Thumbs down my f$%#ed experience with barrier motors/lincoln mercury of bellvue

this is what i wrote the attorney general:

on 11/29/2008 i purchased a 2005 mazda rx-8 from lincoln mercury of bellvue. the salesman who helped me was robert manyon. i needed full coverage insurance before the car could leave the lot, so robert called and aquired insurance for me from orion insurance group. i gave him $400 for the down payment and first months coverage. $200 i gave in cash, and $200 in a check which i have a photocopy of. on

around the 17th of december my car was damaged due to snow, so i dropped the car off at mazda of olympia. michael in the service department tells me that my warrenty will not cover the damage and that i should contact my insurance to file a claim with them.

a few days later i recived a letter from orion insurance group stating that i am not covered because they never recieved the down payment. i called robert at the dealership and ask him why i recieved this letter and he said it's because i didn't make the next months payment, and re-assured me that he did in fact give them my down payment. i called orion insurance and they tell me that they never recieved the money from robert. a few minutes later robert calls and tells me not to contact the person i had talked to at orion because i am going to get her fired, and if i have any problems to contact him and he will take care of things. shanna at orion calls me back and asks if everything is ok now, and that robert said i was mistaking which papers i was looking at.

the phone calls continue and robert is adamant about me not contacting orion insurance group, but because the $400 dollars i gave robert never made it to the insurance company i have no insurance and am stuck with reparing the car myself. for a minum of $6,500+tax.




i have filed a police report, and contacted an attorney. after a visit from bellvue PD my $400 i gave him is on it's way.

and if you're wondering about the damage. the first hard snow day a chunk of ice ripped off the bottom of my radiator and the coolant loss prevented the temp gauge from reading properly and i melted the coolant seals.

Sounds like your salesman was up to some kind of monkey business.

Contacting an attorney was probably a good move.

Hope you can get it resolved Ok.

So you got to drive your car for what, 2 weeks?

Yea dude 6500 dollars is worth hiring an attorney to get the rest back. Hope his 200 cash was worth pocketing. You would think by company policies that the requirement to have full insurance before being able to take the car off the lot that the company itself would be liable to repair the car for their workers mistake. they hired the idiot they should have to pay for the idiots mistakes.

well, i spoke with the GM for barrier motors tonight and it seems like the finance manager at lincoln mercury is trying to keep things hush-hush. he said he will get to the bottom of things by friday.

all i want is the repairs paid for and a loaner untill it's done. but if i go to court thats a whole nother story.

and i drove the car for 18 days.

well definitely be persistent on the matter. the gm is gonna have his work cut out for him.

from my experience at working at burien toyota, if you EVER have any problems concering payments or LOSS of payments in your case. call in and ask for the GM. if they try to forward you to the sales rep that you had, keep insisting that you wish to speak to the GM. MOST of the time, GM's are well paid, and are usually pretty **** concerning rules at the dealerships they are paid to look over. as for the sales rep you had, thats some downright dirty business. what you should have done (not to give you a hard time) is wait till the payments for the insurance were verified before driving off the lot. i remember we used to countdown as customers were driving off the lot, because the second the car leaves the entrance/exit the deal is "certified" as you have taken the order. there have been occasions where customers came in, payed, did all the paper work, got in the car, and before they reached the exit, pulled the car in reverse, and said "i don't want the car actually" and its a law that UNTIL the customer takes delivery, that the deal isn't finalized and we had to give them their money back. as for what to do from this point on, its good you hired an attorney, usually just the threat of a lawsuit or further trouble for a car dealership in these hard times will make them bend to you will. if you have any further questions about dealership bs just pm me! good luck with getting your money, insurance, and repairs done!

I worked for a dealership for several years and i have also seen some really messed up things deal wise car wise etc etc. But "hansaysso" is 100% correct you want to speak with the General sales manager or GM he manages all the sales people and overseas car deals if something fishy is or has happened that's who you need to speak with, they are usually ruthless, and if he or she keeps blowing you off you can demand to speak with the owner or find out how you can get in contact with him or her, Normally Dealerships each one of those dealership is a franchise and is owned by 1 or several people.

Again "hansaysso" is correct, As far as the insurance goes that is correct the dealership is responsible to make sure you have full coverage if you finance the car before the car leaves the lot. I have seen it where someone got a new car w/ 0-20 miles on it 60 miles 3 hours later or around that and its totaled out wreck same day "no joke." I have seen it a few times.

Its strange how your payment was never received, ( Also Not to be hard on you) But next time I recommenced a major insurance company. I'm with and have bin with pemco insurance www.pemco.com for a long time and they have bin great to me so far A+.. I have never even herd of this orion insurance before. :-(

That's just my 2 cents hope this helps good luck in getting your car fixed as well.. rx-8 are awsome. I'm cant wait for turbo rx-8 to come out in the usa.

Filing a complant with the BBB is also a good idea people go to there webside and they will see your complant and what they sent back as an answer.

Car dealerships work the same way with their loan process. They go through companies that are willing to accept the most applicants for loans. IT doesnt matter to teh dealership where you get your money or what the small print is on the contract just as long as the car sells and you owe it. Duh ! then people get accepted that shouldnt have cars, debt gets accumulated in teh masses and hello welcome to TODAY! WOOPIE! They do the same thing with insurance companies, Just curios but where is orion insurance located at? My friend had a new scion. he lost his job because of a motorcycle accident and was in constant surgery, He ended up gettin his car repo'd by the loan company. The loan company for some reason this small little company was located in texas, you couldnt ever get a hold of them when u called. Prior to losing his car he had ONE late payment and they were going through the process to repo his car. Alot of people dont know it but in the small writing on credit cards, loans ect. stated on the bottom. ONE late payment allows for ANY of your credit cards or loans to rise in interest, ONE late payment also allows for ANY loan company to repo ect. Just a thought to think about before skipping through the contracts.

I have been with pemco sense I started driving, I turn 18 in a few weeks and I got my licence when i think i was 15 1/2. They have been great. Also My motorcycle was insured though Progressave (because pemco doesnt have motorcycle insurance) and They do a great job aswell. very happy with both.

I hope everything works out.

all I have to say is go in and tell Rob you have an appointment to talk to Maria Smith about this situation, even if you actually don't..tell him this anyway, it should scare him into taking this thing very seriously for fear of losing a job.

at this point everything is being handled by my lawyer. he sent them a very nasty letter, and gave them till thursday to take the car back and give me a full refund or we will be using my other legal options.

the GM was not helpful at all, but i have copys of everything and a poliece report stating that robert admitted he took the money for himself.

if it goes to court i will sue for much more, and all the evidence is in my favor.
