way both are at fault, one for not looking down the street and the other for speeding in a 30? mph zone.

Just hope that you can take some action on them and at least pay for your medical bills.

Once again Rocky Good Luck.

John
