I just want my car back... even if it means it's in pieces... pieces are better than nothing.

If you were smart you would have payed the fees right away so they didn't accumulate and then with the help of your lawyer try and get your money back from the towing company.....its sounds like your still bitching here ...even your last post in this thread. Your pathetic dude.

Rather than all of you jumping all over him. I know him personally. Nowhere did he ask for anyone's help or money. He was just reporting the shitty luck he's having.

As for paying right away.. its hard to spend money you don't have. I'm sure that the apartment complex was in violation of the law, but sometimes its hard to prove things when you don't have the money to pay for anyone to help you out. The man works all ****** day. Give him a break, show some sympathy.

Florida, especially Jacksonville, is a lot different than you think when it comes to enforcing some laws around here. You seriously get fucked here...

So in ending, lets just hope he can save his RX-7. I'm sure thats what all of you would want if you were in the EXACT same scenario.

You work 90 hours a week and dont have a few hundred bucks to get your car out when it FIRST gets towed? hmmm ok

Hater? If it goads you into taking some action and standing up for yourself, then yes. When you went to the tow yard, short $12.50 out of $872.50, they told you to come back the next day to talk to a manager. Did it occur that maybe they just wanted another day of storage fees? Was the manager off deep-sea fishing or did he have a cell phone? Was the manager the only decision maker? Who actually owns the yard? Wake up! You are letting yourself get walked all over.

I don't like to see people get kicked around, even when they allow it. That's why I took the time to look up the statutes for you. If you had done the research you would know they were required to release the car within one hour when you first called them. You would know they were lying when they threatened to crush the car, and you would also know they can not refuse to allow you to get your personal items from the car. You saw your car in the yard on jackstands for god's sake (which sounds like intent to cause mental distress). If you can document (pictures, tape recordings, etc) and get witnesses to some of these shenanigans you might have a decent case against them. Either: (1) file a civil claim for property suit now (I don't know how that works in Florida) or (2) pay them now to get the car back and sue later; or (3) wait until your car comes up for auction, have a friend buy it for you (better if not you yourself), then sue them. If the car is auctioned be warned they might countersue for the difference between the sale price and the storage fees. (Get advice from an attorney.)

Have you read those sections of the Florida code yet? Did the towing yard have a copy of their contract with the apartment? Do you have a copy of the contract yet? Did you go to your parking lot and measure the signs and distance between them? Have they mailed you a certified letter announcing a sale?

Note the above is all just suggestions and not actual legal advice. You should consult an attorney (or find a better one). Try your local RX-7 club maybe there is an owner who will help you out pro bono.

another suggestion

Here is another idea. Whether you intended to or not, you have done a good job of eliciting sympathy for your plight, at least on this forum. So why not use that ability to try to get your car back?

Go (along with someone else) talk to the tow company manager. If that does not work, talk to the owner. If you still don't get anywhere, talk to the towing company's landlord. The names of the business owner and landlord are public record and you can find them out, (along with their home address and phone number as a last resort).

Some of these good old boys in the towing business can be real ******** and sometimes enjoy making sport of hapless unfortunates who find their cars towed. However they might also have a streak of humanity underneath, and if you are able to touch on that, they might cut you a deal. One way that people can be such ******** and still sleep at night is by dehumanizing the victim. What you need to do is to re-humanize yourself.

Call ahead, and ask if you could please have a few moments of his time. Be very POLITE and even DEFERENTIAL. Your goal is to put a face on the situation and make him see you as human being rather than a faceless schmuck. Go in and try to establish a rapport with him. Explain how you had a misunderstanding with your apartment and his company was not part of the dispute. Don't tell your whole life story, but a couple highlights won't hurt. Explain how important the car was to you, and how you have been working three jobs and 90+ hours a week trying to raise money to get it back. Take your time with this part, and putting yourself in his shoes, try to elicit some sympathy for your plight without placing any blame.

Then, try to make a deal. He is in business, with the goal to make money. Since they kept referring to crushing the car, presumably they feel it is only worth the scrap metal value. If they sell it at auction, they may not make much money unless they sell the wheels separately (which might be of questionalble legality). If you offer him $860, that may be more than he would net by selling it, and he would still end up ahead, business-wise.

It is very important to take someone else with you. Do not take a bouncer, bodybuilder, football player, attorney in suit and tie, or anyone who might create intimidation. A girl would be best, as girls are less threatening.
She does not need to do any talking, but simply be there to listen and ensure there is no misunderstanding. (If it were me, I would even take a clandestine tape recorder, but no need for that and it might get in your way.)

There is no need to threaten lawsuits since towing company is probably used to being sued, and they figure most are empty threats. Although deep down they don't want to pay legal bills either.

Try this and let us know what happens. Be persistent and creative if you can't easily get hold of the owner.

Jesus guys, I know I don't post here often, but when I do I'm always seeing a common bond between all of us....whether it's helping people out with troubleshooting a problem, or being kind instead of shooting some newb off to the "search" function....

What the Hell has happened? Chef is right, nowhere did he ask for sympathy...he only explained the current situation for those who he thought might be interested....sad to see that no one really seems to care. I'd say it pretty much sickens me to read all of your posts....accusing him of searching for donations or sympathy....

Take a walk in his shoes and then criticize him, or either don't say **** at all.

This is the 2nd thread of this long saga and if you read that first and this one you'll come to the conclusion that the smpathy turned to disbelief that somebody would let something go this far. Bad decisions, indecision, lack of a plan, a bunch of whining, and plain old not taking tons of good advice is clearly evident.

Sympathy and love are both rare medicines best administered in measured portions.

And for what it's worth to the rest of the peanut gallery, the main factors fighting me in this battle are time and money.

There's just NOT enough hours in a day to go from one job on one side of town to the other, on the completely opposite side of the largest city in the lower 48 states.... it's a 45 minute drive without traffic to get from one side of Jax to the other. Also, money. Money is what is ruling my life right now. I'm not working 3 jobs because I have a good work ethic, or because my body likes to go weeks at a time without sleep... it's because I'm prioritizing right now, and as much as I want to put my 7 on the top of my list, I can't. I owe the student loan corporation over $82,000. I owe Discover card over $4,000. and I owe the biggest donator to my life, my parents, over $20,000. I got myself into some **** when I was younger, and I'm having to pay for it now. It sucks, but it's my bed, and I have to sleep in it. I am taking full responsibility for my actions. All I did was post a little update as to why there haven't been any "here's how I did in autoX today" stories, or "watch the vids of my track day!" threads. Everything comes down to money.

Well this is the first time I've posted on the 2nd gen of this saga. Well if you have to work 90 hours a week, then that $82000 you spent on college was for crap. And no only 2 people offered you money to bail you out, so no one is offering you sympathy after the first week of this. You started off asking for help, then after not taking any of this advice what do you expect?
When you first went to the yard and you said the car was on blocks you should have called the police then a reported the theft of your rims, what did you do NOTHING!!!!
If you don't want peoples opinons, don't post in a PUBLIC forum.

P.S. you should have your car back by now! After the first day! You could have taken a cash advance on one of those credit cards you love so much. You had no problem before spending the money on stuff, but when it came down to something important you did nothing.

Until one of those two things happens, I don't think it's worth everyone's frustrations to keep this banter going. Chef, I feel for you, I really do. I wouldn't want to lose my ride. But I can honestly say that if anything happened to mine I'd be all over them. I hope you get your car back, but I'm going to close this thread and stop this banter. Post when you have some final results, I hope they're good ones.
