so i got a reckless driving ticket

so i got a reckless driving ticket

i was dicking around in a parking lot , and some dud called the cops, the guy followed me into a nearby city, and then a cop pulled me over and harassed me about still having my autocross numbers on my car, then he searched my car, and made big deal about my pocket knife. the cop never saw anything and all he got out of me was that i was testing my car, which is a little incriminating, but for the most part it could mean a multitude of things.

anyway, i plan on continuously rescheduling the court date until they wont let me. then im either going to try and say that i was just tuning my carb, because the ear witness couldnt hear tire screeching on wet asphalt and he pulled up as i was leaving, so he didnt see anything. or im going to try and plea for forgiveness, this is my first offense in four years of driving.

what do you guys think i should do.

If it was in a parking lot then research the vehicle code for your area. Usually they cannot nor do they do anything for that type of action unless you were involved in an
accident.

It depends on how much the ticket is and local laws. my first and only ticket was about 9 months ago and there's a thing where you don't admit to anything but you pay the fine and after 6 months of no tickets it goes away.

It only works once but it's worth doing. To be honest you probably won't be able to get out of paying the ticket, so you should see if they offer "deferred sentence".

The charge is bogus. Since the so-called witness was not there during the entire duration to see you begin to do whatever it is that you were doing to the very end, he is not a credible witness. All he's doing is assuming. And, the cop giving you a hard time over your car because of the Auto-X numbers, and searching your car also sounds fishy. Really, a cop can't search your car without probable cause, i.e.: being a suspect of trafficking narcotics, having illegal arms in the trunk of your car, etc.

If the ONLY thing you said to him was "I was testing my car", don't say anything else. It is always best to play dumb with a cop so that you do not incriminate yourself. Testing your car can mean a lot of things. You felt that your car was pulling to one side so you pulled into an empty parking lot and checked your air pressure. Your engine was making a funny noise so you pulled over to check it out. The list goes on. Play the "innocent kid" bit.

Damn Cody, that really sucks. This is total BS though. No way he can ticket you if he never even saw anything. And even if he had seen you, parking lots are private property. Don't delay the court date, just go in and embarass the bastard in front of the judge. Just remember to pull your damn pants up before you go in there kid.

yes deffenately fight it , what they didnt see is your evidence against the people.
I have gotten out of seat belt violations, driving while suspended ... among other things and since i investigated laws and had a kick *** lawyer. i got out of all my tickets ever and i now have a clean driving record. remember to massage the sytem more then 'do it dry' lol .

theres NO WAY a ticket will hold up in court if the cop didnt see anything. do some research about your local laws and go to court and kick their ***.

i got a wreckless driving ticket ******* around in a parking lot when it was wet in my old accord. i got it changed to a parking ticket

when you go to court and you say something about the cop not seeing it. theyll say we have an eye witness. ask if that eye witness speaks the legal truth and what makes his word better than yours.

ok, i'm a police officer in ohio and here are the laws. an officer cannot cite for ANY offense in a parking lot of a business OTHER than OVI, DUS or WRECKLESS OPERATION OF A MOTOR VEHCILE(i.e. donuts, drag racing etc.) the officer must witness the activity on order to cite the vehicle. in ohio unless an officer has probable cause to search, the officer must ask for consent to search once he has told you that you are free to go. if you say no then the conversation is over right then and there. max blade length of a knife on your person if 3in, with some exceptions can be made. if memory serves me correctly, MI laws are very similar. make sure you do your research and find out the officer's probable cause for the traffic stop.

where exactly could i find this information? online, or go to the courthouse and ask for something specific?

your state should have a book of laws that is open to the public. ohio's is called "ohio revised code". you may want to try a google search. i know that the orc is on google. if you need anything, dot hesitate to ask.

next time dont do something silly with autocross numbers on your car. You dont want to get your autocross chapter in trouble or lose a site etc.

about a week ago I was doin some slidey stuff in the parking lot of my work before heading home, an undercover cop pulled me over not a block from the parking lot, I thought I was in for reckless driving, but apparently I didn't fully stop at a stop sign, and he let me go with a warning *Few* So Cops CAN ticket you for wreckless driving in a private parking lot right? Or do I do a complete 360 slowly around empty lots at 3 am before trying anything a waste of time?

You DO NOT need a lawyer. Quit sweating it so much. We already told you that the charge is bogus. He did not see you commit the alleged violation. If you get a lawyer, then you're wasting more time and money. A few others have already given you perfect answers on what to say in court.

in a private parking lot no they can not give you a ticket for anything even driving through the lanes you park in at least thats how it is here.

Start calling lawyers and hit one of them up for a "free consultation", which most of them provide. This sounds to be so clean cut, I'm pretty sure they'll just laugh and tell you what to tell the judge. This would still be free of charge... Hell, they'll probably be able to do it over the phone!
