Unhappy It's gonna be crushed, and so will I.

I went to the tow yard today, to get my car back.


I had 98% of the money. total tab was 872.50. I had 860. CASH.


They told me that they wouldn't take it unless it was a complete payment, and that I had till tomorrow to get the rest of it, AND come up with the tow-back-to-the-house fee... which was 125 bucks, otherwise, it was going to the crusher on Friday.



They were VERY pensive on answering me when I asked them if I could take the parts of value to ME off of it.... they told me to come back tomorrow, and talk to the manager, and we'd get something figured out.

This saga's been going on for about 2 months now, Chef i feel for you, but if you had moved your backside at the start, it would have never goten to this level. you jacked around and whined on the forum about it and didn't move until it was to late. Thats what procrastination gets you. Whether this true or not, it's totally your responsibility to take care of your car. Hell...who else would do me the same favor If I pitched in 20 bucks for their asses? Nobody...

I really would have at first, (loaned a 20 spot) but after listening to the entire saga over several cups of java, i got tired of it, casue he wouldn't move on his own....

You're absolutely right. I DIDN'T move fast enough, because the lawyers said they would take care of it.

However, the lawyers called me back to tell me that I was pretty much fucked either way, and to just pony up the cash and go get it.


So I did. I even got another job JUST TO GET MY CAR OUT... hence why I had the cash.


You guys are absolutely right for being cynical, and downright nonchalant. However, I wasn't asking for a handout. I was asking for y'all to wish me luck, and that they'd let me get my stuff from it.

Nowhere in my post did I say "Please, someone send me money!" If you construed it that way, and took it upon yourself to SEND money, then thanks, but no thanks... I had to EARN it.

I just want my car back... even if it means it's in pieces... pieces are better than nothing.

Hey Chef, which yard is it in? Let me give you a little heads up about the tow yards and the rules here in J ville. I used to drive wreckers here for 6 years. (westside)
By law, the tow yard has to give you the right to pay for your car. If no one comes to claim a car, they have to wait a certain number of days(I believe it is 90 days) then they have to "publically offer it for auction" This can mean a simple little ad in the classifieds. They have to auction it for the cost of their fees. IF no one buys it at auction, (usually by silent bid) they then have to go through Tallahassee to get either a abandoned vehicle title, or a certificate of distruction. IF a CD is issued, the car can't be titled or be put on the road again, it has to be parted out. IF the car has any value, it is usually retitled and then sold at a dealers auction.

This all takes a long time. But if you come with the money, they have to give it to you. The catch is that everyday, they charge storage fees. Do what it takes to come up with the rest of the cash and get it out the gate. They can't charge you when it is outside the gate. Then tow it with a strap, get a car dolly or what ever, to get it out of their area. They can "tow" it again if it is left over night and it would start the whole process over again.

Hope you get it with no problem.

Dude, with gas nearly $2 a gallon, you don't even need an Rx-7 if you can't come up with 12.50.

You could've mowed some yards or picked up enough aluminum cans by now to pay for it. How long has this whining been going on ? Seems like weeks and weeks. Hell, deliver some pizzas for a night or two and then quit. Just don't deliver to the trailer parks 'cause they don't tip for ****.

Save your breath. Either this is a scam, or this dude does not deserve to have the car. If it was my car I would know the rules inside and out. He has time to whine, and post other extraneous messages on the RX7club but can't be bothered to do some basic legal research.

There have already been several suggestions how to get the car back. But he can't even even collect scrap aluminum or figure out how to come up with $12.70?

All the questions he has been asking for the past month are covered by the laws. It just took me less than 10 minutes to find the Florida and Jacksonville laws on-line. Try searching through them and you might get some enlightenment and ideas. For starters I searched for tow and found a couple interesting sections:

The Jacksonville statutes are on-line also. Go to www.municode.com and click on Florida and then look for Jacksonville or whatever jurisdiction you are in.

Don't try to represent yourself in court, but you can do the research which is what an attorney would have to do anyway. When you buy a house you would hire a buyers agent but also do your own research, and when you have a disease or need surgery you see doctors but also do your own research. Since you have a personal stake you look out for your interests. Study all the rules and look for somewhere the towing company or apartment complex slipped up and didn't follow proper procedures.

You need to quit riding through life like a ***** and take some control of the situation. Or else quit scamming people for sympathy and money.

well, it looks to me like he believes he needs 137.50. 12.50 for the fee and 125 to tow it back. plus the fee for it staying overnight again. (unless they wanna be cool about it). i don't know the story but good luck. hopefully you can get it back with some good talkin, or at least get some parts off.

Save the $125 to tow it back. Just pull it with a strap, or have someone in another car follow behind and push. How far away is the place?
1.a. Any towed or removed vehicle must be stored at a site within 10 miles of the point of removal in any county of 500,000 population or more, and within 15 miles of the point of removal in any county of less than 500,000 population...the operator shall return to the site within 1 hour or she or he will be in violation of this section.
I hope you have documentation and witnesses for all the conversations with the towing company. It looks like they initially told you to come the next day when they were required to let you have the car within 1 hour. And they should not have charged storage if it was less than 6 hours. They should have a copy of the towing contract at the storage facility.
...no storage fee shall be charged if such vehicle is stored for less than 6 hours.


9. When a vehicle has been towed or removed pursuant to this section, it must be released to its owner or custodian within one hour after requested...

It looks like you should be able to get your tools and personal items out of the car:
10) Persons who provide services pursuant to this section shall permit vehicle or vessel owners or their agents, which agency is evidenced by a writing acknowledged by the owner before a notary public or other person empowered by law to administer oaths, to inspect the towed vehicle or vessel and shall release to the owner or agent all personal property not affixed to the vehicle or vessel which was in the vehicle or vessel at the time the vehicle or vessel came into the custody of the person providing such services.
Check your parking lot to make sure the signs were posted in compliance with 715.07:
a. The notice must be prominently placed at each driveway access or curb cut allowing vehicular access to the property, within 5 feet from the public right-of-way line. If there are no curbs or access barriers, the signs must be posted not less than one sign for each 25 feet of lot frontage.


b. The notice must clearly indicate, in not less than 2-inch high, light-reflective letters on a contrasting background, that unauthorized vehicles will be towed away at the owner's expense. The words "tow-away zone" must be included on the sign in not less than 4-inch high letters.

c. The notice must also provide the name and current telephone number of the person or firm towing or removing the vehicles, if the property owner, lessee, or person in control of the property has a written contract with the towing company.

d. The sign structure containing the required notices must be permanently installed with the words "tow-away zone" not less than 3 feet and not more than 6 feet above ground level and must be continuously maintained on the property for not less than 24 hours prior to the towing or removal of any vehicles.

Also, since 35 days have elapsed they can sell the vehicle, but there are notification requirements. If they are not following them, they are in violation of the law.

Where did you get all of that from?


All I said was I wanted to get my car back. I took it upon myself to get the money to get it out. NOWHERE did I ask for a handout. Especially since I wouldn't be able to pay it back for some time.


Before you go and dismiss me as someone who you THINK is whining... let me clue you in... I work 90+ hours a week. The little free time I DO have, I make the most of it. The tow yard is being semi-cooperative at this point, which is a plus.... but at the same time, they still keep accummulating the storage fees.


I was just posting to let people know about my car... and that soon, most of it's parts will be available... CHEAP.


Sorry Kleinke, or any of you other 'haters" who think you know everything, when you really don't have a clue about ****. Get off your ******* high horse and your "if that would have been me" soap box... I'm doing what I can to get my car, if not just it's parts back. So **** off.

But in a situation like what has been described over the last couple of weeks on the forum, i know (and I'm not from your state) that there are rules that protect owners of property (in this case your car) they have been walking all over you, and you let them.

any lawyer that verbally tells you he is going to take care of the situation etc etc. has just entered a legally binding verbal contract. this will hold up in court, do a quick serch on torts, and you will quickly find that out,

I also know that if they take your property (car) that the law while not perfect is designed to help out the little guy, believe it or not, I have been sued before, and I have dropped lawsuits in both cases, I won, and I was over seas doing it long distance through a lawyer.

if you went to the wrecker yard, and they refused you your personal property then they were bsing, I got arrested for speeding, and the wrecker yard and the cops had to let me get my personal effects, they had to cataloge the car when it arrived at the storage, it came back dinged up, do you think I paid for it? hell no.

in short, grow up pull the car out the gate, get a friend to tow you. do whats necessary, but vice wasting time typeing about it, do something about it
