The police report was just finalized today and I picked it up. She was officially at fault. I had no insurance info until today so I couldnt contact her ins. company. I called and left a message this afternoon so we will see what happens. I looked up the value on NADA for classic cars and it ranged from 1400 to 3200, my car was in great shape mechanically and good shape externally so Im gonna try to get as close to the upper end of their value as I can. We will see.

Im just anxious to have this dealt with so I can start tearing into it and see if its fixable or what not.

And I have started it since the accident and it runs just like it did before. The tranny is stuck in a gear though. And Im pretty sure the core support was leaned back because the fan is impeded by the shroud.

Adjuster came and looked at it. Said it was in amazing condition and gave it high scores in all the categories it's evaluated in to establish how much its worth. I told him I plan on keeping the car and he said the way they settle is:

(Worth of the car that they determine) - (how much a salvage company would give them for it) = what I get

Ill find out on tuesday what the numbers are. Ill start taking it apart sometime here and finding out what I need exactly.

I know its been a while but here is a little update. The other parties insurance says it was my fault, even though the police report says otherwise, and they are not going to pay for my car. They tried to file a claim with my insurance company to pay for their clients car and my company refused saying it was their fault and completely not mine. Since I only had liability on my 7 my insurance isnt going to cover it, which I am fine with.

My only option now is to take the lady to small claims court and hope I win. My agent seems to feel I have a very good chance. Now I have to decide how much I should sue for?

Also I have started keeping an eye out for a tranny and radiator as that seems to be the major things that dont work right now, aside from the fender and bumper being smashed :o

That makes no sense. Would you be suing her or her insurance company and are they going to pay to fix her car?

I say sue. If you can get a body shop to give you an estimate. Then round up from there actually get like 2-3 estimates.

After the accident did you talk to the old lady? What did she say after the accident too you. And what was her statement to the officer? Why didn't you get her information before you left the accident

That's why I hate insurance companies. Avenge the 7

My wife had a similar situation. The other driver's insurance didn't want to pay. What will happen it will go to an insurance arbitrator. They will review the case and then whoever's at fault according to them will have to pay. Might take awhile, I think it took us like two weeks.

I work insurance claims. Her insurance company shouldn't be able to deny liability without reason. If it's her word versus yours, then the police report should be the determining factor.

Your insurance isnt going to pay because it seems you hold a liability only policy.

If you take it to court, in most states small claims has a cap of $5000.
I would suggest you ask for the full $5000. Get estimates, and NADA high value of the car. Also look for adds for other 1st gen's closer to 5k. They may only award you the value of the car not the cost to repair it.

Clean the interior and take pictues of the car from about 10 feet away to hide imperfections in the paint. You might want to wash and wax it as well.

Get photos of the intersection and construct a diagram of what happened. But it will be the police report that should win the court case for you.

If you win the court case its a win-win situation for you. You get the money and your car is not declared a total loss and be stuck with a salvage brand title.

Transmission stuck in gear, that happens, the S1 transmissions do that with any or no provocation. It does not necessarily mean major structural damage. S2 (not S3) transmission is an easy but much better replacement as the only thing that differs externally is the shifter. Or you can just get another S1 box which obviously will drop in. Do the clutch too while you're there.

It looks like you have mostly body damage. And look how sad your car looks. You need to fix her.

Their insurance cannot just decide not to pay. Usually your insurance company will help you out here, they are a lot more likely to help if you have full coverage since otherwise they are on the hook, but usually they will do it anyway.

One great thing about suing a company in small claims court, you don't have to hire a lawyer, but they do... and if all the evidence is in your favor (especially police report) then they know they don't have a leg to stand on and will settle. They are probably just doing this to get you to take less. You don't have to!

Maybe its different in other states, but in CA the insurance company doesnt have to agree with the police report which is what their company decided to do. Since their company is not going to pay, and I am not filing a claim with my insurance, my only option is suing the other party directly in small claims.

Atleast it is possible to fix your car, my frame was so messed up from the accident. We just went ahead and had it totaled, should have parted it out instead (no sense in letting all those useful parts go to waste) Hope everything works out for you.

You need to sneak into that lady's house and switch her pills around. Not only was it illegal to be doing a u-turn there probably but what kind of a retard would do that with an oncoming car with its headlights on?

Suing the other party directly might not be a bad idea. After all if they get sued they are going to wonder why their insurance company is not taking care of things!

But if you do have to go to court remember that you are suing some old lady so you need to be on your best behavior.
