I have never had one (knock on wood), but I know a guy who got his third -- in ten years -- last year. Bad news! 30 days in jail, lost his license for life and if they catch him driving again in the first 5 years he will go to jail for 18 months. Three strikes and you are OUT. Don't be that guy.

Get ready for all the flames from all the people that swear they don't drink and drive ever (but probably do).

Dunno what to tell ya other than get a lawyer, and stop drinking and driving

How old are you? What did you blow? What is your criminal history like? What are the circumstances that led to you being pulled over and arrested?

I have DUI experience, so I can point you in the right direction.

A lawyer makes everything SO much easier--if not just for the peace of mind. Expect to pay a minimum of $1500 if you choose this route. However, if the case for some reason goes to trial (which is rare), expect to pay closer to $3-4k.

I am 25 years old and never been charged or been citied for a felony or any other criminal activity ever. I have had my share of driving offenses though. I was pulled over for speeding i passed a guy in front of me doing 51 i was clocked at 79 at least it wasnt 30 over then it would be reckless driving. I blew a .012. i am getting a lawyer and already have court dates set. my lawyer i might get is a prior prosecuter of similar cases but now is defense so thats a plus to know both side well i guess. any help to keep me on the road enjoying these cars would be appreciated. i definetly wont drive after have had a drink though this **** is a headache.

That'll be a major plus that your record is good. And just so you know, a DUI (or similar) is not a felony. It's a gross-misdemeanor, so don't worry about that. Also, having only one speeding ticket is really good as well...

Blowing a .12 is really good too, because there is a cut-off that determines the severity of the infraction, and I believe it's at .15.

Your first court date will be your arraignment (next couple of days?), and this is where you enter your plea. I would advise waiting until after the arraignment to "purchase" a lawyer, since he'll want to come to the arraignment (which is unnecessary) and will cost you around $250 for his time.

Don't wait too long before getting that lawyer though, because the DOL has a seperate hearing which will determine if and when your license gets suspended. There is a mandatory 30 day suspension, but if for some reason the paperwork doesn't reach the DOL in time, than you'll win the DOL hearing and not have to have your license suspended. This hearing typically takes place over the phone via your LAWYER.

Definitely do not get into any trouble until this stuff's behind you.

He said .012 so I am assuming he meant .12 which is above the legal limit. .012 is nowhere near the legal limit....

So you got pulled over for passing a slow car... Why did he check you for intoxication?? Were you showing signs of being drunk, or did he smell it, or what??

0.08 mg/dl is the now legal limit in WA,
it used to be 0.10 mg/dl in the day.
i have seen live people as high as 0.60 mg/dl, although they were passed out in the ED.
This particular person dropped down to 0.45mg/dl and pulled his IV and walked out of the
ED. The police found him at the nearest bar by tracking the blood trail.
He was drinking a beer.

I had a friend who was a two-time ex-con but he knew all the tricks when it came to getting out of DUIs. First and foremost: get a lawyer. If you blew into a breathalyzer that's not good (you had the option not to.) In one of his cases he got off because he had a metal stud in his tongue and that allegedly skews the results, so it was thrown out.

Get a good lawyer.

Sorry bro, but that's poor advice...

If you refuse to blow you get a MANDATORY ONE YEAR SUSPENSION OF YOUR LICENSE... Not only that, they'll assume you're drunk and arrest you anyways for not complying. Now, they might not have concrete evidence in court, but the police will say everything he needs to say to prove you were drinking--I.E. slurred speach, red eyes, smell of alcohol etc. A police officer is legally considered an "expert witness", so his testimony means a LOT.

I won't get on my soap box with fists of fury this time around, but guys seriously, get a sober person to take you home....I'm on those same roads with my wife and 2 little girls driving home from the movies or from grandma and grandpa's house, while you are intoxicated cruising around thinking "I only had a couple beers."

Seriously, the fact that so many of you are making light of this subject really scares the **** out of me.

Oops, you're right. I was remembering wrong. I just grabbed the card I got from a lawyer and it's the field sobriety test you're supposed to refuse, not the breath/blood test. Additionally, you shouldn't answer any questions but instead insist the officer contact your lawyer (mine provides a pager #.)

Washington sucks... The Legal limit for DWI (Driving While Intoxicated) is .08, but if you blow a .001 and the cop feels you're too intoxicated to drive you can get a DUI (Driving Under the Influence) My best friend got a DUI when he blew a .06

WRONG! One year manditory is only if you're under 21. If you refuse they can take you in and take the blood tes at the station. which is waaaaaaaaaaaaaaay more accurate, but you get another 30 minutes to sober up. You don't have to take road side sobryity tests either. Since they're subjective an can be deemed degrading you have the option of the privacy of the blood test at the station. My again I have 2 uincles that are seattle cops and they both told me if ever in the situation to refuse road side tests and blowing. You're not required by law to do either. Pus the road side tests are designed to be failed. Just try them sober and you can barely do them. So a little bussed they're desigend to be a failproof failure.
