Legal advice for a friend in VA

My gf's coworker got rear ended at a stoplight by an uninsured 19 year old driving a pickup truck. Her car was declared totaled by her own insurance company and they're only offering her about 1/2 of what her car was worth based on blue book values. Beyond sending in evidence to her insurance company to show that the car is worth a lot more than they're offering to pay her, what can she do? Is it worthwhile to hire a lawyer in this case? She's going to end up paying a lot of money ($6-8k) for someone else's mistake while they get away with nothing more than a ticket issued by the police at the time of the accident. Any recommendations on who she could talk to? Thanks!

I'd also suggest calling a lawyer and reading a good book. I read "Surviving an Auto Accident: A Guide to Your Physical, Economic and Emotional Recovery" after my accident and it was very informative. She's going to have to negotiate w/ her insurance company and work her way up the food chain until she gets what is fair.

In MA Driving Uninsured is not "just a ticket" He will be summonsed to court and have to plea out some sort of probation. If it's a subsequent offense he may see jail time.

All she can do is negotiate.

Edit: Take or discard my advice. I work in the busiest courthouse in my county.

reread what OP posted
doesn't say his GF was hit by an uninsured motorist
it's that GF's insurance company doesn't want to pay out the value of the car
What she should do is get a lawyer because they are going to have to sue the other person insurance company to make up the difference.
They also need to see what EXACTLY was covered on the GF's insurance policy, she may only be entitled to half the value of the car after all.

Read insurance policy, hire lawyer, negotiate with and/or sue g/f's insurance company, sue uninsured motorist in civil court for physical injury/medical/ and uncompinsated difference of property damage.
