So I just picked up my car with a fresh rebuild about 5 days ago. A component failed or the installation of the component was under par and I had fluid leaking which caused my car to overheat. It is still covered under warranty so i told them my situation and they said, "if the engine is burned inside (im guessing that means the rotor housings are scored) then i cannot warranty it" It is covered under a 1 year/12,000 mile warranty. Can they deny my claim. If it did not spring a leak it would have never gotten a chance to get hot. BTW....it was idling when this situation occurred.

If the shop rebuilt and installed the engine, then by any standard of ethical fairness, they are probably on the hook for your five day old engine. The legal representation required to get them to honor the warrantee is another story. It could run anywhere from a $100 threatening letter, to a couple of hours of prep and a day in court ($2500).
Of course, the legal posturing may be for naught . Could you define “overheated”? Was the temperature needle pegged for an eternity and only shut down when the volcanic ash level was sufficient to clog the intake? Or was it more along the line of the temp needle simply creeping up until you shut it down?

From outside appearance the engine seems to be normal color. I will disclose the shop when I am certain they will not honor the warranty. I have to bring it in (towed by my expense) to get it checked out. I do not know how long the engine was hot because I left it to idle. The meter was at full H though. Thanks for all the replies. I worked too hard to save up money for this rebuild and I'm not willing to see my money just go down the drain
